COMPLAINT
AND NOW, come Plaintiffs, Ricky Nissly and Marybeth Nissly, by
and through their attorneys, Killian & Gephart, and in support of
this Complaint aver the following:
1. Plaintiffs are adult individuals, husband and wife, who
reside at 247 South 8th Street, Columbia, Lancaster County,
Pennsylvania 17512,
2, Defendant, Erie Insurance Group, is an insurance company
with an address of 4901 Louise Drive, Rossmoyne Business Center,
P,O, Box 2013, Mechanicsburg, Pennsylvania 17055-0710,
3, Defendant, Consumers Insurance Agency, Inc" is a
Pennsylvania corporation with an address of 535 West Orange Street,
Lancaster, Pennsylvania 17603.
4. Plaintiffs have a contract of insurance with Defendant,
Erie Insurance Group, A true and correct copy of the contract is
incorporated hereby and attached hereto as Exhibit "A".
5, The insurance policy was sold to Plaintiffs by Defendant,
Consumers Insurance Agency, Inc.
6, Plaintiff's property at 247 South 8th Street, Columbia,
Lancaster County, Pennsylvania, has a two-story garage.
7, The rcof of the garage, which is a flat roof, and is a
two-story, three bay garage, suffered severe damage from the heavy
snows during the winter of 1994.
8. Plaintiffs initially noticed the severe damage in March
of 1994,
9. The structure is apparently damaged beyond repair, and
Plaintiffs have been advised that their best option is to demolish
the structure and rebuild it,
10, Pursuant to the terms of Plaintiff's policy with Erie
Insurance Group, Plaintiffs have Fifty Thousand Eight Hundred
($50,800) Dollars worth of insurance on their garage,
11. Plaintiffs made claim upon Erie Insurance Group for the
damages to the garage, but Erie Insurance Group has declined to
provide any money to cover the damages to the garage.
12, Plaintiff's insurance policy continues to be in effect,
although Defendant, Erie Insurance Group, has threatened to cancel
the policy.
13, At the present time there is considerable danger that the
structure will collapse into other structures inflicting further
damage on surrounding properties.
COUNT I - BREACH OF CONTRACT
14. The averments of paragraphs 1 through 13 are incorporated
hereby as if set forth fully and at length.
15. Defendant, Erie Insurance Group, agreed to insure
Plaintiff's garage, and wrongfully has refused to compensate
Plaintiffs for damages to the garage.
16, Plaintiffs have been damaged by this refusal in an amount
in excess of Fifty Thousand ($50,000) Dollars.
17, Defendant, Erie Insurance Group, has breached the
contract of insurance by its failure to cover the garage,
WHIRlrORl, Plaintiffs respectfully request this Honorable
Court to grant judgment in their favor and against Defendants in an
amount in excess of Fifty Thousand ($50,000) Dollars which amount
is above the jurisdictional limit for compulsory arbitration,
COUNT II - rRAUD
18. The averments of paragraphs 1 through 17 are incorporated
hereby as if set forth fully and at length.
19, Defendant, Erie Insurance Group's agent, Consumer
Insurance Agency, Inc. , misrepresented to Plaintiffs that
Plaintiffs would have coverage on the garage, and Defendant, Erie
Insurance Group, has accepted premiums which include payment for
the garage, and continues to accept premiums covering the garage
from Plaintiffs.
20. Despite the representation that plaintiffs had insurance
coverage on the garage, Defendant, Erie Insurance Group, has denied
Plaintiffs claim for replacement of the garage pursuant to the
policy.
21. Plaintiffs have been damaged by the misrepresentation in
an amount in excess of the coverage under the policy, as well as
the premium amounts attributable to the refusal, as well as any
other damages which may ensue from the collapse of the building and
damage to neighboring properties.
WHIRIPORI, Plaintiff respectfully requests this Honorable
Court to grant judgment in its favor and against Defendants in an
amount in excess of Fifty Thousand ($50,0001 Dollars with interest
thereon, and costs of this action, punitive damages, and whatever
other damages the Court may find just and equitable, which amount
is above the jurisdictional limit for compulsory arbitration.

COUNT III - UHrAIR TRAni PRACTICIB
22. The averments of paragraphs 1 through 21 are incorporated
hereby as if set forth fully and at length.
23. Defendants' actions as averred above violate the
Pennsylvania Unfair Trade Practices and Consumer Protection Law 73
P.S. 1201-1 et seq.
24. Defendants' sale of insurance to Plaintiffs and their
misrepresentations concerning the extent of coverage provided by
the insurance was fraudulent conduct within the meaning of the
unfair trade practices statute.
25. Pursuant to the Unfair Trade Practices Statute,
Plaintiffs are entitled to recover attorneys' fees in addition to
their actual damages from the Defendants.
WHIRIPORI, Plaintiffs respectfully request this Honorable
Court to grant judgment in their favor and against Defendants in an
amount in excess of Fifty Thousand ($50,0001 Dollars, with
reasonable attorneys' fees, costs of suit, punitive damages, and

AND NOW, come Erie Insurance Group and Consumer Insurance
Agency, Inc., Defendants, by and through their attorneys, Landis,
Black' schorpp, who answer Plaintiffs' Complaint as follows:

Admitted.
4. Admitted in part and denied in part. It is admitted
that Plaintiffs had a contraot of insurance with Defendant Erie
Insurance Group at the relevant time. It is denied that a true
and correct copy of the contract is attached to said Complaint.
On the contrary, only a portion of the contract is attached.
There is attached to this answer a full and complete copy of the
policy.

7. Admitted in part and denied in part. It is admitted
that the roof of the garage is a flat roof, and that the garage
is a two-story structure with three garage door openings. It is
denied that said structure suffered severe damage from any
weather conditions during the winter of 1994. On the contrary,
as is set forth in New Hatter herein (specifically, Paragraphs 32
through 37, inclusivel, any damage to the structure was caused by

wear and tear, deterioration and faulty oonstruction (removal of
a load bearing wall), and not by any snow accumulations during
the winter of 1994.
8. Denied. After reasonable investigation, Defendants are
without knowledge or information sufficient to form a belief as
to the truth of this averment, and the same is therefore denied.
9. Denied. After reasonable investigation, Defendants are
without knowledge or information sufficient to form a belief as
to the truth of these averments. If in fact the structure is
damaged beyond repair, such damage waa caused as set forth in New
Matter herein (speoifioally, Paragrapha 32 through 37,
inolusive), and is not covered by the policy of insurance.
10. Admitted in part and denied in part. It is admitted
that the policy provides coverage limits of $50,550.00. said
coverage is provided only pursuant to the terms, conditions,
ooverages and exceptions from coverages set forth in the polioy.
By way of further answer, the cause of the damage to Plaintiffs'
garage is not covered, all is set forth in New Matter herein
(specifically, Paragraphs 32 through 37, inclusive).
11. Admitted. By way of further answer, as set forth in
New Matter herein, Defendants have absolutely no obligation to
pay plaintiffs any sum whatsoever.
12. Admitted in part and denied in part. It is admitted
that Plaintiffs' policy, as renewed, has continued in effect.
Defendant Erie has not threatened to cancel the policy, but on

the contrary, has advi.ed Plaintiff. that their policy may be
voided because of potential increased hazard if, in fact, there
i. danger that the structure might collapse.

without knowledge or information sufficient to form a belief a.

that Defendant Erie did, at all relevant times, agree to insure
Plaintiff.' garage under the terms and conditions of the policy
it i..ued to Plaintiffs. It is specifically denied that
Defendant Erie has wrongfully refused to compensate Plaintiffc
for damage. to the garage. On the contrary, any damages to the
garage were caused by conditions outside the scope of the
coverages afforded in the policy, all as is set forth in New
Hatter herein (specifically, Paragraphs 32 through 37,
inclusive) .
16. Denied. It is denied that Plaintiffs have been damaged
by any action on the part of either Defendant in any amount
whatsoever. Any damages to the garage structure were caused by
conditions outside of policy coverages, all is set forth in New
Matter herein (specificallY, paragraphs 32 through 37,
inclusive) .

way breached its contract of insurance with Plaintiffs.
Defendant Erie did issue ccverage for the garage structure,
aubject, however, to all of the terms and conditions, exclusions
and coverages set forth in the entire policy of insurance.

19. Denied. It is denied that Defendant Consumer ever
miarepresented to plaintiffs the policy coverage on the garage.
On the contrary, Defendant Erie did issue ooverage on the garage,
aUbjeot, to all of the terms, oonditions and exclusions set forth
in the pOlioy. It is admitted that Defendant Erie has aocepted,
and continues to accept, premiums for the garage coverage,
aubjeot to all terms and oonditions set forth in the pOlicy.
20. Denied. To the extent that Defendants made any
representation to Plaintiffs with respect to coverage on the
garage, said representations were that Plaintiffs would have
coverage on the garage under the terms, conditions, coverages and
exolusions set forth in the policy. It is admitted that
Defendants have denied Plaintiffs' claim. By way of further
answer, said denial was based upon the express terms and
conditions of the policy, all as set forth in New Hatter herein.

21. Denied. It is denied that Defendants, or either of
thsm, have cauaed Plaintiffs any damages whatsoever. On the
contrary, Defendants have at all times honored their Obligations
under the express terms of the policy of insurance. By way of
further answer, the averments of this paragraph are conclusions
of law which require no answer herein.

26. There is attached to this answer, marked Exhibit "A",
and incorporated herein by reference thereto, a full and complete
copy of the policy of insurance and continuation notice for
coverages in effect at the time of the 10Ba alleged in
Plaintiffs' complaint.

27. Pursuant to the terms and conditions set forth in the
polioy of insurance, and speoificallY Paragraph 15, Page 12,
Plaintiffs were required to bring this action within one year of
obtaining knowledge of their loss, after whioh the denial of
their loss would be incontestable.
28. Plaintiffs have averred that they became aware of their
loss in March, 1994 (see Paragraph B. of Plaintiffs' complaint).
29. suit was filed in this matter on October 12, 1995.
30. Prior to the filing of this action, and within the one
year incontestable period, Defendant Erie Insurance provided
written notice on september 12, 1994, that plaintiffs claims for
payment were deniedl full explanation for the denial was set
forth in said correspondence, which is attached hereto as Exhibit
"8" and incorporated herein by reference.
31. such failure to file suit within one year of March,
1994, after full written explanation of denial by Defendant Erie,
bars the within aotion.
32. Any damages to the garage structure described in
Plaintiffs' Complaint were not caused by the winter conditions of
1994, but on the oontrary occurred over a long period of time.
33. Over said long period of time, wooden support posts
enoased in concrete decayed thus causing trusses to sagl said
posts continue to experience ongoing decay, compression,
settlement and shortening.
34. In addition, many of the roof beams have warped

downward over a period of time.
35. In addition, the losses claimed by Plaintiffs were
caused by improper and inadequate construction methods occurring
prior to the winter storms of 1994, in particular as follows:
A. An interior brick load-bearing partition wall was
removed and replaced with a wooden truss which is not
adequately supported, and which is in a state of decaYI
B. The wooden truss posts are not adequately
supported on firm footers I the wooden posts and trusses are
settling over a period of timel
C. The floor joists for the second floor are not
properly anohored and are inadequate to support the volumes
of materials being stored on said floor I
D. The roof girders are inadequately supported I
E. The roof beams are supported by two main girders,
which are in turn supported by the wood postsl said wood
posts are incapable of supporting the imposed loads I
F. A roof beam is inadequately supported above a
window opening of a second floor window adjacent to the
front left corner of the buildingl said window opening was
constructed with a two-inch wood lintel which is inadequate
to carry the imposed loadsl
G. Various cracks in the exterior brick masonry
evidence settling over a period of timel said cracks in the
brickwork are old and pre-date the winter of 1994.

36. By virtue of the conditione eet forth in this New
Hatter, the causes of any alleged damages to plaintiffs garage
are excluded from covsrage in that the policy excludes losses
caused by "(b) mechanical breakdown, deterioration, wear and
tear, marring, inherit vice, latent defect, rust, smog, wet or
dry rot and mold."
37. The conditions set forth in this New Matter are further
excluded from coverage as being "(7) caused by, resulting from,
contributed to or aggravated by faulty or inadequate I (b) design,
development or specifications, workmanship and construction I and
(c) materials used in construction."
38. At all times relevant hereto, the extent of coverages
under the policy of insurance, and the exclusions therefrom, were
fully provided and explained to Plaintiffs in their policy of
insurance.
39. At no time did either Defendant represent to plaintiffs
that coverage would be other than as set forth in plaintiffs'
policy of insurance.
40. Both Defendants fully and completely investigated the
losses claimed by plaintiffs and denied coverage only after
receiving a report from a reputable struotural engineerl the
engineer's report together with Defendant Erie'S explanation of
denial of Plaintiffs' claims were fully and adequately provided
to Plaintiffs promptly upon completion of the investigation of
the alleged losses.

I have reviewed the oircumstances surrounding your claim and
determined there is no coverage for your loss.
After inspecting the damages at your rosidence, I felt it was
necessary to have the opinion of a struotural engineer as to the
oaUse and extent of the damages to your detached garage. I
oontraoted Eugene J. Aufiero' Assooiates, Inc. to inspect the
damages to your detaohed garage. Mr. Aufiero's investiqation led
him to the following oonolusions, 1) the distress to your detached
garage is not the reBult of a single event such as snow and ice
accumulations of this past winter; 2) the damages have ocourred
over a long period of time and can be attributed to the
construction deficienoies which have resulted as a consequence of
removing the interior brick bearing partition that previouslY
divided the structure into two separate garages.
The report submitted to Erie by Mr. AUfiero is attached to this
letter.

I visited the site on August 31, 1994. The owner, Mrs. Nissly,
was present and directed me to the detached garage mentioned
above.

1) The garage is a two story brick structure. The garage
lIeasures approximately 33'-3" wide by 21'-10" deep. Three
overhead doors are accessible from an alley that runs parallel to
8th street. The alley is located behind the main house. For
purposes af orientation, the wall of the garage adjacent to this
alley will be referred to as the rear of the garage.
2) The main building that the garage is located behind is a
duplex. At some time in the past, this structure served as the
garage for two separate residences. Previously, this garage was
divided into two spaces by a two story interior brick bearing
wall. This wall has since been removed. Remnants of this
interior bearing partition can be seen along the inside face of
the front wall of the garage.
3) The removed interior brick bearing partition has been
replaced with a wooden truss. This truss bears on the rear wall
of the garage at the second floor level. The other truss bearing
at the front wall of' the garage is not integral with the front
wall. This end of the truss bears on a 6"x3" wooden post. This
post rests on the concrete floor of the garage. A block of
concrete has been poured around the base of this post. Although
the base of this post could not be seen, wooden posts encased in
concrete and adjacent to moisture are prone to decay.

The truss is sagging. Additionally, the bearing end at the
front wall is lower than that in tho rear II'all. 'I'he bottom chord
of this truss is sloping towards tho front wall. Wooden shelves
that ore attached to this post at the front wall are not level.
They slope towards the post. These conditions seem to indicnte
that this post may be experioncing ongoing decoy and subsequent
compression and shortening. Additionally, this post mny be
punching through the concrete floor of the garage. In any cose,
this post appears to have settled.
4) The second floor framing was examined. The floor joists
measure 4"xO" on one half of the garage and 2"xlO" on the other,
and are spaced at JO" on center. 'I'he joists span from the side
walls of the garage and bear on the bottom chord of the truss
that replaced the removed interior brick bearing partition.
These joists were previously let into the brick bearing wall
which separated the two halves of the garage. The two different
size joists also indicates that this garage previously served two
separnte residences. The second floor of this garage ia used for
storage. The second floor is heavily loaded with furnishings,
construction materials and automotive parts.
5) The roof structure was examined. The roofing consists of
corrugated sheet metal. The sheet metal is supported on 2x4
purlins spaced at 26" to JO" on center. The purlins span from
the side walls. The purlins at the center of the building lap and
are only supported on one edge. The unsupported ends of these
purl ins in this location were previouslY supported by the brick
bearing wall that was removed. The roof purlins are s~pported by
2-J/4"x7-J/4" beans which are spaced at approximately 5""-0" on
center. These beams span from front to rear and are supported by
a girder at the center of the garage.
Half of the garage has continuous beams. The other half of
the'garage has beams which are lapped at the main girder. These
laps are very long. The free end of these lapped beams appear to
have warped downward. This warping appears to be old and not
related to any loading conditions.
The roof beams are supported by two main girders that each
span from the side walls and are supported by a wood post at the
center of the second floor. The post is adjacent to the truss
which supports the second floor, but it does not bear directly on
this truss. The post is supported by the wood flooring and may
rest on one of the second floor beams.
6) The head of the second floor window adjacent to the front
left corner of the building was examined. A roof beam bears
directly above the window opening. Tho lintel that supports
that masonry and beam above tho opening is 0 piece of 2" thick
lumber. The brick above this lintol is cracked. The lintel is
not of sufficient strength to corry the imposed loads. The
cracks in tho brick work are old.

posts are not adequately supported. It is further denied
that any damages to the garage are anything other than a
result of the winter conditions of 1994.

inadequacies in the floor joists,

inadequately supported, except to the extent that the
premises have been damaged by the winter conditions of
1994.
(e) It is specifically denied that the wooden posts have
any inherent defects caused by the passage of time. By
way of further answer, any problems in the structure were
caused by the winter conditions of 1994,
(fl It is specifically denied that the roof beams have
any inadequate supports, or that any damages to the
building are the result of anything other than the winter
conditions of 1994.
(g) It is specifically denied that there are any cracks
in the masonry which predate the winter of 1994,

plaintiffs' damages should properly be excluded from coverage.

1. Petitioner is Plaintiffs', RICKY NISSLY and MARYBETH
NISSLY, counsel in the above-captioned case.
2. Plaintiffs, Ricky Nissly and Marybeth Nissly have failed
to abide by the terms of his fee arrangement with the law firm of
Killian & Gephart.
3. Petitioner cannot effectively represent Defendant for the
above-stated reasons.
WHIRlfORI, Petitioner respectfully requests this Honorable
