STIPULATION AGAINST LIENS

THIS AGREEMENT made the JJ, day 01 Odo.L , 1995, by and
between C & C CONSTRUCTION CUSTOM HOMES, hereinafter referred to as Contractor, and
STEVEN F. ALBRIGHT Ind SANDRA R. ALBRIGHT, husband and wile, hereinafter relerred to as
Owner, whereby the lormer undertakes and agrees to erect and construct a Single lamily dwelling
on:
ALL THAT CERTAIN lot or piece 01 ground situate in the Township 01 North
Middleton, in the County 01 Cumberland, Commonwealth of Pennsylvania, more particularly
bounded and described as follows, to wit:
BEGINNING at a point on the Northern side 01 Skyline View (50.00 leet wide) at the
Southeastern corner 01 Lot No. 10 on the hereinafter mentioned Plan 01 Lots; thence along Lot No.
10, North 07 degrees 29 minutes 18 seconds East a distance 01128,00 feet to a point at other land
now or formerly of Fred A, Gettys, recorded In Deed Book "U", Volume 32, Page 921: thence by the
same South 82 degrees 30 minutes 42 seconds East a distance 0185,00 leet to a pOint at Lot No.
8; thence by Lot No, 8 South 07 degrees 29 minutes 18 seconds West a distance of 128,00 feet to
a point at Skyline View; thence by Skyline View North 82 degrees 30 minutes 42 seconds West a
distance 01 95.00 leet to a point the Place 01 BEGINNING,
BEING Lot No, 9 on Plan 01 North Ridge, Phase 1, recorded In the Office 01 the
Recorder of Deeds in and lor Cumberland County, in Plan Book 67, Page 120,
CONTAINING 10,860,00 square leet.
BEING the same property which Fred A. Gettys and Yvonne W, Gettys, husband and
wife, by their Deed dated 0 l \.'\:, u..., ,). '-I , 1995, and recorded in the
Office 01 the Recorder 01 Deeds in and lor Cumberland County, in Deed Book Ho, Page I lo't ,
granted and conveyed unto Steven F. Albright and Sandra R. Albright, husband and wile,
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said Contractor, lor and in
consideration 01 the sum 01 One ($1.00) Dollar to them In hand paid by Owner, the receipt whereol
Is hereby acknowledged, and the lurther consideration mentioned in the agreement aloresaid, for
themselves and their subcontractors, and all parties acting through or under them, covenant and
agree that no mechanic's liens or claims thereto lor or on account 01 any work done or materials
lurnlshed by them or any 01 them under said contract or otherwise, lor, towards, in, or about the
erection and construction 01 the said buildings on the lot above described, and tha said Contractor,
lor themselves, their subcontractors and others under them hereby expressly waive and relinquish
the right to have, file and maintain any mechanic's liens or claims against the said buildings or any
of them, and agree that this instrument, waiVing the right of lien, shall be an independent covenant.
