FETTROW, JR., Defendant IN DIVORCE THE MASTER I Today is Friday, September 26, 1997. This is the date that we have set for a conference with the parties and counsel in the above captioned divorce proceedings to determine if we come to some resolution of the outstanding claims involving assets and debt. Present in the hearing rOvm are the Plaintiff, Annette M. Fettrow and her counsel the Family Law Clinic, who is represented by Thomas M. Place and Tina Moukoulis, certified legal intern. Also present with the Family Law Clinic is Donald Marritz, staff attorney. Present also is the Defendant, David S. Fettrow, Jr. and his counsel Michael J. Hanft. A divorce complaint was filed on October 20, 1995, raising grounds for divorce of irretrievable breakdown of the marriage. The parties are going to sign affidavits of consent and waivers of notice of intention to request entry of divorce decree today which the Master's Office will file. The divorce, therefore, will be able to conclude under Section 3301(c) of the Domestic Relations Code. The complaint also raised the economic claim of equitable distribution. On March 11, 1997, the Plaintiff filed a petition for al.1mony. No claims have been filed by either party for counsel fees and expenses. The parties were married on January 22, 1993, and separated on September 4, 1995. They are the natural parents of two children, David S. Fettrow, III, born August 10, 1993, and Mary B. Fettrow, born September 29, 1994. The Master has been advised that after discussion this morning the parties and counsel have come to an agreement to resolve all of the outstanding issues. The agreement is going to be placed on the record in the presence of the parties and the agreement as stated on the record will be considered the substantive agreement of the parties not subject to any changes or modifications. The parties understand that upon the statement of the agreement and their affirmation on the record after the statement of the agreement, that the agreement cannot be changed or modified and that the agreement will be enforcible as an order of court. Unlike our usual procedure of having the parties and counsel return to sign the agreement, the Master is not going to require the agreement be signed. The signing is simply an affirmation of the terms of settlement which are going to be stated on the record. ~ After the agreement has been prepared by the court reporter, the Master will prepare an order vacating his appointment, and the parties and counsel can then conclude the divorce by the filing of a praecipe to transmit the record to the Court along with the affidavits signed by the parties. The debt and property shall be distributed and assigned in the following manner: As to the real property, Annette Fettrow shall assign to David Fettrow her interest in the 1.25 acres of land located on Peach Road in Newville, Pennsylvania. Oavid Fettrow shall be solely responsible for the $4,000.00 debt owed to David Fettrow, Sr. David Fettrow shall indemnify and hold harmless Annette Fettrow for this debt. Annette Fettrow shall execute a special warrenty deed conveying said land to David Fettrow, Jr., within two weeks of presentation. 2. Personal Property I Annette Fettrow shall assign to David Fettrow her interest in the Sears garden tractor with snow plow and mower attachments which is currently in David Fettrow's possession. David Fettrow shall be solely responsible for any outstanding debt associated with the purchase of this tractor incurred on the Sears Plus account, No. 0554654296710 and shall indemnify and hold harmless Annette Fettrow for this debt. All other tangible personal property has been distributed between the parties and each party will retain the property presently in his or her possession free of any claims by the other party. , 3. Debtl David Fettrow shall be responsible for the debt of $1,897.50 owed to the Huntington National Bank, account No. 4071583870033975, and shall indemnify and hold harmless Annette Fettrow for this debt. David Fettrow shall be responsible for the debt of $1,500.00 owed to Lowes, account No. 81602216115937, and he shall indemnify and hold harmless Annette Fettrow for this debt. In the event that there have been any charges made in addition to these balances they would be wife's sole responsibility. FETTROW, JR., Defendant IN DIVORCE THE MASTERI Today is Friday, september 26, 1997. This is the date that we have set for a conference with the parties and counsel in the above captioned divorce proceedings to determine if we corne to some resolution of the outstanding claims involving assets and debt. Present in the hearing room are the plaintiff, Annette M. Fettrow and her counsel the Family LaW Clinic, who i. represented by Thomas M. place and Tina Moukoulis, certified legal intern. Also present with the Family Law Clinic i. Donald Marritz, staff attorney. Present also is the Defendant, David s. Fettrow, Jr. and his counsel Michael J. Hanft. A divorce crmplaint was filed on October 20, 1995, raising grounds for divorce of irretrievable breakdown of the marriage. The parties are going to sign affidavits of consent and waivers of notice of intention to request entry of divorce decree today which the Master's Office will file. The divorce, therefore, will be able to conclude under Section 3301(c) of the Domestic Relations code. The complaint also raised the economic claim of equitable distribution. On March 11, 1997, the Plaintiff filed a petition for alimony, No claims have been filed by either party for oounsel fees and expenses. The parties were married on January 22, 1993, and separated on September 4, 1995. They are the natural parents of two children, David S. Fettrow, III, born August 10, 1993, and Mary B. Fettrow, born September 29, 1994, The Master has been advised that after discussion this morning the parties and counsel have come to an agreement to resolve all of the outstanding issues, The agreement is going to be placed on the record in the presence of the parties and the agreement as stated on the record will be considered the substantive agreement of the parties not SUbject to any changes or modifications. The parties understand that upon the statement of the agreement and their affirmation on the record after the statement of the agreement, that the agreement cannot be changed or modified and that the agreement will be enforcible as an order of court. Unlike our usual procedure of having the parties and counsel return to sign the agreement, the Master is not going to require the agreement be signed. The signing is simply an affirmation of the terms of settlement which are going to be stated on the record. After the agreement h~~ been prepared by the court reporter, the Master will prepare an order vacating his appointment, and the parties and counsel can then conclude the divorce by the filing of a praecipe to transmit the record to the Court along with the affidavits signed by the parties. The debt and property shall be distributed and assigned in the following manner: As to the real property, Annette Fettrow shall assign to David Fettrow her interest in the 1,25 acres of land located on Peach Road in Newville, Pennsylvania. David Fettrow shall be solely responsible for the $4,000.00 debt owed to David Fettrow, Sr. David Fettrow shall indemnify and hold harmless Annette Fettrow for this debt. Annette Fettrow shall execute a special warrenty deed conveying said land to David Fettrow, Jr" within two weeks of presentation. 2. Personal Property: Annette Fettrow shall assign to David Fettrow her interest in the Sears garden tractor with snow plow and mower attachments which is currently in David Fettrow's possession. David Fettrow shall be solely responsible for any outstanding debt associated with the purchase of this tractor incurred on the Sears Plus account, No. 0554654296710 and shall indemnify and hold harmless Annette Fettrow for this debt. All other tangible personal property has been distributed between the parties and each party will retain the property presently in his or her possession free of any claims by the other party, 3.
