.aterials, and Defendant was to pay the amount of $4,800.00 to
Plalntifrs.
7. Plaintiffs performed the servicee, as required by the
contract entered into between the parties on or about February,
1995, in a workmanlike, professional and reasonable fashion.
Defendant periodically approved of the workmanship and quality of
Plaintiffs' work.
8. During the course of employment at the home, Plaintiffs
were orally requested by Defendant to paint additional areas of
the home and to perform other home repair jobs at the home.
9. At each request, Plaintiffs would indicate to Defendant
the additional charge for performing such services. After eaoh
time that Plaintiffs indioated to Defendant the charge for the
additional servioes, Defendant instructed Plaintiffs to perform
such services. Defendant indicated that he would pay Plaintiffs
for eaoh additional service rendered. (See attached copy of
additional services performed by Plaintiffs identified as
"Exhibit B").
10. Plaintiffs performed the additional services in a
workaanlike, professional and reasonable manner. Defendant
verified and approved of all work performed by Plaintiffs at the
home.
11. The value of the additional services contracted for
and perfor.ed by Plaintiffs is Three Thousand Four Hundred
($3,400.00) Dollars. The total value of all work performed by
Plaintiffs at the home is Eight Thousand Two Hundred ($8,200.00)
Dollars.
12. Plaintiffs have been paid the amount of Six Thousand
Three Hundred Sixty ($6,360.00) Dollars for the work that they
have perforaed at the home.
13. Plaintiffs have repeatedly demanded Defendant pay the
remaining amount due of One Thousand Eight Hundred Forty
($1,840.00) dollars, however Defendant has refused to make
payaent.
COUNT I - BREACH OF CONTRACT
14. Paragraphs 1 through 13 herecf are incorporated herein
by reference.
15. Defendant has willfully breached his contraotual
obligations pursuant to oral contracts entered into between
Plaintiffs and Defendant br refusing to pay the remaining sum of
$1,840.00 due and outstand ng for services rendered by Plaintiff.
WHEREFORE, Plaintiffs de.and jUdqaent in favor of
Plaintiff. and against Def.ndant in the principal a.ount of
$1,840.00 together with interest, costs of suit and attorney.

Defendant the reasonable value of the services rendered by

reasonable fashion as some of the work was not satisfactorily
completed and had to be corrected on more than one (1)
occasion.
8. Denied. It is denied that during the course of the
employment at the property owner's home, Plaintiffs were
orally requested by the Defendant to paint additional areas of
the home and to perform other home repair jobs at the homs.
The Plaintiffs were requested by the owner of the property to
paint additional areas of the home and at no time to
Defendant's knowledge were the Plaintiffs requested to perform
other home repair jobs at the home.
9. Admitted in part and denied in part. It is admitted
that Plaintiffs indicted to Defendant an additional oharge for
painting additional areas of the home. It is denied that
Defendant indicated that he would pay Plaintiffs for each
additional service rendered. By way of further response, all
bills for additional services were to be sent to the owner and
paid by the owner of the property.

AND NOW, com.. Plaintiffs, Mark Kofalt and Angela Kofalt,
Hu.band and Wif., t/d/b/a Rainbow Painting, by and through their
attorn.y, Gregory J. Katshir, Esquire, with the fOllowing
Complaint and avers as follows:
1. plaintiff., Mark Kofalt and Angela Kofalt are Hu.band
and Wife t/d/b/a Rainbow painting and re.iding at 65 Cardinal
Driv., Etter., P.nn.ylvania 17319.
2. Def.ndant, Terry L. smith, i. an adult individual and
general contractor with a place of bu.in... located at 56 South
Madi.on Str.et, Harri.burg PA 17109.
3. Plaintiffs are in the painting and hoae repair
bu.in....
4. On or about February, 1995, plaintiffs entered into a
contract with Def.ndant to perfora painting servic.s at 863
Hilltop Road, Leaoyne, p.nn.ylvania. (s.. attached copy of
contract id.ntifi.d a. "Exhibit A") D.f.ndant was the g.neral
contractor hir.d by William Keisling, the owner of the property
at 863 Hilltop Road, for the new construction of a ho.e
(h.r.inaft.r "home") at that property.
5. Defendant, as general contractor, had authority from
the property owner to SUb-contract portion. of the job to oth.r
.ervic. provid.r.. Pursuant to that authority, Defendant
approv.d of all work to be done at the home and was to pay each
.ub-contractor for work perforaed.
6. Pursuant to the contract entered into between
Plaintiffs and Defendant on or about February, 1995, Plaintiffs
were to paint portions of the home and provids paint and
materiala, and Defendant WbS to pay the amount of $4,800.00 to
PlaintiffS.
7. Plaintiffs performed the services, as required by the
contract ~ntered into between the parties on or about February,
1995, in a wor~anlike, professional and reasonable fashion.
Defendant periodically approved of the workmanship and quality of
PlaintiffS' work.
8. During the course of employment at the home, Plaintiff.
were orally reque.ted by Defendant to paint additional areas of
the ho.e and to perform other home repair jobs at the home.
9. At each request, Plaintiffs would indicate to Defendant

MOTION FOR SANCTIONS
AND NOW comes plaintiffs, Mark and Angela Kofalt, t/d/b/a
RainboW Painting, by and through their attorney, GREGORY J.
KATSHIR, ESQUIRE, with the following Motion for Sanctions, and
avers as follows:
1. plaintiff filed a civil complaint against Defendant on
october 1B,1995 to recover amounts owed for services rendered.
2. On August 29, 1996, a hearing was held before the Board
of Arbitrators. The Arbitrators issued an award in favor of
Plaintiffs and against Defendant in the amount of $1,350.00 plus
record costs. The Notice of Entry of Award was filed on August
29, 1996.
3. Defendant did not appeal the award of Arbitrators.
Judgment was entered against Defendant in the amount of
$1,350.00, plus record costs, in the amount of $120.00, for a
total of $1,470.00, on October 4, 1996.
3. On October B, 1996, plaintiffs served Interrogatories
in Aid of Execution/Garnishment upon the Defendant, through his
counsel of record for Defendant, pursuant to the Pennsylvania
