failed to set forth any facts disclosing that the Petition was timely filed, that there is a reasonable
explanation for his failure to file a Complaint. or that he has a meritorious cause of action, As
such, there Is no basis for granting the Petition to Open the Non Pros.

attend the Arbitration are true, they are Irrelevant to the issues here and do not support the

of non pros was entered for Plaintllfs failure to file a Complaint, not because his counsel failed to
attend an arbitration,

11, Admitted, It is admitted that Judgment of Non Pros was enlered in this case.
However, Judgment of Non Pros was not entered because oflhe failure ofPlainlilrs counsel to
appear at an arbitration. Rather, the Judgment of Non Pros was entered for Plaintilrs failure to
file a Complaint after being ruled to do so. It should be noted that the Praecipe to File a
Complaint was served on Plaintiff's counsel on December 4, 1995, The Judgment of Non Pros

wu entered on July 30.1999, A true and correct copy of the Praecipe for Entry of Judgment of
Non Pros is attached hereto as Exhibit A, Plaintiff had in excess offour years in order to file a
Complaint In this matter and failed to do so, Plaintiff has set forth no reason for failing to flIe the
Complaint,
12, Denied, It is specifically denied that this Petition was timely filed or that It was filed
within 30 days of the docketing of the Judgment of Non Pros, To the contrary, Judgment of Non
Pros wu entered in this case on July 30, 1999, (Eahlblt A) and Plslntiffs Petition was filed on
November 16, 1999, Under these circumstances, Plaintiffs Petition is untimely,
13, Denied, It is specifically denied that Plaintiff has set forth any circumstances which
would entitle him to have the non pros in this case stricken or opened, As indicated previously,
Judgment of Non Pros was entered in this case for Plaintiffs failure to file a Complaint, not
because Plaintiffs counsel failed to appear at an arbitration proceeding, Plaintiff has failed to set
forth any facts disclosing a defect on the face of the record or judgment which would justify
granting his request to strike the judgment. In addition, Plaintiff has set forth no facts which
would support opening the judgment. Plaintiffs Petition is untimely. and he has failed to explain
his failure 10 file a Complaint. Plaintiff has also failed to set forth facts indicating that he has a
meritorious claim.
14, Denied, It is specifically denied Ihatthe Defendants would suffer no prejudice by the
granting ofthis Petition. To the contrary, the Defendants would be prejudiced by the granting of
the Petition, The Praecipe for Writ of Summons was filed on October 23, 1995, Over four years
later, no Complslnt has been flied. Defendants have been prejudiced by Plaintiffs failure to
proceed with the case.

on December S, 1995, by cenified mail. A copy of the letter and the return receipt evidencing
service are attached hereto as Elhlblt C.
On February 2, 1996, Plaintifl's attorney flied a Petition to Withdraw as Counsel. By
Order dated April 10, 1996, the Honorable J, Wesley Oler, Jr., granted the Petition to Withdraw
as Counsel. Plaintiff has been pro se since that dale.
On June 8, 1999,the Plaintiff was served with a Notice of Praecipe to Enter Judgment of
Non Pros, This was sent by cenified mail to the Plaintiff at the State Correctional Institution at
Camp Hill where the Plaintiff is currently incarcerated. A copy of the Notice of Praecipe to Enter
Judgment of Non Pros as well as the return receipt are attached hereto as Elhlblta D and E.
Despite being properly served with said Praecipe, the Plaintiff failed to file a Complaint or to

Nearly five months after Plaintiff was served with the Praecipe for Entry of Judgment of
Non Pros, he filed the present Petition to Strike Off and/or Open the Judgment of Non Pros on
November 16,1999, On November 24,1999, Judge Oler issued a Rule on the Defendants to
show cause why Plalntlfl's Petition to Strike Offand/or Open Judgment of Non Pros should not
be granted,

proceedinga which hia counsel failed to altend, Defense counsel ia not aware of any arbitration
proceedinga that occurred in this case, and in any event, this would not explain Plaintiffs failure
to file a Complaint for in excess of three yeara. Finally,the Petition is devoid of any facls
indicating that Plalntiffhaa a meritorious cause of action. In fact, the Petition does not indicate in
any fuhion the basis of Plaintiff s action against the Defendants. Accordingly, the Petition fails to
meet the requiremenl8 of Rule 305 I and cannot support thc request to open judgment of non
pros,
The Plaintiff implies in thc Petition that his incarceration and lack of altomey excuse his
delay in this case. Proceeding pro se does not absolve the Plaintiff of his responsibilities to
comply with the procedural rules and the substantive law. SI!I! Jones v. Rudenstein, 40 I Pa.
Super, 400,404, 585 A,2d 520, 522 (1991) (wherein the Court detennined Ihat pro Be litigants
who are incarcerated must comply with procedural rules.) Plaintiffs incarceration and lack of
attorney, therefore, do not excuse his failure to proceed with this case by ming a Complaint
against the Defendants,

In summary, the Plaintilrs Petition to Strike and/or Open Judgment of Non Pros should
be denied, Plaintiff has failed to set forth any dcfccts in Ihe record which would justify striking
the judgment of non pros, Morcovcr, Plaintiff has failed to IlIcctany of the requiremcnts for

Prothonotary of Cumberland County. Thc PlalntilTwas served with a copy of this Praecipe for

Nearly five months after PlaintilTwas scrved with thc Pracclpc for Entry of Judgmcnt of
Non Pros, he filcd the present Petition to Strike OlTandlor Open the Judgment ofNlIn Pros on
November 16, 1999, On Novembcr 24, 1999, Judge Olcr issued a Rule on the Defendants to
show cause why Plalntitrs Pctltion to Strike OlTandlor Open Judgment of Non Pros should not
be granted.

proceedings which his counsel failed to aUend, Defense counsel Is not aware of any arbitration
proceedings that occurred in this case. and In any event, this would not explain Plalntltrs failure
to file a Complaint fllr In excess of three years, Finally, the Petition Is devoid of any facts
Indicating that Plaintiff has a meritorious cause of action , In fact, the Petition does not indicate in
any fashion the basis ofPlaintltrs action against the Defendants, Accordingly. the Petition fails to
mcetthe requirements of Rule 3051 and cannot support the request to open judgment of non
pros.
The Plaintiff implies in the Petition that his incarceration and lack ofauomey excuse his
delay in this case, Proceeding pro Be dlles nllt abslllve the Plaintiffllfhls responsibilities tll
comply with the procedural rules and the substantive law, See Jones v, Rudensteln, 40 I Pa,
Super. 400.404, 585 A,2d 520. 522 (1991) (wherein the Court detennined that pro se litigants
who are incarcerated must comply with procedural rules,) Plaintltrs incarceration and lack of
attorney. therefore, do not excuse his failure to proceed with this case by filing a Complaint
against the Defendants,
IV. CONCLUSION
In summary, the Plaintitrs Petition to Strike and/or Open Judgment of Non Pros should
be denied. Plaintiff has failed to set forth any defects in the record which would justifY striking
the judgment of non pros. Moreover,Plalntlffhas failed to meet any of the requirements for
opening a judgment of non pros for failure to file a Complaint, The Petition to Strike and/or
Open was not timely filed, The Plaintiff has also failed to provide any explanation for his failure
to file a Complaint and has failed to set forth any facts which would indicate he hDS a meritorious
