Pending further Order of this Court or agreement of the parties, the Mother, stacy Boone, and the Father, Desmond Washington, shall have shared legs 1 custody of Shantsy Boone, born May 26, 1985. The Mother shall have primary physical custody of the Child. 4. Pending further Order of this Court, the Father shall have partial physical custody of the Child on alternating weekends from Friday after school until the beginning of the school day on Monday morning and every Wednesday after school until the beginning of the school day on the following Thursday morning. 5. Pending further Order of this Court, during the summer school recess, the Mother shall have custody of the child for the first week after the termination of the school year. 'I'hereafter, the Father shall have custody of the Child during the sunmer school recess, with the Mother having periods of custody on alternating weekends from Friday evening until Sunday evening. 'rhe Mother shall also have custody of the Child during the summer recess when both the I'ather and his wife are working, instead of childcare being provided by a third party. 6. A Conciliation Conference was held on March 5, 1996, with the following individuals in attendance: The Father, Desmond R. Washington. with his counsel. Kathleen Carey Daley, Esquire, and the Mother, stacy BOOne. with her counsel, Joan Carey, Esquire. 3. By prior Order of this Court dated December 22, 1992. the Mother has had legal and primary physical custody of the child with periods of partial custody for the Father. who at that time. lived in Wilkes Barre. The Father has married and currently reaides in Harrisburg with his wife, son and step-daughter. The Mother resides in Carlisle with her daughter who is the subject of these proceedings, and two sons and a daughter from another relationship. The Father filed this Petition for primary physical custody of the Child. 4. The Father's position on custody is as followSl The Father believes that the Child's medical, dental and educational needs are not being met in the flother's household. The child is currently repeating fourth grade snd is participating in a learning support class. The Father stated that the school district in which he resides (Centrsl Dauphin) has a strong reputation for special offerings in the learning support area. The Father hss not been satisfied with the evaluation. testing snd programs in the Carlisle School District where the Child is currently enrolled. The Father believes that the Child's best interest would be served if he were to have primary custody and be afforded the opportunity to more closely supervise the Child'S educational development. 5. Major concerns have included the difficulty she has had maintaining academic progress. Her measured school learning sbllity fell in the borderline to average range. Academic achievement scores were not commensurate With ability in Math. The MDE/IEP team should convene to discuss hoW best to serve her needs. A COnciliation COnference was held on April 26, 2000, with the following individuals in attendance I The Father, Desmond R. Washington I with his counsel, Kathleen Carey OaleYI Esquire, and the Mother I Stacy Boone I with her counsel, Jaime Jablonski I student attorney and Robert Rains, Esquire. 3. 'Itlis COurt previously entered an Order in this matter on July 26, 1996 under which the Mother had primary physical custody and the Father had partial custody during the school ysar on alternating weekends and a rnid-week overnight I and during the entire summer with the exception of the Mother's alternating weekends. The Mother filed this Petition for Modification primarily seeking to reduce the Father's period of custody during the summer. The main issue at the COnference appeared to be the Mother's concern that the Father had not been taking the Child regularly to track practices during his peric.ds of custody. '1118 Father's position was that the Child's entitlement to participate in track should be contingent upon her performance in school. The Father was concerned that the Child is failing some major subjects. The parties agreed at the Conference to contact the Child's I.U.P teacher to set up a system whereby the teacher evaluates the Child's efforts in school on a weekly basis and provides the evaluation to both parties. ~he parties agreed that the Child's ability to participate in track during the following week would be dependent upon her receiving a certain rninimum rating from the I.U.P. teacher from the prior week.
