hereby demands that the above named claimant, Donna L.
Robinson, answer the following Interrogatories, under oath,
pursuant to the Hules of Civil Procedure, within thirty (JO)
days after date of service hereof. These interrogatories
shall be deemed continuing, so as to require supplemental
answers if the affiant or anyone on claimant's behalf obtains
further information between the time the answers are served
and the time of !:t'ial. 'J'he foregoing instructions are deemed
to be incorporated in the Intencogatories which must be
answered strictly in nccordance with the same.

1. statement of Facts
A. Liability
Plaintiff Nathaniel Stanley obtained jUdgment by default
against Defendant George F. SUllenberger, Sr. on December 12,
1995. JUdgment was entered in favor of Plaintiff in the
amount of $8,000.00 plus interest and costs of suit.
Plaintiff then filed a Praecipe for Execution on April
18, 1996 and the Writ of Execution was duly served on April
24, 1996. On April 29, 1996 George F. SUllenberger, Jr.
filed a property claim and on April 30, 1996 Donna L.
Robinson filed a property claim.
The Sheriff of Cumberland County entered property claim
determinations in favor of George F. SUllenberger, Jr. on May
8, 1996 and in favor of Donna L. Robinson on May 10, 1996.
On May 17, 1996, Plaintiff timely filed objections to the
Sheriff's property claim determinations.

On May 8, 1996 Plaintiff served upon George F.
Sullenberger, Jr. and Donna L. Robinson Request for
Admissions. The answers to Plaintiff's request are not
adequate verified denials Accordingly, each matter set
forth in Plaintiff's Request for Admissions is deemed
admitted by property claimants George F. Sullenberger, Jr.
and Donna L. Robinson.
Aside from their bald assertions of ownership, there is
no competent evidence offered by claimants that the property
levied upon belongs to them.
B. Damages
The Sheriff's Interpleader action should be dismissed
and Plaintiff should be permitted to proceed with a Sheriff's
sale of defendant's property. Additionally, Plaintiff is
entitled to be awarded a reasonable counsel fee as part of
the costs pursuant to Pa.R.C.P. 3123.

MOTION FOR SUMMARY JUDGMENT
AND NOW, by and through his attorneys, Bratic & Portko,
Plaintiff Nathaniel Stanley files the following Brief in
support of his Motion For Summary Judgment.
I. Factual and Procedural History
Plaintiff Nathaniel Stanley obtained judgment by default
against Defendant George F. Sullenberger, Sr. on December 12,
1995. Judgment was entered in favor of Plaintiff in the
amount of $8,000.00 plus interest and costs of suit.
Plaintiff then filed a Praecipe for Execution on April

24, 1996. On April 29, 1996 George F. Sullenberger, Jr.

Both George F. Sullenberger, Jr. and Donna L. Robinson
failed to serve answers or objections to the Request for
Admissions within 30 days after service, contrary to the
requirements of Pa.R.C.P. 4014(b). Accordingly, each matter
set forth in Plaintiff's Request for Admissions is deemed
admitted by property claimants George F. Sullenberger, Jr.
and Donna L. Robinson.
Plaintiff's motion is based on the pleadings, answers to
interrogatories, request for admissions, request for
production of documents and affidavits, if any, filed herein.
II. Standard for S~ary Jud~ent

When a motion for summary judgment is made and supported
as provided in Rule 1035, the non-moving party (in this case
the property claimants) may not rest on the averments made in
their claim. Johnson v. Harris, 615 A2d. 771, 775 (pa.
Super. 1992)1 McDonald v. Marriott Corp., 564 A.2d 1296

III. Argwaent
Pretrial discover proceedings are available in a
sheriff's interpleader action. As noted in Goodrich Amram
2d, Volume 8, Section 3216:1, "if the property claim is
inadequate in its statements of facts, discovery is available
to determine any matters which may be relevant to the trial
of the interpleader."
The property claims filed by Donna L. Robinson and
George F. Sullenberger, Jr. are clearly deficient and fail to
establish how claimants obtained title to the property. The
Property Claim form which is used by the cumberland County
Sheriff's Office requires the property claimant to not only
identify the property claimed but also describe how
claimant obtained title to the property. The bottom section
of the property claim form reads: "The Claimant Obtained

Title to the Property as Follows:".
completes this section by writing:
"All property located in & around the premises of
the house located @ 481 Sample Br Rd except those
items belonging to George F. Sullenberger, Jr.
are the property of the undersigned."
Donna L. Robinson
And George F. Sullenberger, Jr. writes:
"These items stored in the basement are mine."
As a result, Plaintiff engaged in discovery which
included interrogatories, request for production of documents
and requests for admissions. The claimants failed to timely
serve answers to the Requests for Admissions, thus, each
Request for Admission is deemed admitted. Pa.R.C.P. 4014(bl.
If, on the interpleader issue, there are admitted facts
obtained by depositions, interrogatories or otherwise,
summary judgment is available. Goodrich Amram 2d, Volume 8,
Section 3212:2, page 615.
On the basis of the parties' pleadings and the Request
for Adminssions, the following factual matters are not
disputed:
that Donna L. Robinson and George F. Sullenberger,
Jr. are the property claimants,
that the property claimed by Donna L. Robinson is
that of the defendant George F. Sullenbeger, Sr.,
that the property claimed by George F. Sullenberger,
Jr. is that of the defendant,
that the property claimed was acquired with funds
provided by defendant, and
that Donna L. Robinson and George F. Sullenberger,
Jr. have no documentation verifying their respective
claims of ownership filed with the Sheriff.
Aside from their bald assertions of ownorship, there i.

no competent evidence offered by claimants that the proper tv

There is no genuine issue as to any material fact and
Plaintiff is entitled to summary judgment in his favor as a
matter of law. The Sheriff's Interpleader action should be
dismissed and Plaintiff should be permitted to proceed with a
Sheriff's sale of defendant's property. Additionally,
plaintiff is entitled to be awarded a reasonable counsel fee

COMPLAINT
AND NOW, TO WIT, comes the Plaintiff Nathaniel stanley
by his attorneys, Bratic & Portko, upon a cause of action
of which the following is a statement:
COUNT I
1. Plaintiff, Nathaniel Stanley, is an adult individual
residing at 300 Ridge Road, Lot 84, Etters, PA 17319.
2. Defendant, George F. SUllenberger, Sr., is an adult
individual residing at 401 Sample Bridge Road, Enola,
Cumberland County, Pennsylvania 17025.
3. On or about June of 1994, Defendant contacted the
Plaintiff and requested of Plaintiff to purchase from
Plaintiff certain goods, service, wares and/or merchandise:
to wit, excavation, grading and paving of driveway at
Defendant's residence located at 481 Sample Bridge Road,
Enola, Pennsylvania.
4. On or about July 31, 1995, Defendant signed a
written proposal whereby the parties' agreed that Plaintiff
would per10rm the aforesaid services for the contract price
of SO,OOO.OO. Attached hereto/ marked Exhibit "A" and
incorporated herein by reference, is an itemized list of
charges, credits and demands made by Plaintiff to Defendant
for the goods, services, wares and/or merchandise requested
by Defendant and delivered by Plaintiff to Defendant showing
a balance due and owing of $8,000.00.
5. Defendant promised to pay to Plaintiff the aforesaid
sum of $8,000.00 which charge is the usual and reasonable
market price for said goods, services, wares and/or
merchandise charged by Plaintiff.
6. Plaintiff performed the work required by the
agreement in a good and workmanlike manner and performed all
other conditions precedent to Defendant's obligation to pay
for the work performed.
7. From time to time, Plaintiff has made demand upon
Defendant and has presented Defendant with the written
proposal for the payment of the usual and reasonable market
price for the said goods, services, wares and/or merchandise
for which Defendant agreed to be obligated, but Defendant has
persistently and willfully refused to pay the balance due and
owing to Plaintiff.
8. Defendant, at no time, made any objection of
whatever form to Plaintiff in regards to the correctness and
completeness of the work performed or the contents of Exhibit
"A", with the exception that Defendant demanded that
Plaintiff perform additional work not included in the
parties' agreement for the price quoted.
WHEREFORE, Plaintiff demands judgment against Defendant
as follows: in the amount of $8,000.00 plus the legal rate
of interest from July 31, 1995 and costs of suit as allowed

10. The said orders requested by Defendant were made
pursuant to and under the Uniform Commercial Code of the
Commonwealth of Pennsylvania (13 Pa.C.S.A. Section 1101
seq.).
11. Defendant has accepted and taken possession of the
goods, services, wares and/or merchandise requested and
ordered by him, and has, at no time, in any form whatsoever,
protested the quality of the goods, services, wares and/or
merchandise accepted by Defendant nor has Defendant in any
way alleged defects in the goods sold and delivered to
Defendants by the Plaintiff, with the exception that
Defendant demanded that Plaintiff perform additional work not
included in the parties' agreement for the price quoted.
WHEREFORE, Plaintiff demands judgment against Defendant
as follows: in the amount of $8,000.00 plus the legal rate
of interest from July 31, 1995 and costs of suit as allowed
by law.

13. By reason of the failure of Defendant to pay to

5. On May 17, 1996 Plaintiff timely filed objections
to the aforesaid Sheriff's property claim determinations.
6. On May B, 1996, Plaintiff served upon property
claimant Donna L. Robinson and upon property claimant George
F. Sullenberger, Jr. Request For Admissions. True and
correct copies of Plaintiff's Request for Admissions directed
to Donna L. Robinson and to George F. Sullenberger, Jr. are
marked Exhibits "A" and "D" respectively, attached hereto and
incorporated by reference herein.
7. Pursuant to Pa.R.C.P. 4014(b), both property
claimants Donna L. Robinson and George F. Sullenberger, Jr.
were required to file answers or objections to the aforesaid
Request For Admissions within thirty days after service/ which
was made on May B, 1996. True and correct copies of the
affidavits of service are marked Exhibit "c" in the
composite, attached hereto and incorporated by reference
herein.
B. Both Donna L. Robinson and George F. sullenberger/
Jr. have failed to file answers or objections within 30 d.~.

9. On the basis of the parties' pleading./
and aforesaid Request For Admissions, the
matters are nol disputed:

A. Donna L. Robinson and George F. sullenberger,
Jr. are the property claimants in the above matter.
B. The property claimed by Donna L. Robinson
is that of the defendant.
C. The property claimed by George F. sullenberger,
Jr. is that of the defendant.
D. The property claimed was acquired with funds
provided by defendant.
E. Donna L. Robinson and George F. Sullenberger,
Jr. have no documentation verifying their respective claims
of ownership filed with the Sheriff.
10. Based upon the aforesaid undisputed facts, the
defendant, George F. sullenberger, Sr. is the owner of the
claimed property and the property claims of Donna L.
Robinson and of George F. sullenberger, Jr. should not be
sustained.
11. In support of this Motion, Plaintiff has
attached the Request for Admissions directed to Donna L.
Robinson and the Requests for Admissions directed to George
F. sullenberger, Jr.
12. Since there is no genuine issue as to any
material fact, Plaintiff is entitled to summary judgment in
his favor as a mstter of law and, further, Plaintiff is
entitled to be awarded a reasonable counsel fee as part of
the costs pursuant to PA.R.Civ.P. 3123.
WHEREFORE, Plaintiff respectfully moves the court for a
summary judgment in his favor on the ground that there is no

genuine issue as to any material fact and that Plaintiff is
entitled to judgment as a matter of law, including the award
of a reasonable counsel fee aa part of the costs.
In the alternatlve, if Plaintiff's motion for summary
judgment is denied, Plaintiff moves the Court for an order
directing that the Sheriff's Interpleader Action be set for
immediate trial by the Court, at a time and place to be fixed
by the Court.
