PEFENQAtlT'S ANSWER TO COMPLAINT
BAYLEY, J" July 115, 1118:-
Plaintiffs, James and Barbara Strupe, filed a complaint against defendant,
Scanlan's carpet and UpholsteJy Cleaning, Inc" seeking $3,731.28 for alleged
dlm.ge to plaintiffs' property as a result of s8IVlces provided to plaintiffs by
defendant. Plaintiffs filed the complaint after a Rule was entered on an appeal by
Scanlan's Carpet and UpholsteJy Cleaning, Inc, from a Judgment entered by a District
Justice. Scanlan's carpel and UpholsteJy ClllBnlng, Inc. filed an anawer to plaintiffs'
complaint; however, that answer was flied by Brian R, Scanlan as president of the
corporation. Pursuant to Pa, Rule of Civil procedure 1028(a)(2), plaintiffs filed a
preliminary objection to defendant's answer alleging a failure to conform to law
because the pleading was not filed by an attomey.
In Wllle.vag. v. EKeln 2000, Ine" 331 Pa, Super. 137 (1984), the Superior
Court of Pennsylvania held:
..... ,...'
95-5340 CIVIL TERM
[t]hat It Is , , , the law of Pennsylvania that a corporation may appear
and be represented In our courts only by an attorney duly admitted to
practice, We further hold , . . that this requirement does not deny
corporations due process or the equal protection of the laws, Nelther
does It deprive corporations or their officers and shareholders of any
other constitutional or statutory rights they enjoy 88 corporate and
natural persons, respectively.
In WlllelVlgl, the Superior Court stated that an exception to Its holding
exllt& for stockholder derivative actions, The court noted that "some states have
established special small claims courts with Informal rules of procedure In which
corporations as well as Individual litigants are permitted or even required to appear
without an attomey." Id. at 143, The Superior Court cited such an exception for
certain small claims In the Philadelphia Municipal Court, Since WlllelVlII. was
decided, Pennsylvania Rule 207 Govemlng Standards Of Conduct Of District Justices
was adopted effective October 12, 1985. Rule 207 provides: "In district lustlce
proceedings, Individuals may be represented by themselves or by counsel and
corporations may be represented by their officers or counsel," Although plaintiffs
herein Initiated this case before a district justice where the president of Scanlan'.
Carpet and Upholstery Cleaning, lno, could defend the Interests of the corporation, a
complaint has now been filed In this court, We are bound by WlllelVlII., sup"';
therefore, the following order Is entered,l
