THIS AGREEHENT made the ~y of ~t< ' 1995, by

and between JAMI. W. HUTCHIIIO , t/d/b/a HUTCH CONSTRUCTION, with

principal place of business at P.O. Box 7, Hechanicsburg,
cumberland county, Pennsylvania 17055, hereinafter referred to as
"CONTRACTOR", and W. JOHN HADDI", III and CAROL A. HADDE", husband
and wife, of 371 Crossroad School Road , Newville, cumberland
county, Pennsylvania, hereinafter referred to as "OWNER", whereby
the former undertook and agreed to erect and construct a residence
on that certain tract of ground situate in West pennsboro Township,
cumberland county, Pennsylvania, being known as Lot 4, on the Final
SUbdivision Plan for Phase No. 3 of Andrew Manor, as recorded in
the Office of the Recorder of Deeds in and for cumberland county in
Plan Book 69, Page l40.
That the sald
NOW, THEREFORE, THIS AGREEHENT WITNESSETH;
CONTRACTOR, for and in consideration of the sum of One ($l.OO)
Dollar to it in hand paid by OWNER, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the
agreement aforesaid, for themselves and their subcontraotors, and
all parties acting through or under them, covenant and agree that
no mechanic's liens or claims shall be filed or maintained by them
or any of them against the said buildings and the lot of ground
appurtenant thereto for or on account of any work done or materials
furnished by them or any of them under said contract or otherwise,
for, towards, in, or about the erection and construction of the
said buildings on the lot above described, and the said CONTRACTOR,
for itself, its subcontractors and others under it hereby expressly

waive. and relinquishes the right to have, file, and maintain any

them, and agree that this instrument, waiving the right of lien,
