1. plaintiff is LINDA D. JANICSKO, who currently resides at
87 Cherokee Ave. Dover, County of York, pennsylvania.
2, Defendant is JOHN L. GILBBRT, JR. who currently resides
at 5010 Pheasant Hollow Rd., Mechanicsburg, County of CUmberland,
Pennsylvania.
3. Plaintiff seeks to have custody of JOHN LBON GILBBRT
III. born June 14, 1980; and BRIAN SCOTT GILBBRT, born July 28,
1982.
The children were not born out of wedlock.
The children are presently in the custody of the Defendant,
JOHN L. GILBBRT, JR.
During the past five years, the children have resided with
the following persons and at the following address (es) : From
August, 1989 until the present with Defendant and Defendant'.

Mechanicsburg, Pennsylvania.
The mother of the children is LINDA D. JANICSKO, who
currently resides at 87 Cherokee Ave., Dover, Pennsylvania.
She is married.
The father of the children is JOHN L. GILBBRT, JR., wbo
currently resides at 5010 Pheasant HollOW Rd.,Mechanicsburg,
Pennsylvania. He is married.

4. The relationship of the plaintiff to the children is
that of mother. The plaintiff currently resides with her
husband William Janicsko and daughter Jennifer.
5. The relationship of the Defendant to the children is
that of father. The Defendant currently resides with the
children and with his wife, Robin Gilbert and daughter Danielle.
6. The Plaintiff has participated as a party or witness or
in another capacity, in other litigation concerning the custody
of the children in this or another court. The court, term and
number, and its relationship to the action is: 2040 CIVIL 1993.
The plaintiff has no information of a custody proceeding
concerning the children pending in a court of this Commonwealth.
The Plaintiff does not know of a person not a party to the
proceedings who has physical custody of the children or claims to
have custody or visitation rights with respect to the children.
7. The best interest and permanent welfare of the children
will be served by confirming in Plaintiff custody of the children
because Plaintiff is the natural mother and can better
care for the children and provide a suitable environment for the
children.
8. Bach parent whose parental rights to the children have
not been terminated and the person who has physical custody of
the children have been named as parties to this action.
WHBRBFORB, Plaintiff requests the court to grant to
plaintiff custody of the children.

1915.3-8, the undersigned Custody Conciliator submits the following report:
1. The pertinent information pertaining to the Children who are the
subjects of this litigation is as follows:

2. A Conciliation Conference was held on November 22, 1995, with the
following individuals in attendance: The Father, John L. Gilbert, Jr., with
his counsel, Francis M. Socha, Esquire, and the Mother, Linda G. Janicsko,
who was not represented by counsel at the Conference.
3. This Court entered a prior Order in this matter on August 5, 1993
based on the parties' agreement as to custody arrangements at a Conciliation
Conference. The Order provides for shared legal custody and primary
physical custody in the Father, subject to the Mother's partial custody
rights.
4. The Mother's position on custody is as follows: The Mother filed
this Petition for primary physical custody of the Children. She stated
that, at the time of the previous Order, she was unrepresented by counsel
and was advised by the Conciliator that she should allow the Children to
have some time to become familiar with her new husband. She stated that the
Children have now developed a relationship with her current husband. The
Mother misses the Children and believes it is in their best interest to
reside with her. The Mother acknowledged that in 1986 she was convicted of
having sexual contact with a minor but that her probationary period has
either already terminated or will soon be terminated and she would like a
second chance. The Mother further stated that she has discussed the custody
situation with the boys and they have expressed a desire to live with her.
In addition, the Mother advised the Conciliator that the Father was arrested
in September 1995 for multiplA counts of burglary and criminal trespass, and
after the trial in the beginning of 1996, will probably be serving a prison
sentence. The Mother stated that she lives in a two bedroom mobile home
with her husband and one year old daughter. Her residence is currently in
Dover but ~he mobile home is listed for sale and it is her intention to move
back to the Cumberland Valley School District where the Children are
