PRELIMINARY OBJECTIONS
AND NOW, come Defendants, Theodore opperman and Susie
Opperman, by and through their attorney, Stephen C. Nudel,
Esquire, and file these Preliminary Objections to plaintiff'S
Complaint as follows:
I. DEMURRER TO CLAIM FOR DAMAGES
1. plaintiff, Tina Myers, is an adult individual who
resides at 12 East Main Street, New Kingston, Cumberland county,
Pennsylvania. (Complaint paragraph 1) .
2. Defendants, Theodore Opperman and Susie opperman, are
adult individualS who reside at 2812 Merion Road, Camp Hill,
CUmberland County, pennsylvania. (Complaint paragraph 2) .
3. On or about December 19, 1994, plaintiff, as Tenant,
and Defendants, as Landlord, entered into an agreement to rent
the premises located at 12 East Main Street, New Kingston,
pennsylvania. (Complaint paragraph 3). ("PREMISES").
4. plaintiff claims damages for expenses arising out of
repairs and maintenance of the premises. (Complaint paragraphs 8
and 9) .
5. Attached as Exhibit "A" to Plaintiff's Complaint are
receipts for alleged expenditures.
6. Most of those receipts are dated prior to December 19,
1994.
7. AcCordingly, under the statements set forth in
Plaintiff's Complaint, any receipts prior to December 19, 1994,
can not be for expenditures arising out of Plaintiff's tenancy at
the premises.
WHEREFORE, Defendants, Theodore Opperman and Susie Opperman,
respectfully request your Honorable Court to dismiss Plaintiff's
Complaint and enter judgment in favor of Defendants and against
Plaintiff plus costs of suit and attorneys fees.
II. DEMURRER TO CLAIM FOR DAMAGES
B. paragraphs 1 through 7 are incorporated herein by
reference as if set forth at length.
9. Plaintiff alleges damages arising out of unnecessary
utility expenses and attaches as Exhibit "B" a report from PP&L
which purportedly supports her claim. (Complaint paragraphs 10
and 11) .
10. Plaintiff alleges damages arising out of electric bills
which "are higher than necessary by $100.00 per month" and that
"a claim for $1,000.00 is hereby made." (Complaint paragraph
12) .
11. Exhibit "B" contains no information which supports
Plaintiff's claim for damages.
12. Plaintiffs' Complaint fails to set forth any facts
which support plaintiff's claim for damages.
13. Plaintiff fails to attach any documentation to support
her vague assertion of damages.
WHEREFORE, Defendants, Theodore Opperman and Susie Opperman,
respectfully request your Honorable Court to dismiss Plaintiff's
Complaint and enter judgment in favor of Defendants and against
Plaintiff plus costs of suit and attorneys fees.
III. DEMURRER TO CLAIM FOR DAMAGES
14. Paragraphs 1 through 13 are incorporated herein by
reference as if set forth at length.
9. plaintiff alleges damages arising out of excessive

purportedly supports her claim. (Complaint paragraph 13) .

COMPLAINT
AND NOW, comes Plaintiff, Tina Myers, by her attorneys, Mette, Evans &
Woodside, and files the following Complaint:
1. Plaintiff, Tina Myers, is an adult individual residing at 12 East Main
Street, New Kingstown, Cumberland County, Pennsylvania 17072.
2. Defendants, Theodore and Suzie Opperman, are adult individuals
residing at 2812 Merion Road, Camp Hill, Cumberland County, Pennsylvania
17011.
3. On or about December 19, 1994, Plaintiff agreed to become tenant
and Defendant agreed to rent and become landlords In the rental of an apartment
situated at 12 East Main Street, New Kingstown, Cumberland County,
Pennsylvania.
4. Plaintiffs rent is paid through the Housing Authority of Cumberland
County.
5. In order to qualify for subsidized rent, it was necessary for the
property to be cleaned and made habitable.

6. In order to obtain shelter for herself and her minor child prior to the
Christmas season, it became necessary for Plaintiff to expend her personal funds
in the clean-up of the property which was the responsibility of the landlord
Defendants.
7. Plaintiff expended the amount of $225.00 in satisfying the landlord
Defendants' obligations and claimed reimbursement which reimbursement
landlord Defendants have failed to make, and claim therefore is hereby made.
8. During the course of tenancy at the property, Plaintiff has been
forced to expend personal funds for repairs and maintenance of the property which
are beyond those expected of tenant and which include repair of items which were
in a state of disrepair at the time she moved into the property.
9. These expenditures amount to a total of $229.50 (receipts for which
are attached as Exhibit "A" and made a part hereoO and claim therefore is hereby
made.
10. Defendants have refused and continue to refuse to repair appliances
in the home including the hot water heater and the bathroom fIXtures, which run
continuously, causing Plaintiff additional and unnecessary utility expense.
11. Attached as Exhibit "B" and made a P,'l1't hereof is PP&L's
investigation which concludes that high electric bills are caused by a faulty water
heater.
12. Plaintiffs electric bills are higher than necessary by $100.00 per
month as a result of Defl)ndants' failure, and claim for $1,000.00 is hereby made.
13. Attached is Exhibit "C" and made a part hereof is a UGI report
documenting excessive bills and dangerous conditions resulting from faulty
appliances and claim for $1,500.00 is hereby made.
14. Defendants failed to supply a properly operating furnace and stove,
both gas operated which resulted in a dangerous condition as documented in the
attached correspondence.
WHEREFORE, Plaintiff, Tina Myers, prays that the Court, in view of the
foregoing, will award $2,954.50 which is less than the amount set as the threshold
for compulsory arbitration by local rule, together with such other costs, interest
and awards the Court deems reasonable and just.

the bill in full. Th. supervisor advised MS. Hyers of her right to oontact
the PUC it not satisfied. Hs. Hyers said she dldn't want the intormation,
she was euing her landlord.
Ha. Hyera phoned UOI on Harch 7, 1991:l reqarding the trace :tuel line. She

regarding having a High oill Investigation and Dot.r ohanqo don.. The work
was schedulod tor Haroh 8, 1995. Ms. Myers B1::ated she haa a gaD odor in the
houDe. A serviceman was dispatched immudiately to chock on the goa odor.
Tne lIervioellan chllcking tne gas odor on Maroh 1, 1995 tound several ga. leaks
at the ranlJe. He dieoonneoted the range and ooudemned it. Tho range 1s
beyond repair and must be replecod.
Tn. serviOGllan conducting the H1qh oill InveBtigation ond motor ohange on
March B, found one furnaco on this metor. The furance i8 over-sized and
under-fired wbich will CIIURe excess gos UBlll:!O. The furance Bupplles only the
first floor apartment with heat at thill time. The chlllnOY Willi bloolted,
eherefore, tho sorviooman shut ott and red-togged the furnace. (The furnace
iB not safe to uee until the ch1Dmey is ropaire<1.) The ranqe had been
disconnected March 1, 1995 due to several CjllB loakB. No gas leaks "ere found
on HllrOh 8.
Ms. Myers called UOY on March 10, 1995, stating the chillll1ey hlld been repair<1.
A serviceman was sent out the same day. The turnaoo and ohiamey Were
inspected. ThO rOd tag was removed and the furnace VDB atarted.

AND NOW, come Defendants, Theodore Opperman and Susie
opperman, by and through their attorneys, the Law Offices of
Stephen C. Nudel, and file this Answer to plaintiff's Complaint
as follows:
1. Denied. plaintiff no longer resides at 12 East Main
Street, New Kingstown, pennsylvania.

the time plaintiff's Complaint was filed that the Housing
Authority of cumberland County paid plaintiff's rent.

to provide the Premises to plaintiff rent free for December in
exchange for which Plaintiff agreed to remove, at her own
expense, the trash and debris which had been left by a previous
tenant, By way of further response, before the parties executed
the Lease on December 19, 1994, the Premises had passed an
inspection conducted by the Housing Aut.hority,
6. Denied. The response to paragraph 5 is incorporated
herein by reference as if set forth at length.

without knowledge or information sufficient to form a belief as
to the truth or falsity of the averment contained in paragraph 7,
