Defendants
COMPLAINT
AND NOW, comes plaintiffs, Dennis Dorsey and Jean Dorsey,
by and through their counsel, Cunningham & Chernicoff, P.C.,
and file their Complaint in Assumpsit and in Ejectment against
the Defendants Kathy Lewellen and stacy Grudjinski, and in
support thereof avers as follows:
1. The plaintiffs, Dennis Dorsey and Jean Dorsey, are
adult individuals who have an address located at 322 West
Green street, Shiremanstown, Pennsylvania 17011.
2. co-Defendant Kathy Lewellen is an adult individual
currently having an address located at 908 West Trindle Road,
Apartment #lE, Mechanicsburg, pennsylvania 17055.
3. co-Defendant stacy Grudj inski is an adult individual
currently having an address located at 908 West Trindle Road,
Apartment #lE, Mechanicsburg, Pennsylvania 17055.
4. On or about December 1, 1994, the parties executed
a Lease Agreement whereby Kathy Lewellen agreed to rent the
premises known as 908 West Trind1e Road, Apartment #lE,
Mechanicsburg, pennsylvania 17055 for the sum of Five Hundred
seventy Five and 00/100 Dollars ($575.00) per month. Other
occupants of the premises were set forth on tho December 1,
1994 Lease Agreement as stacy Grudjinski, Ashley Grudjinski,
Michael Grudj inski and Nicholas Grudj inski. A true and
correct copy of the Loase Agreement is attached hereto and
marked as Exhibit "A".
5. Pursuant to the terms of the Lease Agreement, the
Defendants agreed to pay the sum of Five Hundred Seventy Five
and 00/100 Dollars ($575.00) a month rent on or before the
first (1st) of each month. In addition, the Defendants agreed
that they would be obligated for a Twenty Five and 00/100
Dollars ($25.00) late charge in the event that they failed to
pay the sum of Five Hundred Seventy Five and 00/100 Dollars
($575.00) by the fifty (5th) of the month.

6. The Defendants agreed that no pets and no sUbleasing
would be allowed for the premises known as and located at 90B
West Trindle Road, Apartment #lE, Mechanicsburg, pennsylvania
17055.
COUNT I - IN ASSUMPSIT
7. The averments set forth in paragraphs 1 through 6
are incorporated herein by reference as if more fully set
forth.
B. The Defendants have committed substantial and
repeated violations of their Lease in that they have failed to
pay rent for the months of July, 1995, August, 1995 and
september, 1995 in the amount of Five Hundred Seventy Five and
00/100 Dollars ($575.00) per month.
9. The Defendants have violated their Lease in that
they have failed to pay the entire balance due for the rent
due for June, 1995.
10. The Defendants have violated their Lease in that
they have failed to pay late charges for the months of June,

1995, July, 1995, August, 1995 and September, 1995 in the
amount of Twenty Five and 00/100 Dollars ($25.00) per month.
11. As of the date of this complaint, the Defendants owe
the Plaintiffs the sum of One Thousand Seven Hundred Twenty
Five and 00/100 Dollars ($1,725.00) which represents rent past
due and owing for the months of July, 1995 through september,
1995.
12. In addition, as of the date of this Complaint, the
Defendants owe the Plaintiffs the sum of One Hundred and
00/100 Dollars ($100.00) which represents late charges for the
months of June, 1995, July, 1995, August, 1995 and september,
1995.
13. As of the date of this complaint, the total of all
sums past due and owing to Plaintiffs is One Thousand Eight
Hundred Twenty Five and 00/100 Dollars ($1,825.00).
14. Despite repeated requests, Defendants have failed to
remit the sum of One Thousand Eight Hundred Twenty Five and
00/100 Dollars ($1,825.00) to the plaintiffs for sums past due
and owing.

1995. The Notice to Vacate dated September 1, 1995 again
reiterated that the Defendants were to vacate the premises by
September 30, 1995. A true and correct copy of the Notice
dated September 1, 1995, together with the receipt for
certified mail is attached hereto and marked as Exhibit "c".
20. Since the date of the September 1, 1995 Notice to
Vacate, the Defendants have allowed damage to be done to the
premises in that the Defendants allowed a dog to be in the
apartment and the dog has caused damage to a screen.
21. The Defendants have violated the conditions of their
Lease in that the Lease specifically provides that no pets are
allowed.
22. Despite repeated requests to do so, the Defendants
have consistently failed to pay rent in a timely manner.
23. Despite repeated requests by the Plaintiffs,
Defendants have failed to remit all sums due and owing.

24. The Defendants are in breach of their Lease
Agreement in that they have failed to pay rent, failed to pay
rent in a timely manner, and have allowed a dog to be in the
premises.
WHEREFORE, Plaintiffs, Dennis Dorsey and Jean Dorsey,
respectfully request that this Honorable Court enter judgment
in their favor and against Defendants Kathy Lewellen and stacy
Grudj insld and award them possession of the premises known and
located
as 908
West Trindle Road,
Apartment 1I1E,
Mechanicsburg,
Pennsylvania 17055,
and further award
Plaintiffs all such other relief as is proper and just.
