MECHANICS LIEN WAIVER
WHEREAS, John E. Kyner, III and Tracie R. Kyner, his wife, of 11069 Morgan Drive,
Shlppensburg, Pennlylvanla, are the Owners of real eltate situate In Southampton Township,
Cumberland County, Pennsylvania having a known address of 3D Mountain Drive, Shlppensburg,
Pennlylvanla 17267, and being the same real estate which H. T. Properties, a partnership, by Itl deed
dated June 28, 1993 and recorded In the Recorder's Office of Cumberland County, Pennsylvania, In
Deed Book Volume J36, Page 883, conveyed to John E. Kyner, III and Tracie R. Kyner. the aforesaid
Owners; and,
WHEREAS, Owners Intend to construct a residence on the aforesaid real estate more
particularly described In said Deed Book Volume J36, at Page 683 (Which description Is Incorporated
herein); and,
WHEREAS, Cart Dunlap. 10707 Shale Road, Shlppensburg, Pennsylvania 17267, hereinafter
referred to al Contractor, has entered Into a contract with said Ownen for the construction of the laid
relldence upon laid real estate;
NOW THEREFORE, It Is hereby stipulated and agreed by and between the said Contractor and
Owner., all parties Intending to be legally bound, that neither the underllgned Contractor nor any sub.
contl1lCtor or material man, nor any other person fumlshlng labor or materials to the Contl1lCtor under
the contl1lCt entered Into between said Contractor and Ownen (or any sub-contract between othen and
Contl1lCtor) shall file a lien, commonly celled a mechanics' lien, for work done or materlall fumllhed to
the laid real eltate upon which the contract between the Contractor and Ownen Is to be perfonned, or
any part thereof.
Thll written Inltrument Is made and Intanded to be filed with the Prothonotary of Cumberland
County. Pennlylvanla, prior to commencement of the work upon the said ground and In accordance
with the requirements of the Act of Allembly of Pennsylvania. In such case provided. and, therefore,
bar the filing of any lien upon the said property for work perfonned upon the said construction projects
or any materials supplied therefore.
