CIVIL ACTION AT LAW JURY TRIAL DEMANDED COMPLAINT AND NOW, this [C)~aday of September, 2002, comes the Plaintiff, by and through his attorneys, Diveglia & Kaylor, P. C., and files the following complaint and avers in support thereof as follows: 1. The Plaintiff, John D. Miller, is an adult individual who resides at 610 Lewisberry Road, New Cumberland, Cumberland County, Pennsylvania 17070. 2. The Defendant, Donald G. Riden, is an adult individual who lives at 115 Hillsdale Road, Etters, Cumberland County, Pennsylvania 17319 3. On September 27, 2000, at approximately 11:15 p.m., Plaintiff was operating his car southbound on SRll3 locally known as 1-581 at or near 1-83 and entered the ramp onto 1-83 at Lemoyne. 4. At the above-said time and place, the Defendant was operating his motor vehicle southbound and struck the rear of Plaintiffs vehicle, knocking his vehicle into 1-83 and in the process causing injury to him. The defendant thereafter fled from the collision. 5. At the time and place of the above-said accident described above, the Defendant was operating his vehicle while under the influence of alcohol with a blood alcohol content determined to be 0.15%. 6. As a result of the above-described accident, Plaintiff has incurred serious injuries to his neck, left hand with his left knee requiring treatment. His knee injury has been described as a tear of the medial minisicus and chondromalacia of the medial compartment, requiring an operative procedure. 7. The above-described injuries have caused great pain and mental distress to the Plaintiff with said pain and metal distress continuing. 8. The above-described injuries may be permanent in nature resulting in a severe future disability of the Plaintiff that may diminish his earning capacity. 9. As a result of the above-described collision, which was the result of the negligence of the Defendant, Plaintiff may incur further medical expenses. 10. As a result of the above described collision, plaintiff has incurred a loss of business opportunity in his business known as ComputerWorks. 11. The above-described collision and injuries were the result of negligence of the Defendant whose negligence consisted of the following: (a) He failed to observe where he was going. (b) He was operating his vehicle in a high and excessive rate of speed. (c) He drove her vehicle in a reckless manner and without regard to the safety of others on the highway. (d) He was driving under the influence of alcohol to the extent that it impaired his ability to operate his motor vehicle. (e) The violations of the Pennsylvania Motor Vehicle Code make him negligent per se. WHEREFORE, Plaintiff demands judgment against the Defendant in an amount in excess of $25,000.00.
