Plaintiffs, by and through Frey & Tiley Attomeys at Law and respectfully state as follows: I, Plaintiffs are Pamela A. Holliday and Annette M. Bongiorni, adult individuals, unmarried, residing at 103 Lesli Lane. Dickinson Township. Cumberland County. Pennsylvania. 2. Defendant is Security and Life Systems. Inc., a corporation existing under the laws of, doing business in Pennsylvania and having its office and principal place of business in Pennsylvania at 1651 Mt, Zion Road. York, York County. Pennsylvania. 3. In approximately February, 1995, Plaintiffs visited a sales display of Defendant ala home builders show and obtained Iitemture concerning home security systems sold by Defendant. 4. The Iitemture obtained by Plaintiffs indicated that Defendant was an "AT&T Authorized Dealer" and that the security systems sold and installed were AT&T systems, Attached as Exhibit "A" is a copy of the Iitemture obtained. 5, Based on the infonnation received. Plaintiffs decided to contact Defendant conceming the purchase and installation of a home security system. Plaintiffs chose Defendant because it represented itself to be an AT&T authorized dealer selling AT&T products. Plaintiffs chose to contact Defendant because of the AT&T name even though literature which they reviewed for other systems indicated that systems with similar features could be purchased from other dealers for less total cost. 6. On or about May 15, 1995, Plaintiffs met with John Lakatosh, who held himselfoutlo be a sales agent of Defendant with authority to sell products on behalf of Defendant. Page 1 . . 7, John Lakatosh reviewed vllfious information with Plaintiffs on security systems which could be installed in the home of Plaintiffs ineluding a system represented to them to be the "AT&T Home Security System 8000," hereinafter referred to as "System 8000." 8. Among the representations made about the System 8000, John Lakatosh represented that even if the wires were cut, if an intrusion would occur, the system would notify the monitoring service which would then notify the local police and fire depnrtmentthat a problem had occurred. 9. Defendants were impressed by these representations and relied on them because they live in a rural area, removed from neighboring houses. They relied on the representation that the syslem could communicate with the central monitoring service even if wires to their house were severed, 10. Based on these representations, Plaintiffs entered into a contract for the purchase of a security system for their home which they believed to be the AT&T Home Security System 8000 as represented 10 them. A copy of the contract is attached hereto and incorporated herein by reference as Exhibit "B". II. Pursuant to the terms of Ihe contract, Plaintiffs paid to Defendantlhe sum of $3,982,00 for the System 8000 and to additionally pay a monthly fee of $24,00 per month for moniloring service to be performed by Defendant. 12, Subsequent to the execution of the contract, Plaintiffs leamed that the system actually purchased by them was not the system as represented to them. Plaintiffs leamed that if the telephone line to their home would be disconnected, the system would be incapable of notifying the monitoring service of any problems. 13, Plaintiffs contacted Defendant regllfding this fact and were told that the system could be reconfigured with a cellulllf telephone line but that the reconfiguration would require the purchase of additional equipment by Plaintiffs and would additionally require the purchase of a dedicated cellulllf telephone line for the system. 14, Plaintiffs were not told about the need for additional equipment when they entered into the contract to purchase the System 8000, Page 2 . . 15, Plaintiffs also learned that AT&T was no longer manufacturing or selling security systems at the time of their purchase of the System 8000. The system actually purchased by them no longer had any connection with AT&T and was not backed by AT&T service or warranties. 16. Defendant breached the terms of its Agreement with Plaintiffs by failing to install the security system represented to them which was an AT&T home security system which could not be deactivated by the cutting of wires. 17, Prior to learning of this breach by Defendant, Plaintiffs had fully performed all of their obligations under the terms of the contract, including the payment of monthly monitoring charges. 18, Upon learning of this breach by Defendant, Plaintiffs ceased making any further monthly payments for monitoring of their system. 19, Plaintiffs have been damaged by the breach of Defendants as follows: Cost of system $3,982.00 Monthly service contract 72,00 Total ~4.Q~4.QQ WHEREFORE, Plaintiffs request that Your Honorable Court enter judgment in favor of Plaintiffs and against Defendant in the amount of $4,054.00, plus interest and costs. 20. Paragraphs 1 through 19 are incorporated herein by reference. 21. Defendant was contracted to perform services as professionals in the sale and installation of home security systems. 22. Defendant performs its services and sells the above-described home security systems and similar systems to the general public. 23. Defendant did perform services of installation and did sell the home security system to Plaintiffs in the course of its regular business. 24, Defendant is in the trade, commerce, or business of sales and installation of home security systems similar in character similar to the system sold to Plaintiffs, 25. Plaintiffs entered into the transaction with Defendant primarily for personal, family and household purposes. Page 3 26. It was represented to Plaintiffs as part of the purchase of the system that the system was an AT&T Home Security System 8000 which would operate properly even if wires to the house were cut. 27, Defendants breached their duty to Plaintiffs as stated above by failing to install a system which would operate as represented and failing to disclose that AT&T no longer was in the business of manufacture, sales. or service of home security systems. 28. Defendant's breach of their obligation as stated above was a direct violation of the Pennsylvania Unfair Trade Practices and Consumer Protection Law (73 P.S. ~20 1-1 et seq.) and was an unfair method of competition and an unfair or deceptive act or practice for the following reasons: a. Defendant represented that the home security system was of a particular standard, quality or grade when in fact it was of another; b. Defendants failed to comply with the terms of the representations made by the sales person conceming the nature of the system and its capabilities and limitations. which terms were a guarantee or warranty given to the Plaintiffs at the time of signing a contract for the purchase of the real estate; c. Defendant engaged in unfair or deceptive acts which created a likelihood of confusion or of misunderstanding as to the source, sponsorship, approval or certification of the system and as to the capabilities and limitations of the system. 29. Defendant's conduct in representing that the system was an AT&T Home Security System 8000 which would operate properly even if wires to the house were cut and that Defendant was an AT&T Authorized Dealer was a direct violation of the Pennsylvania Unfair Trade Practices and Consumer Protection Law (73 P.S. ~201-1 et seq.) and was an unfair method of competition and an unfair or deceptive act or practice for the following reasons: a, Defendant made a replacement of a nature or quality inferior to or below the standard of thatl1greed to in writing; b. Defendant engaged in unfair or deceptive acts which created a likelihood of confusion or of misunderstanding as to the source, sponsorship, approval or certification of the system and as to the capabilities and limitations of the system, Page 4 c. Defendant represented that the security system hud a sponsorship, approval, or characteristics that it did not have and that Defendant had a sponsorship, approval, status, affiliation or connection that it did not have, d. Defendant engaged in fraudulent conduct which created a likelihood of confusion or of misunderstanding. 30. Pursuant to 73 P.S. ~ 201.9.2(a), a Court may award up to three times the actual damages sustained and such additional relief as the court deems necessary or proper, 31. Plaintiffs have sustained actual damages as a direct result of Defendant's violation of the Pennsylvania Unfair Tmde Practices and Consumer Protection Law (73 P.S, ~20 I-I et seq.) in the amount of $4,054.00 as set forth in paragraph 19 above.
