AND NOW. comes the Plaintiff, VlIIlIIe Associates. lIa Hampden Village. by and
throuah its attorneys, Goldbera. Katzman &. Shipman. P.C. and who repreaents as follows:
I. Plaintiff. Vlllaae Associates. lIa Hampden VlIlllle, Is a Pennsylvania partnership
havlna a principal place of business at 431 Wren Court. Hampden Township, Cumberland
County, Pennsylvania 17055.
8. Defendanll have failed to..y monthly rent to the Plaintlffbe&lnnlng In the month
of July 1995, and contlnulna through the preaent time.
9. By letter dated July 31, 1995, aent via certified mail, Plaintiff gave written notice
to Defendanll of their default under the Leue, by reaIOIl of their failure to pay rent II required
under the LaIe, and pve notice that eviction proceedings would commence If rent WII not
brouaht current by the end of August 1995.
10. When Defendants refused the vacate the premlllelll requested and continued in
their failure to ..y rent due and owina, Plaintiff instituted an action for possession based on
bracll of the Lease before District Justice Pamer.
11. On or about Seplcmber 26, 1995, District Justice Pamer entered an Order for
Pouesslon in favor of the Plaintiff ..ainst the Defendanll.
12. On or about October 26, 1995, Defendants flied a Notice of Appeal from the
Order of District Justice Pamer, therefore requiring Plaintiff to flIe the Instant Complaint.
13. Defendants continue to refuse to vacate the premises, despite the judgment entered
..ainst them and despite receipt of written notice to vacate.
14. Under the terms of the Lease between the parties and under apptlcable law,
Plaintiff is entitled to posllelslon of the premises at 6006 Hummingbird Drive, Hampden

PRELIMINARY OBJECTIONS TO PLAINTIFF'S COMPLAINT
COMES NOW Defendant Tammy Wargo, through her attorney,
Philip C. Briganti, Legal Services, Inc, and raises the following
Preliminary Objections:
I. DEMURRER
1. Plaintiff operates a "mobile home park" as this term is
defined by the Mobile Home Park Rights Act (68 P.S. 6398.1 ~
~), and is sUbject to the requirements of said Act.
2. Defendant Tammy Wargo is a "mobile home resident" as
this term is defined by the Mobile Home Park Rights Act (68 P.S.
6398.1 n .llltlh
3. In Paragraph 9 of Plaintiff's Complaint, Plaintiff avere
as follows: "By letter dated July 31, 1996, sent via certified
mail, Plaintiff gave written notice to Defendants of their
default under the Lease, by reason of thsir failure to pay rent
as required under the Lease, and gave notice that eviction
proceedings would commence if rent was not brought current by the
end of August 1996."
4. Although Plaintiff did not attach a copy of this letter
to its Complaint, a copy of the letter is attached hereto and
marked as Defendant's Exhibit "A".
6. This letter fails to state that an additional nonpayment
of rent occurring within six months of the giving of the notice
may result in immediate eviction proceedings, in violation of 68
P.S. 1398.3(b)(2)(i l.
6. Because Plaintiff's notice to quit is defective,
Plaintiff cannot pursue an eviction action to remove Defendants
from the mobile home park and has failed to state a claim for
which relief can be granted.
WHEREFORE, Defendant Tammy Wargo respectfully requests that
Plaintiff's Complaint be dismissed.
II. PETITION RAISING QUESTION OF JURISDICTION
7. Paragraphs 1 through 6 are incorporated herein by
reference.
8. Service of a note to quit which is in strict compliance
with the Mobile Home Park Rights Act is a jurisdictional
prerequisite to the commencement of an eviction action against a
mobile home park resident.
9. Because Plaintiff failsd to serve Defendants with a
notice to quit which complies with the Mobile Home Park Rights
Act before commencing eviction proceedings against Defendants,
this Court lacks jurisdiction over the SUbject matter of this
action.
