NOW COMES, Defendant, William Hyers, by and through his
attorney, John L. Perry, Esquire, and, pursuant to PA, R.C.P.
Section 1028, files preliminary objections to plaintiff'S complaint
as follows:
PETITION RAISING QUESTION OF SUBJECT HATTER JURISDICTION
1. The action set forth in the above captioned complaint
seeks judgement against the Defendant in the amount of $2,496.50,
plUB cOBts, for the alleged breech of the terms of a lease
agreement involving real estate located at 619 North pitt street,
carlisle, pennsylvania.
2. on November 3, 1995 Defendant filed a voluntary
Bankruptcy petition in the united states Bankruptcy court for the
Middle District of pennsylvania.
3. This petition was assigned Case Number 1-95-02321, a copy
of whioh is attached as Defendant'S Exhibit A.
4. On November 20, 1995 Defendant filed schedules, in
support of the previouslY filed Bankruptcy petition, listing
RimberlY Williams as an unsecured non-priority creditor.
5. persuant to the automatic stay provisions of, Title 11
united states code, section 362 (a)(l), the jurisdiction over the
subject matter of this action is noW vested in the United StateB
Bankruptcy Court for the Middle District of pennsylvania.
6. Accordingly, this court now lacks jurisdiction over the
subject matter of this action.
WHEREFORE, Defendant requests that the plaintiff's complaint
be disnisBed and that the $375.00 deposited with the prothonotary
by the Defendant be refunded to the Defendant.
