WHEREAS, F. STEPHEN VanVOORHEES and ELIZABETH K. VanVOORHEES
of 2520 Lake Meade Road, East Berlin, PA 17316 (the "owner"),
owners of the tract of land hereinafter described, have executed or
are about to execute contemporaneously horewith a contract with
LOBAR ASSOCIATES, INC., with a prinoipal place of business at 4
Barlo circle, Dillsburg, PA 17019 (the "Contraotor"), for site
improvements on, and other improvements to, tracts of land known as
101 South Third street, Borough of Lemoyne, Cumberland County,
Pennsylvania, upon property more particularly desoribed on Exhibit
"A" attaohed hereto, incorporated herein by reference and made a
part hereof (the "Premises").
NOW, November 10 , 1995, before any authority has been
given by the said Owner to the said Contractor to oommence work on
said site improvements, or to otherwise oonstruot any improvements
thereto, or to purchase materials for the same, or to enter into
any oontraots with any subcontractors or materialmen, or to
authorize any purchases by or through any subcontractors or
materialmen, in consideration of the making of said contract with
the Owner and the further consideration of One ($1.00) Dollar to
Contractor paid by said owner, Bnd with the intent of all parties

to be legally bound hereby, it is agreed that no lien ShBll be
filed against the building or Premises, or any part thereof, by the
Contractor or any subcontractor or by any of the materialmen or
workmen or any other person for Bny lBbor, or mBterials purohased,
or extra labor or materials purchBsed, for the site improvsments to
the Premises (including hereafter changes made thereto), the right
to file liens being expressly waived.
It is the full intent of the contractor, for itself and for
any subcontractors or mBterialmen clBiming for themselves, or by,
through or under the contract or the contrBctor, that the right to
file B mechanic's lien, under the provisions of law and/or of Acts
of Assembly in such CBses made Bnd provided, for work done or
materials furnished in and about the construction of the
residential dwelling Bnd improvements to the Premises above
described is hsreby wBived.
