Tbe Defendant is Deluxe Develo~nt Corp., a Pennsylvania corporation witb registered offic8S in Berwick, ColuMbia County, Pennsylvania, wbicb Maintains offices for tbe conduct of its business in CUMberland County at 144 Wertzville Road, Bnola, Cuaberland County, Pennsylvania, The Defendant regularly conducts business in CUMberland County and Maint~ins a constant presence for the conduct of that business. 3, At all tiMes relevant to this action, the Defendant was a builder/developer of real estate, purchasing real estate and erecting hOles thereon for sale to the public, 4. By an Installllent Sale AgreeMent dated 30 August 1994, Plaintiffs purchased froe Defendant a tract of real estate illproved witll a single faMily residence known and nUMbered as 41 GreenllOnt Drive, A copy of the InstallMent Sale Agr~eMent, as it was I delivered to Plaintiffs, is attached hereto and Marked as Bxhibit A. 1 I 5, As the builder and developer o( tile 1I0lle whicll it sold to PlaintiUs, I Defendant Made iMplied warranties regardiDQ the property, Those warranties included: !I II ~ A, A warranty of habitability. 8, The warranty that the hOle was constructed in a reasonably work.anlike .anner, sufficient to satisfY the standards in the construction industry at the ti.e and location at which it was built, 6. Shortly after taking possession of the hOle they purchased fr~ Defendant, Plaintiffs experienced proble.s with water leaking, seeping, and flowing into the bale~nt of the house. In October of 1994, Plaintiffs reported thOle proble.s to the Defendant, 7. In OCtober of 1994, Defendant did work at Plaintiffs' hOle which partiallY r.-edied the water proble. in the Plaintiffs' base.ent but which, in turn, cauled a proble. with standing water in the backyard of the hOle. 8, In "arch and April of 1995, Defendant returned to Plaintiffs' hOle and did additional work in an effort to cOlplete the repairs c~enced in OCtober of 1994 and to correct the proble. of standing water in Plaintiffs' backyard, 9, The repair work done by the Defendant was inadequate to correct the proble., AI a result, in late June and early July of 1995, Plaintiffs experienced ~re serious proble.s with water in the base.ent, which resulted frOl water leaking, seeping, and flOWing into their base.ent and collecting in the base.ent. 10, On or about 1 July 1995, Plaintiffs notified Defendant of the proble. with water in their ba8~nt.
