Plaintiff/Appellee JOHN A. WALKER. t/d/b/a JOHN A. WALKER
PLUMBING AND HEATING. by hie attorney, Richard F. Maffett, Jr.,
Esquire, and reepectfully represente the following:
1. On October 26, 1995. the Defendant/Appellant filed a
Notice of Appeal from District Juetice Judgment. regarding a
judgment entered by District Justice Jlelen B. Shulenberger,
Magisterial Dietrict 9-3-02, on September 26, 1995 at
cV-OOOOI30-95. in favor of Plaintiff/Appellee, John A. Walker
Plumbing and Jleating,
2. Pa. R.C,P.J,P, No. l005(A) requires that the
Defendant/Appellant must eerve a copy of the Notice of Appeal
upon the Appellee/Plaintiff and upon the District Justice who
rendered the judgment.
3. Pa. R.C.P.J.P, No, 1005(B) requires that
Defendant/Appellant shall file with the Prothonotary proofs of
service of his Notice of Appeal within ten (101 days after filing
his Notice of Appeal.
4. The Defendant/Appellant hae violated Pa. R.C.P.J.P. No.
1005(B). since more than ten (10) days have elapsed since the
Defendant/Appellant filed the Notice of Appeal and the
Defendant/Appellant has not filed with the Prothonotary a proof
of service of the Notice of Appeal upon Appellee/Plaintiff.
5. The Defendant/Appellant has violated Pa. R.C,P.J.P. No.
1005(B). since more than ten (10) days have elapsed since the
Defendant/Appellant filed the Notice of Appeal and the
Defendant/Appellant has not filed with the Prothonotary a proof
of service of the Notice of Appeal upon District Justice Helen B.
Shulenberger.
6, Pa. R.C.P.J.P. No. 1006 requires that upon failure of
the Appellant/Defendant to comply with Pa. R.C.P.J.P. No.
1005(B). the Prothonotary shall. upon praecipe of the
Appellee/plaintiff, mark the appeal etricken from the record.
WHEREFORE. Appellee/plaintiff respectfully requests that the
Prothonotary mark the aforesaid Appeal of District Justice
Judgment etricken from the record,
