Plaintiff, LEADER FEDERAL BANK FOR SAVINGS, f/k/a Leader Federal Savings & Loan Association, is a corporation, with an office at P. O. Box 18600 Memphis, TN 38101-1860. 2. Defendants, JAMES W. SAUVE, JR. and JUDITH A. SAUVE 0 are adult individuals whose last known address is 282 St. John's Drive, Camp Hill, Pennsylvania 17011. 3. On or about September 4, 1980, the said Defendants executed and delivered a Mortgage Note in the .sum of $930000.000 payable to VNB MORTGAGE CORPORATION, which Note is attached hereto and marked Exhibit "A". 4. Contemporaneously with and at the time of the execution of the aforesaid Mortgage Note, in order to secure payment of the same, Defendants made, executed and delivered to original Mortgagee, a certain real estate Mortgage which is recorded in the Recorder of Deeds Office of the within County and Commonwealth in Mortgage Book 683, Pg. 126 conveying to original Mortgagee the subject premises. Said mortgage is incorporated herein by reference. The mortgage was subsequently assigned to LEADER FEDERAL BANK FOR SAVINGS F/K/A LEADER FEDBRAL SAVINGS AND LOAN ASSOCIATION, as recorded in the within County in Volume 316, pg. 715 on April 21, 1986. The Mortgage and Assignments are incorporated herein by reference. 5. The land subject to the Mortgage is: 282 St. John's Drive, Camp Hill, Pennsylvania 17011, and is more particularly described in Exhibit "B" attached hereto. 6. The said Defendants are the real owners of the land subject to the Mortgage. 7. The Mortgage is in default due to the fact that Mortgagors have failed to pay the installment due on March 10 1995, and all subsequent installments thereon 0 and the following amounts are due on the Mortgage: $80,927.07 (a) Unpaid principal balance (b) Interest at $26.98 per day from 2/1/95 to 10/30/95 (based on contract rate of 12') (c) Accrued/Accumulated Late Charges and Late Charges at $46.95 per month 7,338.56 375.60 *Together with interest at the per diem rate noted in (b) above after October 30, 19950 and other charges and costs to date of Sheriff's Sale. The attorneyOs fees set forth above are in conformity with the Mortgage documents and Pennsylvania lawo and will be collected in the event of a third party purchaser at Sheriff's Sale. If the Mortgage is reinstated prior to the saleo reasonable attotneyOs fees will be charged that are actually incurred by plaintiff. 8. Notice of intention to foreclosure and accelerate the loan , , ~ balance pursuant to pennsylvania Act No. 6 of 1974 is not required in that the original principal balance exceeds $50,000.00. 10. Defendants are not members of the Armed Forces of the united t States of America, nor engaged in any way which would bring them within the Soldiers and Sailors Relief Act of 1940, as amended. 11. plaintiff has complied with the procedures required by Pennsylvania Act 91 of 1983 (HomeoWners' Emergency Mortgage Assistance Payments Program) and Defendants have either failed to meet the time limitations as set forth therein or have been determined by the Housing Finance Agency not to qualify for assistance. WHEREFORE, plaintiff demands judgment in mortgage foreclosure against Defendants for the aforementioned total amount due together with interest at the rate of 12\ ($26.98 per diem) 0 together with other charges and costs including escrow advances incidental thereto to the date of Sheriff'S Sale and for foreclosure and sale of the property within described. Plaintiffo LEADER FEDERAL BANK FOR SAVINGS, f/k/a Leader Federal Savings & Loan Association, is a corporationo with an office at P. O. Box 1860, Memphis, TN 38101-1860. 2. Defendants, JAMES W. SAUVE, JR. and JUDITH A. SAUVE, are adult individuals whose last known address is 282 St. John's Drive, Camp Hill, Pennsylvania 17011. 3. Defendant, United States of America, is a nation located on the continent of North America. 4. The United States of America is hereby joined as a party in accordance with the provisions of the Act of Congress of the United States of June 250 1948, c. 646, 62 Stat. 972, as amended, 28 USCA Section 2410, and for the reason that the United States of America may allege to have an interest in the premises subject to the mortgage herein on account of said tax lien. The United States of America is being joined herein for the purposes of having any liens discharged which it may have pursuant to PUB. L. 89-719, Title I. Section 109, November 2d. 1966, 80 Stat. 11410 as amended, 26 USCA Section 7425. 5. On September 8, 1993, the United States of America filed a tax lien against the Defendants, James W. Sauve, Jr. and Judith A. Sauve, in the amount of $300333.02 for income taxes due by the aforesaid Defendants for the period ending 12/31/87 and 12/31/88. Said li&ns are further identified as Serial No. 239313979, Identification No. 206-32-0585. Said liens are indexed to Judgment Docket No. 6910. A copy of the Tax Lien bein~ attached hereto and made a part hereof as Exhibit "A". 6. On June 15, 1995, the United States of America filed a tax lien against the Defendants James W. Sauve, Jr. and Judith A. Sauve in the amount of $21,661.89 for income taxes due by the aforesaid Defendants for the period ending 12/31/90. Said liens are indexed to Judgment Docket No. 95-3227. The liens are further identified as Serial Number 239506679, Identification No. 206-32-0585. A copy of the Tax Lien being attached hereto and made a part hereof as Exhibit "B". 7. The Mortgage was subsequently assigned to LEADER FEDERAL SAVINGS AND LOAN ASSOCIATION, (NOW KNOWN AS) LEADER FEDERAL BANK FOR SAVINGS as recorded in the within County in Volume 316, pg. 715 on April 21, 1986. The Mortgage and Assignments are incorporated herein by reference. 9. The land subject to the Mortgage is: 282 St. John's Driveo Hampden Township, Camp Hillo Pennsylvania 17011, and is more particularly described in Exhibit "0" attached hereto. 10. The said Defendants are the real owners of the land subject to the Mortgage. 11.
