NO. 95-6239 CIVIL ACTION - LAW Plaintiffs v. THOMAS P. WILGUS Defendant PLAINTIFFS' TRIAL RRIEF I. STATEMENT OF FACTS A. Liabili\y On September 22,1994, at approximately 5:45 p.m.,PIRintiff, David McNeal, wu driving home from school on Route 114 in Mechanicsburg, PA, when the Defendant, Thomu Wilgus, suddenly pulled out from a side street and struck Mr. McNeal's vehicle. The Impact threw Plaintiff forward, and, despite being seat belted. he struck the steering wheel before being jerked backwardl into his seat. He developed immediate lower back pain with leg radiation. Witnesses, Eric O'Doyle, John Williams and Henrietta March confirmed that Defendant simply pulled out In front of Plalnliff, who had no opportunity to avoid the collillon. Even the Defendant's father, David Wilgus, who was In a vehicle directly behind his son al the time of the accident, told police that his son pulled out directly in the path of Plaintiffs vehicle. As a result, Defendanl has admitted liability. ~ ". B. Dam~iel David McNeal was extricated from his vehicle by a fire rescue squad and attended to by EMS personnel. Plaintiff was then transported by ambulance 10 Holy Spirit Hospital, where he was discharged to bed resl until he could see Dr. Jay Cho, who had previously treated him for earlier, work related back injuries. Dr. Cho admllted Plaintiff to Scidle Memorial Hospital between September 26, 1994 and October 20, 1994, for intensive physical therapy , medication treatment and epidural steroid Injections. Dr. Cho diagnosed acute cervical and lumbar pain. Upon discharge from the hospital, Mr. McNeal entered an outpatient physical therapy program at Trlndle Rehab. Initially, he underwent daily physical therapy and medication treatment for two weeks, and Ihen three visits per week for approximately three weeks, and then follow up vllits with Dr. Coo until lite April, 1995. By way of hislOry, Mr. McNealluffered a ruptured disc in his low back in March, 1988, while working at ApplelOn Papers. He underwent severallurgeries over the next couple years, but had improved 10 the point where he had entered a training program at the Dauphin County Vocational Technical School to become a building inspector. He had only been enrolled in the school for a few weeks when the subject automobile accident occurred. Mr. McNeal incurred $26,614.07 in medical billl for treatment of his injuries, which exhausted his automobile insurance coverage.
