STIPULATION AGAINST LIINS

THIS AGREEMENT made the /~ day of ~..!9-!' , 1995,
by and between JOSHUA B. SIGKAN and J. ILAINB SIGKAN, t/4/b/a
SIGKAN'S MOBILI HOHl SALIS, with principal place of business at
50 Bonnybrook Road, carlisle, Cumberland County, Pennsylvania
17013, hereinafter referred to as "CONTRACTOR", and RICHARD ....
SBBASTIAN and DIANE M. SBBASTIAN, husband and wife, of South
Middleton Township, Cumberland county, Pennsylvania, hereinafter
referred to as "OWNER", whereby the former undertook and agreed
to erect and construct a residence on that certain tract of
ground situate in South Middleton Township, Cumberland County,
Pennsylvania, being known as Lot 37, on the Subdivision Plan for
Cobblestone Estates, Sheet No.2, as recorded in the Office of
the Recorder of Deeds in and for Cumberland County in Plan Book
7U, Page 130A.
NOW, THEREFORE, THIS AGREEMENT WITNESSETH: That the said
CONTRACTOR, for and in consideration of the sum of One ($1.00)
Dollar to it in hand paid by OWNER, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the
agreement aforesaid, for themselves and their subcontractors, and
all parties acting through or under them, covenant and agree that
no mechanic's liens or claims shall be filed or maintained by
them or any of them against the said buildings and the lot of
ground appurtenant thereto for or on account of any work done or
materials furnished by them or any of them under said contract or
otherwise, for, towards, in, or about the erection and
construction of the said buildings on the lot above described,
and the said CONTRACTOR, tor itselt, its subcontractors and
others under it hereby expressly waives and relinquishes the
riqht to have, tile, and maintain any mechanic's liens or claims
aqainst the said buildinqs or any ot them, and aqree that this
instrument, waivinq the riqht ot lien, shall be an independent
covenant.
