submits this Complaint and avers as follows:

I. PlaintllT is an adult individllal residing In the Commonwealth of Pennsylvania
with an address of333 North 27th Street. Camp Hili. Pennsylvania,
2, The Defendant. Stephen J, Landersman ("Defendant"), Is an adult individual
residing in the Coml11onweahh of Pennsylvania with an address of 201 South Enola
Drive, Enola, Pennsylvania,
3, On or about April 12. 1994. Defendant caused his automobile to smash Into the
rear end of 1'laintllT's 1966 ford Econollne Pickup Truck ("Truck") while Plainlill's
Trllck was legally parked, unattended, in front of Locke Automotive, an automobile
service garage located at 420 Soulh Enol a Drive, Enola. I'cnnsylvanla. Defendanl was
driving his car althe lime of the collision.

PLAINTIFF'S REPLV TO NEW MATIER
AND NOW comes the Plaintiff, TIlomas A, Beckley ("Plaintiff'), who, by and
through his attorneys, TIlomas S. Beckley, Esquire, and Beckley & Madden. of Counsel,
submits this Reply to Defendant's New Matter:
8. TIlis is a legal conclusion to which no response is necessary. By way of further
answer, it is denied that the damage done to Plaintiffs vehicle by the Defendant exceeded
the fair market value of Plalntltl's vehicle. To the contrary, the value of Plaintiffs
vehicle exceeded the damage done by the Defendant,
9. TIlls is R legal conclusion to which no response Is necessary, By way of further
answer, the Appraiser's Act states that "an Insurer shall not pay vehicle replacement
value until the owner produces evidence to the Insurer" Ihat he has compiled with the
Appraiser's Act, 75 Pa.C,S,A, !i 1117(a) (1996) (emphasis added), In the present case,
the Defendant Is an Individual and not an "insurer" wilhlnthe meaning of Ihe Appraiser's
Act. See 75 l'a,C,S,A, !i 1702 (1996), TIlerefore, the Appraiser's Act does not apply and
the Defendant Is liable for the full amount of the damage done 10 I'lainlln's vehicle,

WHEREFORE. Defendant Stephen J. Landersman demands judgment in his favor and
dismissal of Plaintllrs Complaint with prejudice,
NEW MATIER
8, As a result of the aforesaid collision, the vehicle of the Plaintllfwas effectively a total
loss since the amount of damal!e to the vehicle exceeded the fair market value of the vehicle at the
time of the loss,
9, Defendant stands ready, willing and able to compensate Plaintiff for the fair market
value of the vehicle at that time it was totaled, however the Appraiser's Act requires that Plaintiff
convert the title of the vehicle to note that II is a salvaged vehicle which Plaintiff has refused to do,
WHEREFORE, Delimdant Stephen J. Landersll1an demands judl!ment in his favor and
dismissal ofPlaintilrs Complaint with prejudice
