\. Plaintiff John Gross & Company, Inc., is a Pennsylvania corporation with it.
principal place of business at 308 Cheryl Avenue, Mechanicsburg, Pennsylvania 17055.
2. Defendant Cristian Florea is an adult individual residing at 13 Randolph coun,
Hanover, PeMsy1vania 1733 \.
3. Defendant Nick Marikas is an adult individual located at 1117 Eichelberger Street,
Hanover, PeMsylvania 1733 \.
4. Defendant Cristian's is a PeMsylvania corporation with its principal place of
business at 1117 Eichelberger Street, Hanover, PeMsylvania 17331.
5. Defendant Marikas, Inc. is a Pennsylvania corporation with itl principal place of
business at 1117 Eichelberger Street, Hanover, PeMsylvania 17331.
6. At all relevant time periods the Defendants Cristian Florea and Nick Marika
operated a pannership which did business under the name of Christian's, a reltaurant located in
Hanover, PeMsy1vania,
7. The Plaintiff operates a food service distribution buslnell from itl location in
Mechanicsburg, Cumberland County, Pennsylvania.
8. On or about March 2, 1992, the Defendants completed an application for creelit and
billing and is hereby attached as Exhibit U A,"
9. Some time in Mayor June 1995, the Defendants began to fail to pay for food service
products which were sent and for which the Defendants were properly invoiced. A copy of the
