STIPULATION AGAINST LIENS
THIS AGREEMENT rnade this /) 1/ day 01' Cclt!"b'-. ' 1995, by
and between
MUlier Home Builders, Inc.
hereinafter referred to as Contractor,
AND
Michael T. Sellar and Carol A. Sellar, husband and wire ,
hereinafter referred to as Owners, whereby the contractor undertook
and agt'eed to erected and construct a single family dwelling on the
certain lot of ground situate in Middlesex Townlhip, Cumberland
County, Cornmonwealth of Pennsylvania, known as Lot 19, Hoover Road,
Carlble, Pa 17013 and more fully described in Exhibit "A" which is
attached hereto and rnade a part hereof.
NOW THIRIFORE, THIS AGRIIMINT WITNISSETHI That the said
Contractor, for an in consideration of the surn of ($1.00) Dollar to
Contractor in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration rnentioned in the
agreernent aforesaid, for itself, hirnself or themselves and its, his
or their subcontractors, and all parties acting through or under
thern, covenant and agree that no rnechanic's liens or claims shall
be filed or rnaintained by thern or any of them against the said
buildings and the lot of ground appurtenant thereto for or on
account of any work done or rnaterials furnished by thern or any of
thern under said contract or otherwise, for, towards, in, or about
the erection and construction of the said buildings on the lot
above described, and the said Contractor, for itself, himself or
thernselves, its, his or their subcontractors and others under them,
hereby expressly waive and relinquish the right to have, file, and
rnaintain any rnechanic I S liens or clairns against the said buildings
or any of thern, and agree that this instrurnent, waiving the right
of lien, shall be an independent covenant,

Exhibit "A"
ALL THAT CERTAIN parcel of land situate in the Township of
Middlesex, the County of Cumberland and in the Commonwealth of
Pennsylvania, being shown as Lot No. 19 on the Final Minor
Subdivision Plan for Carolyn R. Glace, as prepared by Fisher
Mowery Rosendale and Associates, as last revised on April 5, 1995
and recorded in the Office of the Recorder of Deeds for
Cumberland County on April 19, 1995 in Plan Book 69, Page 136.
BEGINNING at a parker kalon nail set in Hoover Road (T-573);
thence along and through said Hoover Road on a line curving to
the left, having a radius of 239.90 feet and a length of 149.11
feet to a parker kalon nail set; thence along the same North 59
degrees 03 rninutes 40 seconds East a distance of 115.99 feet to a
parker kalon nail set at the cornrnon corner of Lot No. 20 as shown
on the aforementioned subdivision plan; thence along said Lot No.
20, South 35 degrees 15 minutes 27 seconds East a distance of
447.06 feet to an iron pin set at lands of the Appalachian
National Scenic Trail; thence along said lands of the Appalachian
National Scenic Trail South 69 degrees 32 rninutes 55 seconds West
124.15 feet to an existing A.N.S.T. rnonument no. 365-Pa - 35 at
lands now or formerly of Thornas W. Laganosky and Marcia A.
Laganosky; thence along said lands of Thornas W. Laganosky and
Marcia A. Laganosky North 50 degrees 36 minutes 18 seconds West
a distance of 497.06 feet to a parker kalon nail set in Hoover
Road, the place of BEGINNING.
Containing 1.818 acres of gross area and subject to a 0.158 acres
of dedicated right-of-way along Hoover Road.
BEING the same premises which Carolyn R, Glace and Ivan M. Glace,
Jr. husband and wife by deed dated April 24, 1995 and recorded in
the Office of the Recorder of Deeds in and for Cumberland County
in Deed Book 121, Page 186, granted and conveyed to Michael T.
Sellar and Carol A. Seller, husband and wife, Borrowers herein.
