CIVIL ACTION - LAW NO. 95-5349 CIVIL TERM SCANLAN'S CARPET & UPHOLSTERY CLEANING, INC. Defendant COMPLAINT 1. Plaintiffs are James G. strupe, Jr. and Barbara O. strupe, husband and wife, adult individuals who reside at 16 campbell Place, Camp Hill, cumberland county, Pennsylvania 17011. 2. Defendant is Scanlan's Carpet' Upholstery Cleaning, Inc., a corporation with place of business at 1721 Green street, Harrisburg, Pennsylvania 17102. 3. In september, 1994, Plaintiff Barbara 0, strupe contacted Defendant to arrange to have Defendant clean the fabric on a sofa and various chairs in the living room of Plaintiffs' home, said items of furniture were owned jointly by the Plaintiffs herein. 4. In response to Plaintiff wife's request, Defendant, through its agents, servants and employees, agreed to clean the upholstery on the requested pieces. 5. Thereafter, on or about September 20, 1994, Defendant's personnel went to plaintiffs' home and proceeded to steam clean the fabric on the living room furniture, 6. Prior to proceeding with the work, Plaintiff wife informed Defendant's employee(e) that certain written information from the furniture manufacturer, Ethan Allen, indicated that said fabric was not to get wet or be cleaned with any water process I further, she informed Defendant's personnel that the fabric tags on said furniture indicated that the fabric was not to get wet or be cleaned with any water process. 7. The furniture tags were present on the furniture at the time the Defendant's personnel performed the cleaning services. 8. Despite the express warnings, Defendant's personnel, told plaintiff wife that they were going to steam clean the fabrio and that she would be very happy with the results. 9. The furniture fabric was ruined by Defendant by improperly steam cleaning the same, whereby it became permanently .tained, experienced substantial shrinkage and buckling and bunching of fabric. 10. As a result of the improper cleaning, the items of furniture must be re-upholstered at a total cost of $3,464.08, as per quotation attached hereto, marked Exhibit "A", and incorporated herein. 11. Prior to discovering the damage, Plaintiffs paid Defendant for the defective cleaning in a total amount of $206.70. 12. District Justice costs of $60.50 have been paid by Plaintiffs in the within matter. COUNT I 13. The averments of Paragraphs 1 through 12, inolusive, of this complaint are incorporated herein by reference. ..~~*~ 14. Defendant, through its agents, employees, servants and repre.entative, was negligent, and reckless in cleaning the affected furniture as followSl A. In attempting to steam clean the furniture fabrio de.pite having been informed by Plaintiff wife of the manufacturer's warning not to do so; B. In disregarding the express manufacturer's warning on the labels attached to the furniture at the time of oleaning, C. In failing to use due care to clean the fabrio in a manner approved by the manufacturer, D. In failing to properly clean the furniture fabrio de.pite holding itself out to be professional and experienced in undertaking the work, E. In failing to use proper and acceptable oleaning processes in performing the work, G. In failing to use due care under the circumstances. WHEREFORE, Plaintiffs demand of the Defendant the sum of $3,731.28, plus costs. COUNT II 15. The averments of Paragraphs 1. through 12., inclusive, of this complaint are incorporated herein by reference. 16. Defendant expressly or impliedly agreed to perform the work requested by Plaintiff wife in a good and workmanlike manner. . " .1 '17, Defendant failed to perform its contract with plaintiffs in a good and workmanlike manner, thereby breaching its agreement. 18. Defendant, through its agents, servants and employees, represented to plaintiffs that the furniture could be steam cleaned, and that plaintiffs would be happy with the resultS. 19. Defendant breached its express warranty by failing to properly clean the furniture and permanentlY damaging the fabric in the process. 20. Defendant breached its contract with plaintiffs in that itl A. Breached express warranties concerning the quality of its work, B. Breached implied warranties of good and workmanlike service, C. Failed to properly perform the services which it agreed to undertake. Plaintiffs filed the complaint after a Rule was entered on an appeal by Scanlan's Carpet and UpholsteJy Cleaning, Inc, from a Judgment entered by a District Justice. Scanlan's carpel and UpholsteJy ClllBnlng, Inc. filed an anawer to plaintiffs' complaint; however, that answer was flied by Brian R, Scanlan as president of the corporation.
