COMPLAINT Plaintiff Groff Tractor & Equipment, Inc. by its attorneys, Snelbaker & Brenneman, P. C., files this Complaint and in support thereof avers the following: 1. Plaintiff Groff Tractor & Equipment, Inc. is a Pennsylvania business corporation with its principal office and place of business located at 6499 Carlisle Pike, Mechanicsburg, Cumberland county, Pennsylvania, 17055. 2. Defendant Richard L. Longenecker is an adult individual trading and doing business as Pine Hill Excavating & Paving, with an address of R.D. 3, Box 536, Annville, Lebanon County, Pennsylvania, 17003. 3. Plaintiff is in the business of selling, leasing and servicing construction and related equipment, together with accessories and parts therefor. LAW O""'CI.I SNEL8AKER a BRENNEMAN .. " COUNT I. 4. The averments of Paragraphs 1 through 3, inclusive, of this Complaint are incorporated by reference in this Paragraph in their entirety. 5. Beginning on or about October 12, 1992 and continuing thereafter, Plaintiff, at the specific request of Defendant and/or Defendant's authorized agents, representatives and/or employees, did sell, provide and deliver to Defendant, at Plaintiff's place of business, various equipment parts, products and services at Plaintiff's then customary charges, which charges Defendant orally agreed to pay. 6. Defendant requested, received and accepted equipment parts, products and services from Plaintiff, at the times, in the amounts of and for the prices and charges as stated on the parts and service account invoices of Plaintiff, true and correct copies of which are attached hereto and incorporated by reference herein as "Exhibit A-1" through "Exhibit A-7". 7. At Defendant's request and agreement, Plaintiff permitted Defendant to charge his various purchases of equipment parts, products and services provided him by Plaintiff and maintain a parts and service account with Plaintiff with a service charge thereon in the amount of eighteen percent (18\) per annum. The prices charged by Plaintiff to Defendant for equipment parts, products and services provided Defendant were fair, customary and reasonable and at no time objected to by Defendant. 10. Defendant has failed and refused to pay for the equipment parts, products and services charged and the account balance when same has become due and owing, in spite of Plaintiff's request and demand to do so. 11. Defendant's failure and refusal to pay for the equipment parts, products, and services and the account balance is a material breach of the parties' agreement. WHEREFORE, Plaintiff demands judgment against Defendant in the amount of $3,434.40, together with interest on the principal balance in the amount of eighteen percent (18%) per annum and the costs of this action. COUNT II. 12. The averments of Paragraphs 1 through 3, inclusive, of this Complaint are incorporated by reference in this Paragraph in their entirety. LAW On-ICI:. SNELBAKER . BRENNEMAN 13. Beginning on or about June 25, 1992 and continuing thereafter, Plaintiff, at the specific request of Defendant -3- LAW C"'IC~. SNELBAKER a BRENNEMAN . . and/or Defendant's authorized agents, representatives and/or employees, did lease to Defendant and Defendant did agree to lease from Plaintiff the equipment identified below at Plaintiff's then customary rental charges, which charges Defendant agreed to pay. 14. Beginning on or about June 25, 1992, Defendant agreed to lease and did lease from Plaintiff the following equipment for the rental periods noted below: EOUIPMENT AGL Gradlight Laser SERIAL NO. GA206101 RENTAL PERIOD 6/25/92 through 5/14/93 8/31/92 through 10/13/92 1/04/93 through 1/18/93 Bomag Roller 101520110668 stanley Breaker 675201 True and correct copies of the lease agreements and invoices noting rental by Defendant of the equipment for the above periods and the charges for same are attached hereto and incorporated by reference herein as "Exhibit B-1" through "Exhibit B-16". 15. At Defendant's request and agreement, Plaintiff permitted Defendant to have possession and use of the above equipment and to maintain a rental account with Plaintiff with a service charge thereon in the amount of eighteen percent (18\) per annum. 16. The total account balance due Plaintiff by Defendant -4- LAW O....ICE. SNELBAKER a BRENNEMAN - - for Defendant's rental of the above equipment as of February 7, 1994 is $11,714.79. 17. The prices charged by Plaintiff for rental of the above equipment were fair, customary and reasonable and never objected to by Defendant. 18. Defendant has failed and refused to pay the rental charges and account balance as same have become due and owing in spite of Plaintiff's request and demand to do so. 19. Defendant's failure and refusal to pay the rental charges and account balance constitute a material breach of the parties' agreements. WHEREFORE, Plaintiff demands jUdgment against Defendant in the amount of $11,714.79, together with interest on the principal balance thereof at a rate of eighteen percent (18%) per annum and costs of this action. COUNT III. (In the alternative to Counts I and II.) 20. The averments of Paragraphs 1 through 19, inclusive, of this Complaint are incorporated by reference in this Paragraph in their entirety. 21. The parts, products, services and equipment provided Defendant as more fully described and identified in Counts I and -5- . . .
