STIPULATION AGAINST LIENS 'l{.5'.356 It! L/J
THIS AGREEMENT made the 1 ~ tL day of October, 1995, by and between
SIGMAN'S HOME SALES, hereinafter referred to as Contractor, and KEITH G.
HOCKENBERRY and MARIE C. HOCKENBERRY, husband and wife, hereinafter
referred to as Owner, whereby the former undertakes and agrees to erect and construct
a single family dwelling on:
ALL THAT CERTAIN tract of land with the Improvements thereon erected,
situate In Lower Frankford Township, Cumberland County, Pennsylvania, being described
according to a survey for Charles E. Glllaugh, dated March 28, 1978, prepared by Larry
N. Neidlinger, P.E., as follows:
BEGINNING at a point In the center line of L.R. 21033 (McClure's Gap
Road), which point Is approximately 400 feet from the Intersection of Township Road 487
and L.R. 21033; thence by the center line of L.A. 21033, South 38 degrees 10 Inlnutes
East 100 feet to a nail; thence along land now or formerly of Roy Carbaugh and passing
over the Mobile Pipe Une right-of-way and the Laurel Pipe Une right-of-way, South 52
degrees 10 minutes West 392 feet to an Iron pin; thence along land now or formerly of
John E. Garman, North 3B degrees 10 minutes West 100 feet to an Iron pin; thence along
land now or formerly of Eugene I. Rotz and Oma D. Rotz, husband and wife (referred to
In the above survey as Tract No.3) and passing over the said Mobile Pipe Une rlght-of-
way, North 52 degrees 10 minutes East 392 feet to a point In the center line of L.R.
21033, the Place of BEGINNING.
CONTAINING 39,199.94 square feet, and being designated on the above-
referred to Plan as Lot No.2.
BEING the same property which Paul A. Myers, Jr. and Rebecca A. Myers,
husband and wife, by their Deed dated September 14, 1990 and recorded In the Office
of the Recorder of Deeds In and for Cumberland County, in Deed Book "T", Volume 34,
Page 1178, granted and conveyed unto Keith G. Hockenberry and Marie C. Hockenberry,
husband and wife.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said Contractor,
for and In consideration of the sum of One ($1.00) Dollar to them In hand paid by Owner,
the receipt whereof Is hereby acknowledged, and the further consideration mentioned in
the agreement aforesaid, for themselves and their subcontractors, and all parties acting
through or under them, covenant and agree that no mechanic's liens or claims thereto
for or on account of any work done or materials furnished by them or any of them under
said contract or otherwise, for, towards, In, or about the erection and construction of the
said buildings on the lot above described, and the said Contractor, for themselves, their
subcontractors and others under them hereby expressly waive and relinquish the right to
have, file and malntaln any mechanic's liens or claims against the ssld buildings or any
of them, and agree that this Instrument, waiving the right of lien, shall be an Independent
covenant.
