WAIVER OF RIGHT TO FILE MECHANICS' LIENS

ALL THAT CERTAIN lot of ground situate in Cooke Township
(previously erroneously identified as Penn Township), Cumberland
County, Pennsylvania, bounded and described as follows:
BEGINNING at a point on the southern side of Pine Tree Drive,
said point being also on the division line between Lot 34 and Lot
35 on the hereinafter mentioned Plan of Lots; thence along the
latter, South 09 degrees 30 minutes 00 seconds East, a distance
of 466.57 feet to a point at line of land now or late of the
Commonwealth of Pennsylvania; thence along the latter, South 79
degrees 49 minutes 40 seconds West, a distance of 211.50 feet to
a stone; thence along the same, North 45 degrees 31 minutes West,
a distance of 289.97 feet to a point on the division line between
Lot 33 and Lot 34 on the hereinafter mentioned Plan of Lots;
thence along the latter, North 44 degrees 06 minutes 10 seconds
East, a distance of 423.29 feet to a point on the southern line
of Pine Tree Drive; thence eastwardly along the latter on a curve
to the left, having a radius of 145 feet, a distance of 44.71
feet to a point on the division line between Lot 34 and Lot 35,
the PLACE OF BEGINNING.
BEING described according to a Plan of Lots known as Lake Warren
Estates, prepared by Thomas A. Neff, R.S., dated September 10,
1966 and recorded in the Office of the Recorder of Deeds for
Cumberland County, Pennsylvania, in Plan Book 18, Pages 57 and
58, and being designated as Lot No. 34 thereon.
BEING the same premises which James W. McClafferty, single man,
by his deed dated September 27, 2000 and recorded in the Office
of the Recorder of Deeds of Cumberland County in Deed Book 229,
Page 847 granted and conveyed unto Bret J. and Jennifer L.
Gibboney, husband and wife.
FOR right-of-way and use restriction see Deed from Pine Brook
Corporation to Waran Enterprises, Inc., dated August 21, 1968 and
recorded in the Office of the Recorder of Deeds in and for
Cumberland County in Deed Book "X", Volume 22, Page 197.
UNDER AND SUBJECT to all streets, lanes and building lines as
exist on said recorded Plan and also to the Declaration of
Restrictions recorded in Miscellaneous Book 176, Page 742.
BEING known as Cumberland County Tax Parcel # 07-37-2573-002.
