3. During thR F.ll of 1994, I)efend.nt and her mathllr, who
r.sidRs at 210 East Lau.r L.ne, where Defendant sometim.. r..id.., got
into a dispute with a neighbor by the name of G.ry F. Y.nkow.ki (now
d.a....d) and his vife, narg.ret n. Yenkawski, who resid.d .nd r..id. at
220 East Lauer Lane, Ilampd.m Townahip, Cumberland County, Penn.ylvania.
3. On or abDut the 19th d.y Df Ootob.r, 1994, the Yllnkow.ki.
filed suit ag.inat Defend.nt, dooketed to ND. 94 - 6013 Equity, in the
CDurt Df CommDn Pleaa, Cumbll'rland CDunty, PRnnsylvani., with the
Yenkowskia averring that bath propertiRs were subjRot to c.rt.in fllncll
restriotiDna, that Defendant had ereotll'd a sill (6) foot. f.nc., in
viDlation of t.he reatrictians, without. o.use, and for thR purpo.. of
.nnoylng Plaintiffs, with t.he Complaint conoluding with a pray.r for a
mlndatory injunction order requiring Defendant to remove the fenc. and
requiring that any future fenoe should oomply with the ooven.nt.
governing the re.l estate, tOilet her vi th an alternative pr.y,r for e
judgment of $20,000.00 and other relief.
4. Defendant engaged the services of the Plaintiff.' 1.'1 firm
to defend against the suit, and a oopy of a Representation and ree
Agreement made as of October 25, 1994, is allached herelo as Exhibit 1.
5. In Bccordanoe 'lith the saili vritlen fee agreem.nt,
Plaintiffs submitled to Defendant bills, copies of vhioh Bre Bttaohed
hereto BS Exhibits 2 through 7.
6. The only paymenl made by Defendant to Plaintiff eg.inst
the aforesBid billings VBS a oheok in the amount of $400.00 on "arch 20,
1995, as reflected on Exhibit 5 attaohed hereto.
7. Prior to undertBking the representation of Defendant,
Partner Leslie B. Handler told her that he vas only undertaking thi.
oase because of her mother, and that, in the ordin.ry oourse of things,
most attorneys, if they undertook this type of oa.e, vould require her
to put up . substantial dovnpayment Bnd that he v.s nol going to do .0
beoau.e of her mother .nd because of her very firm promi.. th.t sh.
vould p.y billa promptly.
8. In defense of DefendBnt's position, Plaintiff not only
filed Bn Ansver, but vas foroed to respond to ,a Request for Produotion
of Doouments and to Interrogatories, while contending 'lith a eli.nt
(Defendant) vho vas outraged that she had been sued and outr.ged th.t
she had to cooperate 'lith her attorneys, and vhich client (Def.nd.nt)
tried to tell Plaintiff lav firm how it should be handling the c....

9. In thR course of their duties, Plaintiff law firm fil.d
Interrogatories 011 the YRnkowskis, which evidently brought the
litigation to a halt -- because they never did respond to same, at least
through the reprRselltation of Plaintiffs -- for Defendant in the law.uit
brought by the Yenkowskis.
10, The lack of appreciation by Defendant far what Plaintiff
law firm sccomplished for her is definitely set forth in a hand-writt.n
letter of eleven (111 pages that Defendant wrote Plaintiff Lesli. B.
nandler under dete of June 13, 1995. A copy of said letter i. not being
attached to the pleadings, but will be submitted at Bny hearing on thi.
matter.

WHEREFORE, Plaintiffs pray thl! court 8Vsrd them .1,916.58 that
Plaintiffs billed Defendant through April 13, 1995.

13. Prior to the .igning of the Repre.entation and Fe.
Agr..~.nt attached hereto e8 Exhibit 1, Defendant told Pleintiff Le.lie
B. Handler that Plaintiff "argaret Yenkowski had told her that it wa.
going to cost her .20,000.00 in legal fees, and Defendant wa. afraid
that it would be so.
14. Plaintiff Leslie B. Handler told her that while he
couldn't guarantee anything, he doubted very, very much that her bill
would come anywhere near that, and, in point of fact, .. i. .hown,
excluding interest, Plsintiffs sppesr to Ilave billed her $2,225.00 for
actual services rendered.
15. Although Defendant was told to get another sttorney,
Defendant failed to do so, foroing Plaintiffs to go through the
requirements of being formally relieved as counsel of record, by virtue
of a Petition and Rule upon Plaintiffs and Defendant, in the lavsuit
dooketed in this court to No. 64-6013 Equity - 1995, captioned Gary F.
Yenkowski and Margaret M. Yenkowski, Plaintiffs, v. Sandra Ann Barasoh,
Defendant.
16. During the Fall of 1994 and the Winter of 1995, Defendant
demanded that Plaintiff Leslie B. Handler interviev various neighbors
and Plaintiff refused to do so because, as he pointed out to Defendant,
he would just be annoying the neighbors and, Plaintiff now adds, running
up the bill, and Defendant also demanded that Plaintiff Leslie B.
lIandler contaot McNees, Wallace & Nuriok, in sn effort to short-cirouit
the suit against her.
17. In the Spring of 1995, Defendant first demanded that
Plaintiff Leslie B. Handler file a trespass action against the
Yenkowskis because of their animals ooming into her property, but.
Defendant refused to put up a $1,500.00 retainer.
lB. Subsequent to the above conversation, Plaintiff Leslie B.
Handler and Defendant had another conversation, and though Plaintiff
Leslie B. Handler hasn't found the letter, he recalls that Defendant
both told and wrote PIBintiff Leslie B. lIandler to sue the Yenkowskis
for the mental harassment that the Yenkovskis had caused her Bnd her
REPRESENTATION AND FEE AGREEMENT
KNOW ALL MEN BY THESE PRESENTS, that I, SANDRA BARASCII, do
hereby retain lIandler and Wiener uf lIarrisl.Jurg. Pennsylvania, to
represent me in connection with a suit filed against me by Gary F,
Yenkowski and Margaret M, Yenkowski, his wife, docketed to No. 94-
6013 civil Term (Equity) in the Court of Commun Pleas of Cumberland
County, Pennsylvania,
'l'he undersigned agrees not tu settle or adjust the matter
without the written consent of the law firm of lIandler and Wiener,
and agrees to pay for its services at the rate of $150.00 per hour,
or fraction thereof.
'l'he undersigned understands that any necessary expenses and
costs incurred or advanced by lIandler and IHener will be reimbursed
by me upon demand, and that the services rendered have commenced
even prior to my signing this Representation and Fee Agreement.
IN WITNESS WIIEREOF, I have hereunto set my hand and seal as of
the 25th day of october, 1994, with intent to be legally bound

COMPLAINT
1. Plaintiffs are the partners in the law firm known a.
Handler .nd Wiener, .nd Plaintiffs maintain a law office at 319 Market
Street, Harri.burg, Pa.
2. Dltfendant i8 an individual who owns real e.tate in
Cu~berland County, situ.te at 210 East Lauer Lane, Ha~pd.n Town.hip,
Cu~b.rland Ccunty, Pennsylvania, but whose legal residence i. thought to
b. 165 Ea.t 35th Str.et - Apt. 8-1, New York, New York 10016.
3. During the F.ll of 1994, D.fendant snd her mother, who
re.ides at 210 East Lau.r L.ne, wh.re Defendant someti~.. reside., got
into a di.pute with a neighbor by the name of Gary F. Venkowski (now
d.c....d) and hi. wife, Margaret M. Venkowski, who re.ided and re.ide at
220 Ea.t Lauer Lane, Hampden Township, Cumberland County, Penn.ylvania.
3. On cr about the 19th day of October, 1994, the Venkow.ki.
filed suit against Defendsnt, docketed to No. 94 - 6013 Equity, in the
Court of Common Pleas, Cu~berland County, Pennsylvani., with the
Yenkow.kis averring that both properties were subject to certain fence
restrictions, that Defendant had erected a SiK (6) foot fence, in
violation of the reatrictions, without cause, and for the pur pc.. of
snnoying Plaintiffs, with the Complaint concluding with a prayer for a
mendatory injunction order requiring Defendant to remove the f.nce and
requiring that any future fence should comply with the covenant.

4. Defendant engaged the services of the Plaintiff.' law firm
to defend against the suit, and a copy of a Representation and Fee
Agreement made as of October 25, 1994, is attached hereto as Exhibit 1.
5. In accordance with the said vritten fee agreelllent,
Plaintiffs submitted to Defendant bills, copies of which are atteched
hereto as Exhibits 2 through 7.
G. The only payment made by Defendant to Plaintiff again.t
the aforesaid billings was a check in the amount of .400.00 on "arch 20,
1995, a. reflected on Exhibit 5 attached hereto.
7. Prior to undertaking the represltntation of Defendant,
Partner Leslie B. Handler told her thet he was only undertaking this
ca.. becaus. of her mother, and that, in the ordinary course of thing.,
mo.t attorneys, if they undertook this type of caBe, vould require her
to put up a aubatantial downpayment and that he was not going to do .0
becau.e of her mother and because of her very firm promise that .he
vould pey billB promptly.
8, In defense of Defendant's position, Plaintiff not only
filed an Answer, but we. forced to reapond to a Request for Produotion
of Documents and to Interrogatories, vhile contending with a client
(Defendant) vho vaa outraged that she had been sued and outraged that
she had to cooperate vith her attorneys, and vhich client (Defendent)
tried to tell Plaintiff law firm how it should be handling the case.
9. In the cour.e of their duties, Pleintiff lew firm filed
Interrogetories on the Yenkowskie, which evidently brought the
litigstion to a halt -- because they never did reepond to seme, et least
through the representetion of Pleintiffs -- for Defendant in the lew.uit
brought by the Yenkowskis.
10. The leek of Bpprecietion by Defendent for whet Plaintiff
lew firm eccompliahed for her is definitely set forth in e hend-written
letter of eleven (11) peges thet Defendent vrote Plaintiff Le.lie B.
Handler under dete of June 13, 1995. A copy of .eid letter i. not being
atteched to the pleedings, but will be submitted et eny heering on this
lIIetter.

Plaintiff. billed Defendant through April 13, 1995.

13. Prior to the Signing of the Repr.sentstion and Fee
Agreement atteched hereto e. Exhibit 1, Defendent told Pl.intiff Leslie
B. Hendler thet Plaintiff Kergeret Venkow.ki had told her that it was
going to co.t her t20,000.00 in legel fee., end Defendant wa. efraid
that it would be so.
14. Plaintiff Leslie B. Handler told her thet while he
couldn't gunrentee enything, he doubted very, very much thet her bill
would come anywhere near that, end, in point of fact, a. is shown,
excluding interest, Plaintiffs appear to have billed her $2,225.00 for
Bctual services rendered.
15. Although Defendant was told to get another attorney,
Defendant failed to do so, forcing Plaintiffs to go through the
requirements of being formally relieved as counsel of record, by virtue
of a Petition and Rule upon Plaintiffs and Defendant, in the lawsuit
docketed in this court to No. 64-6013 Equity - 1995, captioned Gary F.
Yenkowski and Margaret M. Yenkowski, Plaintiffs, v, Sandra Ann Barasch,
Defendant.
16. During the Fall of 1994 and the Winter of 1995, Defendant
demanded that Plaintiff Leslie B. Handler interview various neighbors
and Plaintiff refused to do so because, as he pointed out to Defendent,
he would just be annoying the neighbors and, Plaintiff nov adds, running
up the bill, and Defendant also demanded that Plaintiff Leslie B.
Handler contact HcNees, Wallace & Nurick, in an effort to short-circuit
the suit against her.
17. In the Spring of 1995, Defendant first demanded that
Plaintiff Leslie B. Handler file a trespass action against the
Yenkowskis because of their animals coming into her property, but
Defendant refused to put up a $1,500.00 retainer.
lB. Subsequent to the above conversation, Plaintiff Leslie B.
Handler and Defendant had another conversation, and though Plaintiff
Leslie B. Handler hasn't found the letter, he recalls that Defendant
both told and wrote Plaintiff Leslie B, Handler to sue the Yenkowskis
for the mental harassment that the Yenkowskia had caused her and her

REPRESENTATION AND FEE AGREBMENT
KNOW ALL MEN BY 'l'HESE PRESENTS, that I, SIINDRA B1\R1\SClI, do
hereby retain Handler and Wiener of Harrisburg, Pennsylvania, to
represent me in connection with a suit filed against me by Gary F,
Yenkowski and Margaret M, Yenkowski, his wife, docketed to No. 94-
6013 Civil Term (Equity) in the Court of Common pleas of Cumberland
County, Pennsylvania,
The undersiglled agrees not to settle or adjust the matter
without the written consent of the law firm of Handler and Wiener,
and agrees to psy for its services at the rate of $150,00 per hour,
or fraction thereof.
The undersigned understands that any necessary expenses and
costs incurred or advanced by Handler and Wiener will be reimbursed
by me upon demand, and that the services rendered have commenced
even prior to my signing this Representation and Fee Agreement.
IN WITNESS WHEREOF, I have hereunto set my hand and seal as of
the 25th day of October, 1994, with intent to be legally bound
hereby, and I acknowledge receipt of a copy hereof.
