6. On or about November 18, 1994, Plaintiff entered into
possession of the premises pursuant to the lease, expended the sum
of One Thousand six Hundred Dollars ($1,615.00) for supplios to
commence renovation of the space to accommodate her living and duly
paid to Defendant the rent called for by the lease as it became due
until her use of same became untenable.
7. While in possession of the premises, Plaintiff found same
to be in a defective condition, being unsanitary, unsafe, and unfit
for occupancy either as a retail establishment or apartment as
contracted for at the time of the lease. These conditions included:
a. The feeder valve on the furnace would not function
properly causing the heat to fluctuate from below 68 degrees
to 90 degrees, resulting in extreme conditions causing
Plaintiff's illness. Additionally, a defective feeder valve
resulted in water leaks out of the registers of the furnace,
raising the possibility of explosion due to dry starts or by
putting water into a dry hot furnace.
b. ^ defective fluorescent light ballast containing
Polychlorinated Biphenyl (PCB) was found on the premises.
Said fixture was ,"emoved, however, in the process dripped
black material on the carpet, which material was high in PCB's

19. As a result of same, Plaintiff has incurred damages in I
the amount of $4,683.05 as follows:
a. Loss of monies expended to purchase supplies to
renovate the property for her use through January 18, 1997 in
the amount of $1,615.00;

b. Removal of contaminated carpet and installation of

new carpet at the cost of $250.00;
c. Laboratory testing for Polychlorinated biphenyls
(PCB) at a cost of $160.00;
d. Cleaning of floor and cement sidewalks from PCB and
rental of Rinse-u-vac machine at a cost of $71.47; and
e. Advertising cost of $1,103.58 to support advancement
of business at the location;

before the premises were able to accommodate her living. Said renova-
tions were to be left by plaintiff upon her vacation of the premises
but instead were removed or maliciously destroyed.
7. Denied. It is denied that the premises were in a defective
condition, unsanitary, unsafe or otherwise. By way of further answer,
it was contemplated by the parties that substantial renovations were
going to be made to the premises as provided on page 1 of the addendum
of the lease and that said renovations were to be made by Lessee at
Lessee's expense.
a. Denied. It is denied that the heater valve on the
furnace would not function properly or that water leaked from the
registers or that the possibility of an explosion existed and proof
thereof, if relevant, is demanded at time of trial. By way of further
answer, the furnace was maintained on a regular basis by an indepen-
dent service company.
b. Denied. After reasonable investigation, defendant is
without knowledge to either admit or deny the averments of paragraph
7.b. and proof thereof, if relevant, is demanded at time of trial.
c. Denied. After reasonable investigation, defendant is
without knowledge to either admit or deny the averments of paragraph
7.c, and proof thereof, if relevant, is demanded at time of trial. By
way of further answer, if indeed a fluorescent light ballast overheat-
ed, this was certainly no cause for the fire department to be dis-
patched.

d. Denied. It is denied that plaintiff was to have access
to the basement. It is admitted that the door was barricaded. By way
of further answer, plaintiff or others had forced open the ~aid door
and vandalized the premises.
e. Denied. It is denied that the hot water heater unit
leaked oil. By way of further answer, the hot water heater was
maintained under a service contract with an independent service
company. By way of further answer, any alleged leakage from the hot
water heater should have been of no concern to the plaintiff nor did
plaintiff have permission nor any reason to be in the basement of the
premises.
f. Denied. It is denied that any parking places were
originally assigned to the plaintiff. It is further denied that any
parking places were taken from the plaintiff. By way of further
answer, plaintiff's automobile remained on the premises for at least
six weeks after the time she vacated the premises.
g. Denied. It is denied that the roof leaked. By way of
further answer, plaintiff's premises were on the first floor of a
three unit building.
8. Admitted and denied. It is admitted that plaintiff notified
defendant periodically throughout the term of the lease of occasional
problems on the premises. It is denied that plaintiff received no
response. To the contrary, defendant endeavored to keep those items
in the premises which were his responsibility in good working order.

Defendant's efforts were often frustrated because access to the
premises by defendant was continually denied by plaintiff.
9. Denied. It is denied that plaintiff lacked heat. It is
denied that there existed a worn fluorescent light fixture which might
contain PCB's. It is denied that there was ever any dangerous condi-
tion of the furnace.
10. Denied. It is denied that there are any defective condi-
tions of the leased premises which breached any implied warranty of
habitability.
11. Denied. It is denied that plaintiff has sought and received
intercession by municipal authorities.
12. Denied. It is denied that plaintiff withheld rental pay-
ments to compel any corrective actions. By way of further answer,
plaintiff simply stopped paying rent and defendant believes and
therefore avers that there is no escrow account established as would
be required under the law.
13. Denied. It is denied that defendant verbally harassed or
threatened the life and well being of the plaintiff. By way of
further answer, plaintiff assaulted defendant and his brother/plumber
with a loaded firearm and is currently subject to criminal proceedings
as a result thereof.
14. Denied. It is denied that defendant failed to correct
defective conditions or that plaintiff has been denied the use of the
premises or has suffered loss of business, damage to personal property
or causing her to relocate at additional costs incident thereto.

COUNT I
BRBACH OF CONTRACT
15. The answers to paragraphs 1 through 14 are incorporated
herein by reference as if set forth at length.
16. Denied. It is denied that pursuant to the lease agreement
defendant was to provide plaintiff adequate heat. By way of further
answer, under page 1 of the lease addendum, plaintiff was given a
mechanism through the lease to supplement the heat if the temperature
dropped below 68 degrees in the front room.
17. Denied. It is denied that the premises were to be main-
tained by the defendant in a good and safe condition. By way of
further answer, it was agreed by the parties that substantial improve-
ments to the wiring and plumbing and other equipment were to be made
by the plaintiff at plaintiff's expense and to be left on the premises
after the vacation of the premises by the plaintiff.
18. Denied. It is denied that defendant violated any of his
duties and defendant's answer to paragraph 6 are incorporated herein
by reference.
19. a. through i. Denied. After reasonable investigation,
defendant is without knowledge to either admit or deny the averments
of paragraph 19 and proof thereof, if relevant, is demanded at time of
trial. By way of further answer, the carpet alleged to be contaminat-
ed and replaced in paragraph 19.b. was landlord's carpet and not
tenant' s. Furthermore, with respect to paragraphs 19. e. and f.,

plaintiff's business was rarely open for business which alone account-
ed for any income reduction or loss of business.
20. Denied. After reasonable investigation, defendant is
without knowledge to either admit or deny the averments of paragraph
20 and proof thereof, if relevant, is demanded at time of trial.

NUISANCE

22. Denied. It is denied that defendant failed to maintain the
property in good repair, that defendant created a nuisance condition.
23. Denied. It is denied that defendant unreasonably interfered
with plaintiff's use and enjoyment of the business or apartment.

INTBNTIONAL INFLICTION OF EMOTIONAL DISTRESS

fear of imminent bodily injury. By way of further answer, plaintiff
assaulted defendant and defendant's brother with a loaded gun requir-
ing police intervention. Plaintiff is being criminally charged for
the same.

2. Plaintiff, Eva Ordo, is an adult individual previously
r.esiding at 312 Hummel Avenue, Lemoyne, Cumberland County, Pennsylva-
nia. Her present address, although in Cumberland County, is unknown
to the defendant.
3. Pursuant to a lease agreement attached hereto as Exhibit "A"
and made a part hereof by reference, defendant leased to plaintiff
the premises at 312 Hummel Avenue, Lemoyne, Cumberland County, Penn-
sylvania.
COUNT I
Breach of Contract
4. Despite demand for the same, plaintiff failed to make pay-
ments as required under the lease from and after May 18, 1995, through
March 18, 1996, in the amount of $461.00 per month for a total of
$4,610.00.
7. Inasmuch as plaintiff has vacated the premises, plaintiff has
breached the lease agreement and has failed to pay rent for the

remainder of the term from March 18, 1996, through January 18, 1997,
for a total of $4,610.00.
8. Upon vacation of the premises, plaintiff left the premises in
a severely damaged state.
9. Defendant believes and therefore avers that the cost to
repair the damage to the premises caused by the plaintiff is
$10,000,00.
WHIRBFORB, defendant demands judgment against plaintiff for
$19,220.00 together with costs of suit.
COUNT II
Intentional Infliction of Emotional Distress
10. The averments of paragraphs 1 through 9 above are incorpo-
rated herein by reference as if set forth at length.
11. On or about November 26, 1995, while defendant was working
with a plumber in the basement of the premises, plaintiff assaulted
defendant and the plumber with a loaded shotgun.
12. As a direct and proximate result of plaintiff's actions,
defendant has suffered severe emotional distress causing substantial
monetary loss related to the same.
WHIRBrORB, defendant claims damages from the plaintiff in the
amount in excess of $10,000.00 plus interest and costs.
COUNT III
Assault
13. The averments of paragraphs 1 through 12 above are incorpo-
rated herein by reference as if set forth at length.

Qualitx legal service requires skill and time. My skill and .time
is my .took in trade" -- and generally my fees are based on skill
and time expended.
It is always proper for you, my client, to discuss fee
arrangements, progress in the matter or details of a particular
bill, It will help you and I if you would read this explanation
and discuss any questions you may have.

TYPES OF FEES
CONSULTATION: For an initial consultation, charges primarily will
be based on the time I spend with you, If my consultation reveals
that I need to study the law or facts of your case further before
I decide to take it, I will discuss this further step, and the fee,
if any, with you.
STANDARD FEES: I will quote a fixed fee for some standardized
services such as the drafting of routine deeds and wills.
CONTINGENT FEES: In some situations involving lawsuits for
recovery of a sum of money [personal injury suits, for example] I
will receive a fixed percentage of the total recovery as
compensation for handling the case. However, all expenses must be
paid by you and kept current on a monthly basis.
VARIABLE OR HOURLY FEES: In most matters I will charge an hourly
rate of $100.00. I shall be pleased, however, to furnish you with
an idea of the approximate time r will spend on the matter.
However, this figure can only be a rough estimate.
RlTAINERS: This office requests a $500,00 retainer fee. The
fee is generally a deposJt for costs and expenses which I expect to
incur when I agree to proceed with your matter. The retain.~ i.

CHARGING: My office will keep accurate records of the time expended
and services performed on your matter. When I send you my bill, I
