AND NOW comes Plaintiff by and through its attorney,
ARTHUR A. KUSIC, ESQUIRE, and respectfully represents the
following:
1. Plaintiff, THE BON-TON, INC, , is a corporation
organized and existing under the laws of the Commonwealth of
Pennsylvania with offices at 2081 springwood Road, York, York
county, Pennsylvania.
2. Defendant, KATHRYN J. HECKERT is an adult individual
residing at 230 Old Ford Road, Lemoyne, Cumberland county,
Pennsylvania.
3. Defendants entered into a Retail Installment Credit
Agreement with Plaintiff. Said account is known and numbered as
1050205814.
4. The application for the retail installment account
was taken by telephone solicitation.
The terms of the credit
agreement were mailed to the Defendants and became accepted and
agreed to by their use of the account. As evidence whereof, a copy
of the Plaintiff's affidavit is attached heretc, made a part hereof
and marked Exhibit "A".
5. From time to time, Plaintiff at Defendants' specific
request extended credit to Defendants,
6. Defendants purchased and received goods and
merchandise from Plaintiff thereby utilizing the credit account
established in their behalf. As evidence whereof, copies of
billing statements sent to Defendants by Plaintiff are attached
hereto, made a part hereof and marked Exhibit "B".
7. The prices charged for said merchandise were fair
and reasonable and were agreed to by the Defendants.
8. Any and all monies received have been credited to the
Defendants' account.
9. Demand has been made upon Defendants for the amount
due, but all demands remain unheeded.
10. As a result of the Defendants' failure to make
satisfactory payments on their credit account and, under and
pursuant to the Credit Agreement, are now indebted to Plaintiff in
the amount of $816.87 along with interest at the rate of 18% per
annum. As evidence whereof, a copy of the terms of the credit
agreement is attached hereto, made a part hereof and marked as
Exhibit "C".
11. Pursuant to paragraph #6 of the Credit Agreement,
Defendants are also responsible for reasonable attorney's fees not
to exceed 20% and the costs of this proceeding. Accordingly,
Defendants are responsible for attorney's fees in the amount of
$163.37.
12. The purpose of this communication is to collect
a debt. Any and all information obtained will be used for that
purpose.
13. Plaintiff avers that the amount due and owing does
not exceed the jurisdictional amount requiring arbitration referral
by local rule.
WHEREFORE, Plaintiff prays your Honorable Court to enter
Judgment in its favor and against Defendants in the amount of
$816.87 along with interest at the rate of 18% per annum, plus
attorney's fees in the amount of $163.37 and the costs of this
proceeding.
