WHEREAS, James E, Mosemann and Mary Louise Mosemann, his wife, of 1485 Creek Road,
Carlisle, Pennsylvania, are about 10 exeeule conlemporancously herewith a conlraet with J, E. Mosemann
Builders, of 1485 Creek Road, Carlisle, Cumberland County, Pennsylvania, for the erection ofa residential
dwelling upon ntraet of land siluate nt Lot No.6, Grahnms Woods Rond, Cnrlisle, Cumberland County,
Pennsylvania, more particularly described in the deed of Philip J. Ruegg and Evelyn J. Ruegg, his wife, to
the Owners herein, dnted April 12, 1995, and recorded in the Office of the Recorder of Deeds for Dnuphin
County, Pennsylvanin in Deed Book 120. Page 978,
NOW, Oelober 10, 1995, at the time of and inunedialely before the exceution of the principal
contract. and before any authority has been given by the snid Owners to the said Contractor to commence
work on SlIid building, or to purchase materials for the sllll1e in consideration of the nutking of the said
contract with the SlIid Contraelor and the further consideration of the sum of One and nollOO (SI.OO)
Dollnr to Contractor paid b)' snid Owners, it is agreed that no lien shnll be filed ngninst the building by the
contractor, or any subcontractor. nor by nny of the material men or workmen or any other person for any
labor or II1lIterials purchased or extra labor or materials purchased for the erection of snid building, the
right to file such liens being expressly waived,
