THE BOROUGH COUNCIL OF WORMLEYSBURG BOROUGH, CUMBERLAND COUNTY, PENNSYLVANIA, Appellee. ....................................................... NOTICE OF APPEAL Joseph F. Hamilton and Elizabeth J, Hamilton (the "Hamlltons"), by and through there attorneys, Kirkpatrick & Lockhart LLP, hereby appeal the decision of the Wormleysburg Borough Council (the "Council") approving the Minor/Final Subdivision Plan for William B. Quinn and Waltraud Quinn (the "Qulnns"), as follows: 1. The Hamiltons are the owners of certain improved property located In the Borough of Wormleysburg, Cumberland County, Pennsylvania. A true - 1 - and correct copy of the Hamlltons' Deed to their property Is attached hereto as exhibit "A." 2, The Hamiltons' property is Lot No, 70 in the Plan of Lots known as Pennsboro Manor, which Plan (hereinafter, the "Pennsboro Plan") is recorded in the Office of Recorder of Deeds for Cumberland County in Plan Book 3, Page 6. A true and correct copy of the Pennsboro Plan is attached hereto as Exhibit "B." 3. Under the Zoning Ordinance of the Borough of Wormleysburg, Pennsboro Manor is In the RR-1 Restricted Residential District. 4. On September 12, 1995, the Council approved a subdivision plan submitted by the Quinns, designated as the "Minor/Final Subdivision Plan for William B. & Waltraud Quinn" (hereinafter, the "Quinn Plan"). A true and correct copy of the Quinn Plan is attached hereto as Exhibit "C," 5. At the time that the Council was considering the Quinn Plan, the Quinns were owners of the property designated as Lots 68 and 69 In the Pennsboro Plan (Exhibit B hereto). A true and correct copy of the Qulnns' Deed to Lots 68 and 69 Is attached hereto as Exhibit "D." 6. By their Plan, the Quinns attempted to alter the lot line between Lots 68 and 69, moving the line in a northerly direction, thereby purporting to increase the size of Lot 68 to 25,042.57 square feet and to decrease the size of Lot 69 to 20,041.27 square feet. (See Exhibit C hereto). 7. On September 15, 1995, immediately following approval by the Council of the Quinn Plan, the Qulnns purported to convey Lot 68 to Edward F. - 2 - Wilson and Deann M. Wilson (the "Wilsons") and Lot 69 to John Henry Diehl, III and Lynne C. Diehl (the "Diehls"). True and correct copies of the Deeds from the Qulnns to the Wilsons and to Dlehls are attached hereto as Exhibits "E" and "F," respectively. 8, The boundary line between Lots 69 and 70 In the Pennsboro Plan as originally set forth In the Deed to the Quinns (Exhibit 0 hereto) is described as "thence along the western line of Lot No. 70 South 60 dearees 29 minutes East. 185 fu1 to a stake on the court at the rear of Lot No, 69" (emphasis added). 9, The new boundary line between Lots 69 and 70 as set forth In the Deed from the Qulnns to the Diehls (Exhibit F hereto) Is now described as "thence along the southern line of Lot #70 South 58 dearees 00 minutes 00 seconds East. a distance of 185 feet to a point on the southern right-of-way of a 70' unnamed Court" (emphasis added). 10. -.;, J Quinn Plan, as approved by the Council, is in error because it improperly purports to move the boundary line between Lots 69 and 70 In the Pennsboro Plan, as described in the original Deed to Quinns (Exhibit 0 hereto) and the Deed to the Hamlltons (Exhibit A hereto), thereby including within the Quinn Plan property owned by the Hamiltons. 11. The Hamlltons were afforded no notice of the Council's consideration of the Quinn Plan, and they did not sign, certify or otherwise participate in submission of the Quinn Plan. 12. The Quinn Plan, as approved by the Council, is in error under Section 403, Section 406 and/or Section 407 of the Subdivision and Land - 3 - Development Ordinance of Wormleysburg Borough ("Subdivision Ordinance"), as follows: a. Section 403 of the Subdivision Ordinance requires an "applicant" to submit a final plat for a minor subdivision approval. Similarly, Section 406 requires the final plat to be submitted by the "applicant." b, "Applicant" is defined by Section 222.3 of the Subdivision Ordinance as "[a] landowner or develooer ... who has filed an application for development including his heirs, successors and assigns" (emphasis added). c. "Developer" is defined by Section 222.25 of the Subdivision Ordinance as "[a]ny landowner, aaent of such landowner or tenant with the permission of such landowner, who makes or causes to be made a subdivision of land or a land development" (emphasis added). d. "Landowner" is defined by Section 222,66 of the Subdivision Ordinance as "[t]he leaal or beneficial owner or owners of land including the holder of an option or contract to purchase ,.., a lessee if he is authorized under the lease to exercise the rights of the landowner, or other oerson havlna a oroDrietarv interest in land ..." (emphasis added). e. The Hamiltons own both legal and equitable title to a portion of the property shown as part of the Quinn Plan, f. The Quinns did not have the Hamiltons' consent to Include their land as part of the Quinn Plan, nor did the Hamlltons have any agreement with the Quinns entitling the Quinns to include such land as part of the Plan. - 4. g. The Quinns do not qualify as proper "applicants" under the Subdivision Ordinance with respect to the Hamlltons' property, 13. The Quinn Plan, as approved by the Council, is in error under Section 403.1.a(2)(h) and/or Section 407,1.a(5) of the Subdivision Ordinance, as follows: a. Section 403.1,a(2)(h) of the Subdivision Ordinance requires that an applicant for minor subdivision approval submit a final plat that Includes a certification of ownership signed by the owner. b. Section 407.1.a(5) of the Subdivision Ordinance similarly requires that an application for subdivision approval include a "[c]ertification of title showing that the applicant is the owner of land, agent of the landowner or tenant with permission of the landowner." c. The Quinn Plan does not include a certification of ownership signed by the Hamlltons as owners of a portion of the property covered by the Plan. d, The certification of ownership, if any, signed by the Quinns and included in the Quinn Plan is in error because the Quinns are not the owners of the Hamilton prope~, the agents of the Hamlltons, or the tenants with permission of the Hamiltons, 14, The Quinn Plan, as approved by the Council, is in error under Section 403,1.a(2)(b) of the Subdivision Ordinance, as follows: - 5 - a. Section 403.1.a(2)(b) of the Subdivision Ordinance requires that an applicant for minor subdivision approval submit a final plat that Includes U[b]earlngs and distances of the property taken from the property deed Including the primary control point.u b. The Quinn Plan Is In error because it does not accurately Include bearings and distances of the property taken from the property deed (Exhibit 0 hereto). 15. The Quinn Plan, as approved by the Council, is In error under Section 403.1.a(2)(e), Section 501.5 and/or Section 505.1.a of the Subdivision Ordinance, as follows: a. Section 403.1,a(2)(e) of the Subdivision Ordinance requires that an applicant for minor subdivision approval submit a final plat that Includes, among others, the lot area, lot dimensions, bearings and distances or lot lines, and building set back lines and contours, b. The lot area, lot dimensions, bearings and distances or lot lines, and building set back lines and contours displayed on the Quinn Plan are In error, as they are measured from or otherwise reflect the boundary line between Lots 69 and 70, which Itself Is In error on the Plan. c. Furthermore, Sections 501.5 and 505.1.a of the Subdivision Ordinance requires that proposed land uses under the Subdivision Ordinance conform to the requirements of the Wormleysburg Borough Zoning Ordinance, Including the requirement relating to size of lots. -6- d. Section 304 of the Wormleysburg Zoning Ordinance provides a minimum lot area for lots in the RR-1 Restricted Residential District of twenty thousand (20,000) square feet. e. The lot area for Lot 69 as drawn on the Quinn Pian does not satisfy the minimum lot area requirement of the Zoning Ordinance if the correct boundary line between Lots 69 and 70 is properly considered. 16. The Quinn Plan, as approved by the Council, Is In error under Section 407.1.a(1) of the Subdivision Ordinance, as follows: a. Section 407.1.a(1) of the Subdivision Ordinance requires that an application for subdivision approval include a final plat which shows "[p]rimary control points, or description and 'ties' to such control points, to which all dimensions, angles, bearings, and similar data on the subdivision or land development plat shall be referred." b, The Quinn Plan Is in error because it inaccurately depicts the primary control points, or description of "ties" to such points, upon which the boundary line between the Lots 69 and 70 as drawn on the Plan is based. 17. The Quinn Plan, as approved by the Council, Is In error under Section 407.1,a(2) of the Subdivision Ordinance, as follows: a. Section 407.1.a(2) of the Subdivision Ordinance requires that an application for subdivision approval Include a final piat which shows, among others, tract boundary lines and property lines of residential lots ''with - 7 - accurate dimensions, bearing, or deflection angles, and radII, arcs, and central angles of all curves" (emphasis added). b. The Quinn Plan is in error because It inaccurately depicts the boundary line between the Lots 69 and 70 and includes within the Plan property owned by the Hamiltons, 18. The Quinn Plan, as approved by the Council, is in error under Section 407.1.a(13) and/or Section 501,5 of the Subdivision Ordinance, as follows: a. Section 407.1.a(13) of the Subdivision Ordinance requires that an application for subdivision approval include a final plat which shows building setback lines on all parcels or lots in the unit. b. The minimum building setback line from the boundary of Lots 69 and 70 displayed on the Quinn Plan is In error, as it Is measured from the boundary line between Lots 69 and 70, which Itself Is In error on tl1e Plan. c, Furthermore, Section 501.5 of the Subdivision Ordinance requires that proposed land uses under the Subdivision Ordinance conform to the Wormleysburg Borough Zoning Ordinance. d. Section 304 of the Wormleysburg Zoning Ordinance provides a minimum side yard width of fifteen (15) feet. e, The side yard width for Lot 69 as drawn on the Quinn Plan does not satisfy the side yard width requirement of the Zoning Ordinance if the correct boundary line between Lots 69 and 70 Is properly considered, - 8- 19, The Quinn Plan, as approved by the Council, is in error under Section 501.2 of the Subdivision Ordinance, as follows: a. Section 501.2 of the Subdivision Ordinance specifies that the standards and requirements of the Ordinance "shall be considered the minimum for the promotion of the public, health, safety, convenience, and general welfare," b. The Quinn Plan does not comply with the standards and requirements of the Subdivision Ordinance and is to the detriment of the public health, safety and welfare. 20, The approval by the Council of the Quinn Plan is In violation of the Wormleysburg Subdivision Ordinance, the Wormleysburg Zoning Ordinance, and the Pennsylvania Municipalities Planning Code. 21, The approval by the Council of the Quinn Plan Including portions of the Hamlltons' property constitutes a taking of property without just compensation in violation of the Constitution of the United States and the Constitution of the Commonwealth of Pennsylvania, 22. The approval by the Council of the Quinn Plan including portions of the Hamlltons' property, without notice to or opportunity for the Hamiltons to be heard, constitutes a deprivation of a property interest without due process of law in violation of the Constitution of the United States and the Constitution of the Commonwealth of Pennsylvania, -9- 23. The approval by the Council of the Quinn Plan is arbitrary, capricious, and an abuse of discretion. WHEREFORE, Joseph F. Hamilton and Elizabeth J, Hamilton respectfully request that this Court reverse the action of the Wormleysburg Borough Council and direct that the Minor/Final Subdivision Plan for William B. & Waltraud Quinn be denied.
