COMPLAINT IN MORTGAGE FORECLOSURE
AND NOW, comes the above mentioned Plaintiff, by their
lawful counsel, John J. Krafsig, Jr., Esquire. who demands judg-
ment against the said Defendants in the sum of Twenty-one Thousand
Eight Hundred Ninety-two Dollars and 70/100 ($21,892.70), present
principal balance as of September 10, 1995, together with continu-
ing interest from September 10, 1995, plus reasonable attorney's
fees of $4,378.54, or a present sum due of Twenty-six Thousand
Two Hundred Seventy-one and 24/100 ($26,271.24), upon a certain
cause of action, whereof the following a statement:
1. The Plaintiff, Blazer Consumer Discount Co,
is a corporation duly qualified to do business within the Common-
wealth of Pennsylvania. with an office situate at 1217 Market
Street, Lemoyne, Cumberland County, Pennsylvania 17043.
2. The names and addresses of the Defendants in
this action are:
Timothy A. Arthur, P.O. Box 173, Franklin,

Indiana 46131 and Lisa J. Arthur, his wife, 400 South College
Street, Myerstown, Lebanon County, Pennsylvania 17067.
3. There are no other known persons, who are
believed to be present real owners to be made a party of of
this action.
4. Th~ parties to the mortgage dated February
17, 1994 and recorded in the Office of Recorder of Deeds, in and
for Cumberland County, Pennsylvania in Mortgage Book 1197, Page
1110, which is expressly incorporated by reference and attached
hereto and marked as Plaintiff's Exhibit "A": was between the
Plaintiff and Timothy A. Arthur and Lisa J. Arthur, his wife.
To the present knowledge of the Plaintiff, there has been no
assignment of record of the said mortgage.
5. The description of the real estate situate
at 7 East Shady Lane, Enola, East pennsboro Township, Cumber-
land County, Pennsylvania is more particularly set forth in
Plaintiff's Exhibit "B", a true and correct copy of said description
is attached hereto and made a part hereof.
6. The face amount of the mortgage entered into
on February 17, 1994, with an initial advance of $20,675.42, with
an agreed rate of interest of 9.84%, calling for monthly payments,
first on account of interest and then on account of principal of
$220.00 per month.
7. That the Defendants failed to pay their said

monthly obligations since April 10, 1995 and despite written notice
of intention to foreclose on a Residential Mortgage, served upon
both Defendants under date of July 31, 1995, by Certified Mail
Return, Return Receipt Requested, received August 2, 1995, by
Lisa J. Arthur and August 18, 1995 by Timothy A. Arthur, a true
and correct copy of said Notice, is attached hereto and made a
part hereof, together with the said Return Receipt Cards, marked
as Plaintiff's Exhibit "C:" and the Defendants have failed to
cure the said default.
8. Reflecting credits of all payments, from
March 10, 1994 of $220.00 per month at 9.84% interest on the
sum of $20,675.42 financed, with a default as of April 10, 1995
to September 10, 1995: there is a balance of $21,892.70, with
continuing interest thereon from September 10, 1995. In addition
thereto, pursuant to the Note and Mortgage executed by the said
Defendants, calling for reasonable attorney fees: the Plaintiff
is required in addition to the expense of counsel sending Notice
of Intention to Foreclose by Certified Mail: preparing Complaint
in Mortgage Foreclosure and effecting service: taking judgment
and issuing Writ of Execution: providing Praecipe of Notice to
parties: providing Notice to all Lien Holders pursuant to Rule
3129 of the Rules of Civil Procedure: providing 7 copies of Notice
and all necessary mailing and notices required: the Plaintiff
has incurred a reasonable attorney's fee of $4,378.54, or a present
