and between RUSSELL C. GOODLING, of 2920 Dickinson Avenue, camp
Hill, penn.ylvania, hereinafter referred to as Contractor, aMD
RUSSELL C. GOODLING, of 2920 Dickinson Avenue, Camp Hill,
penn.ylvania, hereinafter referred to as Owner, whereby the
former undertook and agreed to erect and construct a single
faaily re.idential dwelling on that certain lot of ground situate
in Hampden Township, Cumberland county, Pennsylvania, being Lot
No. 439, Highlands of Hampden square Phase IV, as recorded in
Plan Book 66, Page 17. Being a portion of the same premises
which Hampden square Development company by deed dated November
17, 1988 and recorded in the Cumberland county Recorder of Deed.
Office in Deed Book R, Volume 33, Page 1077, granted and conveyed
unto Highland. of Hampden Square Partnership. Also being the
ea.e pre.iee. which Highlands of Hampden square Partnership by
deed dated October .;lS, 1995 and about to be recorded herewith,
granted and conveyed unto Russell C. Goodling.

contractor, for and in consideration of the Bum of One ($1.00)
Dollar to him in hand paid by owner, the receipt whereof is
hereby acknowledged, and the further consideration mentioned in
the agr.ement aforesaid, for themselves and their subcontractor.,
and all parties acting through or under them, covenant and agree
that no mechanic's liens or claims shall be filed or maintained
by them or any of them against the said buildings and the lot of
