ELECTION MATTER
HEARING MEMORANDUM
This malter concerns the County's petition to divide Hampden Township into 12
Instead of the the existing 7 voting precincts. The basis of the petition is the number of
voters In each of the existing precincts,
Article V of the Election Code (25 P,S, ~2701 et. seq,)' controls election
districts. This petition Is brought by the County pursuant to 25 P.S, ~2704.' The Court
Is given the power to create new election districts by 25 P,S, ~2702. That section
provides that new districts shall contain between 600 and 800 registered electors.
However the section also states that no district shall be formed with less than 100
registered electors. The 600 to 800 range, has, however, been held not to be
mandatory, or at least not the maximum number of voters permllled In new election
districts, In Re Petition for Redistricting Voting Districts of Ross Township, 2 D.&C. 4th
447, 1988, affirmed 557 A,2d 59, 125 Pa,Cmwlth, 191. In Re Division of West Third
North Ward of Cheltenham Township, 25 D,&C, 2d 104 (1962)'
25 P.S. ~2704 states that upon petition: "", the court may make such order for
the division, redlvlslon, alteration, formation or consolidation of election districts, as
will, In its opinion, promote the convenience of electors and the public interests,,," 25
P ,So ~2702 states that election districts may be divided: "so as to suit the convenience
of the electors and to promote the public interests:' The case of In Re Jackson

This matter concerns the County's petition to divide Hampden Township Into 12
Instead 01 the the eKlstlng 7 voting precincts. The basis 01 the petition 15 the number 01
voters in each 01 the eKlstlng precincts.
Article V 01 the Election Code (25 P.S. ~2701 et. seq. )' controls election
districts. this petition 15 brought by the County pursuant to 25 P.S. ~2704.' The Court
15 given the power to create new election districts by 25 P.S. ~2702. Thatsectlon
provides that neW districts shall contain between 600 and 800 registered electors.
However the section also states that no district shall be lormed with less than 100
registered electors. The 600 to 800 range, has, however, been held not to be
mandatory, or at least not the maKlmum number 01 voters permitted In new election
districts. In Re Petition for Redistricting Voting Districts of Ross Township, 2 D.&C. 4th
447, 1988, affirmed 557 A.2d 59, 125 Pa.Cmwllh. 191. In Re Division of West Third
North Ward of Cheltenham Township, 25 D.&C. 2d 104 (1962)'
25 P.S. ~2704 states that upon petition: "...the court may make such order lor
the division, redlvislon, alleratlon, lormatlon or consolidation 01 election districts, as
will, In Its opinion, promote the convenience 01 electors and the public Interests..." 25
P.S. ~2702 stales that election districts may be divided: "50 as to suit the convenience

precinctB of Hampden TownBhip. We held a hearing to eBtabliBh
fact, on Augu,t 5, 1996.
FINDINGS OF FACT
1. Notice waB pOBted in five (5) of the current voting
precinctB at the front door of the buildingB on July 25-26, 1996.
The nottceB Bet forth the reapportionment Bcheme, the date upon
which the Bcheme waB to be conBidered by the court, and a warning
that objectionB Bhould be filed with the Prothonotary prior to
the date of the hearing.

4. These proposed precincts were submitted by the
Commissioners of Hampden Township and follow the current census
lines.
5. To the best of the knowledge of Dennis Marion,
Cumberland County Administrator, inquiries have been made into
the nonpublic party locations of the polling places which are
proposed by Petitionere. This informal inquiry reveals that all
parties are agreeable to the use of their property as a polling
place.
6. Hampden Township has approved the plan to build new
developments in Hampden 5 and Hampden 12 which will significantly
increase the population of these precincts once the development
is accomplished. These developments are expected to add
approximately 250 to 300 homes to each precinct.
7. A brief survey of the Hampden Township Judges of
Elections indicates that prospective voters have experienced
delays of up to one hour. (Pet. Ex. 2). The most serious delays

occur during presidential Elections.
8. Testimony by David R. Harris indicates that because much
of the Hampden community is made up of commuting workers, there
is a tendency to vote around the hours of 7100 to 8120 AM or 5100
to 8130 PM, which are the times of the day when most of the
waiting occurs.
9. Although no one has been disenfranchised by the current
precinct scheme, the reapportionment would make it more
convenient for the population to vote and easier to disseminate
information and conduct voter registration.
10. No citizen of Hampden Township contacted the solicitor
to indicate their disapproval or this plan. Furthermore, no one
appeared at the hearing or filed objections with the
Prothonotary.
DISCUSSION
This petition is brought by the County Board of Elections
pursuant to section 2704 which provides in part as followSI
Upon the presentation of any such petition by the
count! board, . . . the court may make such order for
the d vision, redivision, alteration, formation or
consolidation of election districts, as will, in its
opinion, promote the convenience of electors and the
public interests. . . .

A court may not make a final order "until
at least ten days after notice shall have been posted in at least
five public and conspicuous placed in the district or districts
to be affected thereby, one of which notices shall be posted on
or in the immediate vicinity of the polling place in each such

district." .liL. These notices should state the reapportionment
scheme, the date upon which the scheme will be considered by the
court, and a warning that objections should be filed prior to the
date of the hearing. .liL.
A court is authorized to reapportion districts
. . . so as to suit the convenience of the elsctors and
to promote the public interests. Election districts so
formed shall contain between six hundred (600) and
eight hundred (BOO) registered electors as noarly as
may be. No election district shall be formed that
shall contain less than one hundred (100) regietered
electore. When a echool district crosses county lines,
the regions of the school shall be composed of
contiguous election districts.
25 P.S. Section 2702. The 600 to BOO range is a guideline which
is not a mandatory provision. In re Petition for Redistrictinq
votinq Dist. of Ross Township, 2 D & C.4th 447 (Alleg. Co. 19BB)
a[['d 125 Pa.Commow. 191, 557 A.2d 59 (19B9). These figures are
to be a minimum standard for the size of an individual election
district, rather than the absolute maximum number permissible
after division of the district. In re Div. of West Third North
Ward of Cheltenham Township, 25 D & C.2d 104 (Hontg. Co. 1962).
Given the current numbers of registered electorate voters,
this reapportionment will certainly suit the conveniencs of the
electors and promote the public interest. This Court is
confident that these new districts will make it easier for
citizens of Hampden Township to carry out their right to enjoy
their franchise by eliminating unnecessary delays at each
precinct. Petitioners have satisfied all of the notice

provisions of the Election Code and have developed adequate
precinct lines which conforms to the appropriate regulations.
Furthermore, ten of the twelve proposed precincts contained the
number of voters recommended by 25 P.S. Section 2702. Although
the registered electorate of Hampden 5 and 12 fall short of that
guideline, given the new developments which have been approved by
Hampden Township, thie Court is satisfied that these additions
will place the aggregate registered electorate firmly within this
range. The endorsement of the Hampden County Board of Elections
as well as the support of the citizens and various organizations
convinces this Court that reapportionment of the current
precincts would be in the best interest of the Hampden Townehip.
ORDER
AND NOW, this ~~ day of August, 1996, upon careful
consideration, the reapportionment and creation of give new
additional election districts of Hampden Township is APPROVED.
The election districts in Hampden Township shall be known as
