1. Plaintiff. Dorothy Me ok and George W. Meek, Jr., are
hu.band and wife and adult re.ident. of Cumberland County,
Penn.ylvania.

Realty co.pany, at all relevant time. ownad, po..e..ed and/or
controlled the Candlewick Apartm.nt Complex at 700 Nailor Drive in
ca.p Hill, Cumbarland county, Penn.ylvania.
3. Dafendant Waterford A.sooiate., Inc., i. a corporation
orvani.ed under the law. of the commonw.alth of Penn.ylvania, which
at all relavant tim.. al.o owned, possessed and/or controll.d the
Candlewick Apartment Complex locatsd at 700 Nailor Drive, in Camp
Hill, Cumberland county, Psnnsylvania.
4. Defendant First Investors General, Inc., is a general
partner t/d/b/a Water ford Associates, which at all relevant times
al.o owned, po.....ed and/or controlled the Candlewick Apartment

complex located at 700 Nailor Drive, in Camp Hill, cumberland
county, Pennsylvania.
5. All of Plaintiffs' damages hereinafter related occurred
on or about the evening of December 3, 1993, after dark, at
Candlewick Apartment Complex. At that time and place, the
Plaintiff, Dorothy Meok, was helping her daughter unload packages
from a car.
6. As Mrs. Meek walked toward her daughter's car, which had
stopped at the curb in front of the building in which Plaintiffs
resided, the Plaintiff, Dorothy Meok, stepped into a hole on the
property owned, possessed and/or controlled by the Defendants.
7. It is believed and therefore averred that this hole was
oreated froll a signpost whioh the Defendants had plaoed and then
removed.
8. All of Plaintiffs' damages are the direct and proximate
result of the negligence of Defendants in that they:
a. permitted a hazardous hole to exist on property
whioh they knew or should have known would be traversed by
residents and visitors, and whioh would not be readily visible
at night,
b. failed to post appropriate warnings;
o. failed to oordon off or otherwise blook access to
the hole;
d. failed to fill the hole in a timely manner;
e. failed to cover the hole in a timely manner;

f. failed to install adequate lighting; and
9. otherwhe failed to discharge the duty owed to
residents such as the Plaintiff.

9. Para9raphl 1 through 7 are incorporated herein by
referenoe as if .et forth at length.
10. As a result of Defendants' negligence, the plaintiff,
Dorothy Meok, sustained a displaoed bimalleolar fracture of the
ri9ht ankle, whioh was reduced by open internal fixation.
11. As a result of the aforementioned injuries, Plaintiff
Dorothy Msck was foroed to incur medical expenses in an effort to
restore hereelf to health, and because of the nature of her
injuries, Plaintiff will be forced to incur similar expenses in the
future, and olaim is made therefore to the extent permitted by law.
12. As a result of the aforementioned injuries, Plaintiff
Dorothy Meek hao undergone and in the future will undergo great
physical and mental pain and sUffering, great inconvenience in
carryin9 out her daily activities, loss of life's pleasures and
enjoyment, and claim is made therefor.
13. As a result of the aforementioned injuries, Plaintiff
Dorothy Meok has been and in the future will be subjeot to great

humiliation, embarrassment, scarring and disfigurement, and claim
i. made therefor.
14. As a result of the aforementioned injuries, Plaintiff
Dorothy Meck has in the past and may in the future sustain a loss
of earning. and a diminution of earning capaoity, and claim is made
therefor.
WHEREFORE, Plaintiff Dorothy Meek demands judgment in exoess
of Twenty-Five Thousand ($25,000.00) Dollars, exclusive of interest
and costs and in excess of any jurisdictional amount requirinq
compulsory arbitration.

15. Paraqraphs 1 through 7 are incorporated herein by
reference as if set forth at length.
16. By reason of the aforesaid injuries sustained by his
wife, plaintiff George W. Meok, Jr., hos been deprived of the
assistanoe, companionship, consortium, and society of his wife and
has, like his wife, incurred liability for the negligenoe of the
Defendants, as alleged herein, as well as neoessary medioal oare
thereafter as a result therefrom, and may be forced to incur
similar miscellaneous expenses in the future, and claim is made
therefor.

WHEREFORE, Plaintiff George W. Meek, Jr., demands judgment
aqainet Defendants Investment Realty company and Waterford
A..ociate. in an amount in excess of Twenty-Five Thousand
($25,000.00) Dollars, exclusive of interest and costs, and in
exo... of any jurisdictional amount requiring oompulsory
arbitration.
