HUSBAND hereby transfere to WIFE all his right, title and Interest In eald property which shall be the sole and separate property of WIFE. HUSBAND shall retain the utility trailer, his guns and gun 88fe, the shares of the hunting camp, his savinge at Cornerstone Credit Union, his IRA, HUSBAND'S premarital savings bonds, the Sprint Retirement Pension Plan, and the Sprint Savers Plus Plan. WIFE hereby transfers to HUSBAND all her right, title and Interest In said property which shall be the sole and separate property of HUSBAND. Attached to this Agreement as Exhibit "A" Is a list of household goods which shall be the sole and eeparate property of HUSBAND. The marital assets listed In Exhibit "S' are all of the marital aseets of which either parties hereto have knowledge, 4, Rill Property: The parties are owners of a home at 12 East Hunter Road, Carlisle, Cumberland County, Pennsylvania, The parties In agreement that the value of the marital home is $120,000.00, and that the first mortgage thereon, as of November, 1995, approximately $35,706.12, Within forty-five (45) days of the date of thle Agreement, WIFE will refinance the marital home to relieve HUBBAND of any further obligation thereon. On the date of the refinance, HUBBAND will transfer to WIFE all his right, title and Interest in the marital home. Commencing the date of the refinance, HUBBAND will no longer be responsible for paying the mortgage, and payment of the mortgage ehall be the sole and exclusive obllgetlon of WIFE. That obligation, however, wlll coincide with payment to WIFE of alimony and child support ae set out below. WIFE 4 .:'......\101110_..... Both parties will give effect to this promise by revising their Wills accordingly. 8. Child and Educational Support: HUSIAND will pay to WIFE lor the support of Jessica $468.00 per month. Said payments shall continue until Jessica graduates from high school, or turns 18 years 01 age, whichever comes later. In any case, said payments will cease the first month Jessica Is enrolled In post-secondary education, At that time, so long 88 Jessica Is enrolled In a college In a progrsm leading toward a Bachelor's Degree, HUSIAND will pay $4,800.00 per year lor Jessica's education. Said payments may be applied to tuition, room and board, and will be paid by HUSBAND directly to the college or university which Jessica attends. Said obligation by HUSBAND shall continue so long as he Is employed and his salary Is not substantially reduced, In addition to the paymsnts set out by HUBBAND, Jessica shall have for her education those amounts deposited in the Uniform Gift to Minors' Act account with Smith Barney, valued, as 01 September 30, 1995, at $13,853,60. In ths event that It would be advantageous for WIFE to claim Jssslca as a dependant, so that Jssslca would qualify for financial aid for her post. secondary education, HUSBAND will give favorabls consideration to the transfer of the dependent status to WIFE. 9. Tax and Retainer Refund.. The parties will file Joint federal state and local income tax for 1995, and will equally divide any refund which they might recelvs from the federal government. In the event that any federal, state or local Incoms tax Is due, HUSBAND will pay It. Additionally, In ths event of a refund of any attornsys' retainer fees, the parties will spilt said refund equally. 10, Modlllcatlon: No modification, rescission, or amendment of this agreement shall be effective unlsss In writing signed by each of the parties hereto, 11.
