II 1.6..> Esquire 2 8. settlement was held on February 19, 1993, however, within two (2) weeks of settlement, the plaintiffs noticed various problems in connection with the asphalt of the driveway in front of the side entry garage door and the garage door itself. Thoee problems were as follows: a. the asphalt was the same level as the concrete apron extending out from the garage, b. a gap existed between the asphalt driveway and the side entry garage door permitting moisture to enter the soil up against the home's foundation, c. the asphalt began to sink causing depression. of up to four (4) inches in the asphalt. One (1) such four (4) inch depression was directly in front of the side entry door into the garage, d. said depressions cau~ed water to pool in the drivsway which became extremely icy in the winter, and e. the basement foundation wall direot1y adjacent to the driveway became wet and saturated. 9. Plaintiffs contacted the Defendant's office manager, Cheryl, and notified the Defendant of the problem with the driveway. 3 . I , t 10. Approximately three (3) months after notifying the Defendant or the problem with the asphalt driveway, Derendant's representative inspeoted the driveway and told Plaintiff that the Defendant would oorreot the problem 11. Despite this assertion, Defendant did not send anyone out to oorrect the problem despite numerous and repeated requests by the Plaintiffs to do so over a two (2) year period. 12. Finally, in May of 1995, Defendant sent an individual out to attempt repairs whioh consisted of: a. laying a patoh of asphalt approximately four (4) by three (3) feet directly in front of the side garage doorl b. sealing the patch of asphalt where it met the existing driveway asphalt by plaoing an eight (8) inoh strip of tar along the edge of the patch. 13. Despite said attempt at repairs, Plaintiff continues to have sinkage problems with pUddling, the tar used as a sealant melts and has caused tar to be traoked into the home, ruining the oarpet in the Plaintiffs' family room. 4 THE DATE OF THIS CONTRACT. A Change Order i3 a written order to the Contractor signed by the Bu~p.r or his authori:ed agent and issued after the e~ecution ot this Agreement, authori:ing a Change in the Project and/or an adjustment in the Contract Price, or the Perform~nce Time Schadule. 5.6. The Contract Price and the Per~ormance Time Schedule may be changed only by Change Order or as otherwise spP;.ified in this Agreement. 5.7. .The cost or credit to the Buvp.r from a Change in the Work shall be determined by mutal agreement. Final payment constituting the unpaid balance of the Contract Price as adjusted by Change Orders shall be due and payable when the Project is delivered to the Buyer, ready for beneficial occupancy, or when the Buyer occupifts the Project, whichever event first occurs, provided that thp. Insurance. 7.1. Indemnitv. The Contrar.tor aorees to inder.~ifv and hold the Buver harmless f:om all claiMS for bodilj' injury and' prop~rty damage' (other than the work itself and other property insured under Par3graph 7.2) that may arisR frcm the Contractor's operations under this Agreement~ 7.2. Con~r3ctor's Liability Insurance. The Contractor shall purchase and maintain such insurance as will protect it from claims under wor~en's co~pensation acts and other emplcyee benefit acts, from claims for daoaqes because of bcdily injury, including death, and from claims for dL~aqes to property which may arise out of or result from the Contractor's oper"tion under this Contract, whether such operations be by it or by any Subcontractor or anyone dire~tl: or indirectly employed b~ any of them. This insurance shall be written for not less than any limits of liability required by law and shall include contractual liability insurance as applicable to the Contractor's obligations under this A~reement. 7.3. Buyer's Liability Insurance. The Buyer shall be responsible for purchasing and maintaining his own liability insurance and, at his option, may maintain such insurance as will protect him against claims wlch may arise from operations under this Contract. 7.4. Buypr's Property Insurance. Unless otherwise provided, the Buyer shall purchase and maintain propert.y insuranc~ upon the entire Contract Work at the site to the full insurable value thereof. This insurance shall include the int.erests of the Buyer, the Contractor, Subcontractors and Sub-subcontractors in the Contr3ct Work and shall insure against the perils of fire, e~tended coverage, vandalism and malicious mischief. Any insured loss is to be adjusted with 'the Buyer and made payable to the Buyer .s trustee for. the insurod9 as their interests mB~ appear, sUblect to the requirement9 ot any mortgagee clause. The Buyer sha 1 - 6 - provide a copy of all policip.s to the Contractor prior to the commencement of the Work. The Buyer and Contr3ctor waive all rights against each other for dam3ges caused by fire or other perils to the extent covered by insurance provided under this paragraph. The Contr3ctor shall require simi13r w3iver~ by Subcontractors and ,sub-subcontractors. B. Corrpction of Work. Thp. Contr3ctor shall correct an~ Work that fa~ls to contorm to the requirements of the Contrar,t Documents wherp. such failure to conform appears during the progress of the Work, and shall remAdy any defects due to f~ultJ materials, equipment or workmanship which appear wi thin a p~riod of OnE (1) YEAR fr01ll the Date of substantial Completion of the Contract. The provisions of this paraqraph apply to Work done by Subcontractors as well as to Work done by direct employees of the Contractor. Contractor does not warrant a waterproof or damp-proof basement. THE CONTRACTOR ~~'ES AND THERE EXISTS NO OTRER WARRANTIES, WRITTF.N OR IMPLIED, CONCERnING THE CONTRACT WORK OR l\lIY OTHER SUB,TECT MATTER OF THIS AGREEMENT. 9. Default bv Buver. If the Buyer shall default here- under prior to ~'e beglnnlng or conatruction work, Contractor shall retain the money paid by Buyer as liquidated damagesr and this Contract shall thereupon terminate. !f the Buyer fails to make a Progress Payment to Contractor as herein provided through no fault of the Contractor, the Contractor may, upon se"en days' written notice to the Buyer, terminate the Contract and recover from the Buyer payment for all Work compl~ted and for any proven loss sustained upon any materials, equipment, tools, and ccnstruc- tion equipment and machinery, inclUding reasonable profit and damages. Upon default in pa~ment of any installment as provided in Paragraph 5.2, the Buyer hereby authorizes and empowers any attorney of any Court of Record of Pennsylvania, or elsewhere, to appear for and to enter judgment against him (them) for the Contract Price, a sum certain, and for all moneys due under this Contract without defalcation, with costs of suit, release of errors, without stay of execution and with ten 110\1 percent added for collection feesl and he also waives the right of inqui- sition of any real estate that may be levied upon to collect this sumr and does hereby voluntarily condemn the same, and authorizps the Prot.honotary to enter upon the fi. fa. his said voluntary condemnation and he further agrees that said estate may be sold on fi. fa. and he hereby waives and releases all relief from any and all appraisement, stay or exemption laws of any state, now in force or hereafter to be passed. - 7 - 10.
