Kenjarski of Cumberland County, is about to execute contemporaneously herewith, a contract, with Haubert Homes, Inc. of Cumberland County, Pennsylvania, {'or the erection of a xxlaa~ building upon a lot of land situate in Hampden Township, Cumberland County, Pennsylvania, more fully described on Exhibit A attached hereto Pennsylvania, NOW. AUgUSt 28, 2002 ~ , at the time of and immediately before the execution of thc prin- cipal contract, and before any authority has been given by the said Kevin T. Kenjarski and Dana M. Kenjarski to the said Haubert Homes, Inc. to commence work on thc said building, or purchase materials for the same in consideration of the making of the said contract withKevin T. Kenjarski and Dana M. Kenjarski and the further consideration of One Dollar. to Haubert Homes, Inc. paid by Kevin T. Kenjarski and Dama M. Kenjarski , it is agreed that no lien shall be filed against the building by the contractor, or any sub-contractor, nor by any of the material men or workmen or any other person for any labor, or materials purchased, or extra labor or materials purchased for the erection of said building, the right to file such liens being expressly waived. SIGNED AND S~E PRESENCE OF ALL THAT CERTAIN tract or pamel of land being situate in Hampden Township, Cumberland County, Pennsylvania, more particu!arly bounded and described as follows, to wit: BEGINNING at a point on the suuthem fight-of-way line ofAldersgate Ckcle, a 50 foot wide street, said point being the northeastern comer of Lot No. 8; thence along said fight-of-waY line along a curve to the lek having a radius of 1025.00 feet and an arc length of 112.20 feet, said arc being subtended by a chord of North 76 degrees 23 minutes 09 seconds East, a distance of 112.14 feet to a point; thence continuing along said fight-of-way/Me along a curve to the right having a radius of 15.00 feet and an arc length of 17.36 feet, said arc being subtended by a chord of South 73 degrees 35 minutes 29 seconds East, a distance of 16.41 feet to a point, said point being the northwestern corner of Lot No. 28; thence along the western line of said lot, South 19 degrees 28 minutes 24 seconds West, a distance of 141.65 feet to a point, said point being on the northern line of Lot No. 8; thence along the northern line of said lot, North 65 degrees 07 minutes 29 seconds West, a distance of 68.52 feet to a point, said point being on the eastern line of Lot No. 8; thence along the eastern line of said lot, North 10 degrees 28 minutes 43 seconds West, a distance of 84.37 feet to a point, the place of BEGINNING. CONTAINING 10,545.18 square feet or 0.2421 acres. BEING Lot No. 27 as shown on the Final Subdivision Plan of Fairwinds, Phase III, recorded in the Office of the Recorder of Deeds, Cumberland County, in Plan Book 78, Page 90.
