assigned,
5. ROBERT M, SMILEY, JR. and CRYSTAL S. SMILEY, are the
sole record owners in fee simple of said premises subject to
said mortgage, by virtue of a Deed dated and recorded on April
16, 1992, and recorded in the Cumberland County Record~r's
Office in Deed Book "Po, Volume 35, Page BBB, more specifically
set forth in Exhibit "CO, attached hereto and made a part
hereof by reference,
6. Said note and said real estate mortgage are in default
because Defendants herein have failed to pay the payments that
were due and owing for the following months, May , June, July
August. September and October 1995, said payments being due and
payable the 15th day of each month.
7. The Plaintiff has given to the Defendants written
notice of intention to foreclose on said mortgage as required
by law under Act 6, dated June 20th, 1995. a copy of which is
marked Exhibits "0", and attached hereto and made a part hereof
by reference.
8. The Plaintiff has given written notice of default as
required by the Homeowner's Emergency Assistance Act of 1983,
dated June 20th, 1995, a copy of which is marked Exhibits "E",
and attached hereto and made a part hereof by reference.

That the Movant is a secured creditor of Debtors by virtue of a promissory note and
mortgage dated April IS, 1992 in the original principal amount of $68,000.00. Copies of the
promissory note and mortgage are attached hereto, made part hereof and marked Exhibit A,
said copies being true and correct reproductions of the originals.

That Debtors are indebted to the Movant on the mortgage referred to in paragraph 3 in
the amount of $72,131.82 calculated as follows:

a mortgage payable to Movant In !he amount of $35,000.00 dated September 13, 1993 and
recorded in Cumberland County Mortgage Book 1165, Page 1030.

That Debtors are indebted to Movant on the mortgage referred to In paragraph 8 In the
amount of $35,575.08 calculated as follows:

December 28, 1995, January 28, 1996 and February 28, 1996 were not made.

That Movant believes and therefore avers that the real estate taxes for the years 1994
and 1995 are delinquent and unpaid in an amount In excess of $2,000,00.

That Movant believes and therefore avers that the fair market value of the property
referred to in paragraph 2 Is $100,000.00,

That Movant belleves and therefore avers that Debtors do not have either equity or a
sufficient equity cushion in the collateral pledged as security for the loan referred to In

That Movant belleves and therefore avers that there Is not adequate protection of its
Interest in the collateral pledged as security for the loan referred to In paragraph 3 because
there Is neither equity nor a sufficient equity cushion.

That a Sheriff's Sale of the property described In paragraph 2 was scheduled In
Cumberland County, Pennsylvania for March 6, 1996 In an action of mol1gage foreclosure

for the purpose of delay. ,

That Movant believes and therefore avers that uniess the automatic stay is tenn\nated its
Interest in the collateral pledged as security for the loan referred to In paragraph 3 will be

WHEREFORE 1 Movant respectfully requests that your Honorable Court issue an Order
tennlnatlng the Automatic Stay so that Movant may forthwith enforce its security Interest In
the mOl1gaged property pursuant to the provisions of the Instruments marked Exhibit A and
according to applicable law with the proceeds of any Sheriff's Sale subsequently held being
