HODECKER, Defendants CIVIL ACTION - LAW MORTGAGE FORECLOSURE AID ION, comes PNC Bank, National Association, successor by merge~ to CCNB Bank, N.A., by and through its attorneys Saidis, Guido, Shuff , Masland, and respectfully avers the following: 1. Plaintiff is PNC Bank, Nationel Association, successor by merger to CCNB Bank, N.A. ("PNC") a national banking association authorized and existing under the banking laws of the United States of America with a principal office at 4242 Carlisle Pike, Camp Hill, Pennsylvania 17011. 2. Defendants are Douglas J. Hodecker and Shirley M. Hodecker, adult individuals residing at 1604 Pine Road, Carlisle, Cumberland County, Pennsylvania 17013. 3. The plaintiff brings this action to foreclose on a Mortgage dated June 24, 1992, by and between the Plaintiff and Defendants (the "Mortgage"), given to secure a certain promissory note dated June 24, 1992, in the original principal amount of Sixty-Four Thousand Five Hundred and 00/100 Dollars ($64,500.00) (the "Note"). A copy of the Note and Mortgage are attached hereto, made a part hereof and marked as Exhibit "A". 4. The Mortgage is recorded in Cumberland County Mortgage Book 1075 at Page 315. The Mortgage secures and is a lien upon 3 that certain tract of land situate in Penn Township, Cumberland county, pennsylvania, known and numbered as 1604 Pine Road, carlisle, penneylvania. A copy of the legal description is attached to Exhibit "A". 5. The Defendants are the present real owners of the premises encumbered by the Mortgage. 6. pursuant to the Note and Mortgage, the Plaintiff advanced to the Defendants the sum of Sixty-Four Thousand Five Hundred and 00/100 Dollars ($G4,500.00). 7. The Defendants have defaulted under the terms of the Note and Mortgage by failing to make payment pursuant to the terms of the Note and Mortgage, following demand by PNC. 8. The plaintiff has given the Defendants written notice of the default and of the acceleration of the eums due under the Note and Mortgage, and demand for payment, by letter dated July 24, 1995. The default letter is attached hereto, made a part hereof and marked as Exhibit "B". 9. The plaintiff has given written Notice of Intention to Foreclose and complied with the provisions of Act 6, 41 P.S. S403, dated August 17, 1995. The Act 6 letter is attached hereto, made a part hereof and marked as Exhibit "C". 10. The Plaintiff has given written Notice of Default and complied with the Homeowners' Emergency Assistance Act of 19B3, dated August 17, 1995. The Notice of Default is attached hereto, made a part hereof and marked as Exhibit "D". 11. To the best knowledge, information and belief of plaintiff, the Defendants have not been granted assistance under 4 Act 91. 12. The fullowing amounts are due under said Note and Mortgage: Principal $ 62,579.10 Interest at 9.25\ per annum as of October 5, 1995 $ 1,174.27 Reasonable Attorney Collection Fees S 2.500.00 TOTAL $ 66,253.37 NIIIUrOU, Plaintiff prays Your Honorable Court to enter judgment for the Plaintiff and against the Defendants, jointly and severally, in the amount of sixty-Six Thousand Two Hundred Fifty- Three and 37/100 Dollars ($66,253.37), plus subsequently accrued interest at 9.25\ per annum, attorneys' fees and costs of suit and for foreclosure and sale of the mortgaged premises.
