Defendant, Jao~ A. Hoke, now appearing in court on the oharae of
Indireot: Criminal Contempt with hi. privately retained oounsel,
Artbur K. Oils, Isquire, and having tel\dered a plea of guilty to
Indireot criminal Oontempt, the Defendant's plea of guilty i~
aooepted.
Pursuant to an agreement of oounsel, in the person
of Mr. oils and William I. Gabig, Esquire, of the Distriot
Attorney's Offioe, the .entel\oe of the Court is that the
Defendant pay the oosts of proseoution, and any suroharge
roquired under the Protection from Abuse Aot and other fees
assooiated therewitb, and that he undergo a period of
unsupervised probation of six montbs, oonditioned upon his being

following is ordered to prevent abuse of. the Plaintiff and the
minor children t
1. Defendant shall refrain from abUsing the plaintiff
or the children and from placing plaintiff or the children in
fear of abusel
2. Defendant ahall refrain from having any contact
with the plaintiff, including, but not limited to entering
plaintiff'S residence, talephoning plaintiff, stalking or
harassing plaintiff or plaintiff'S relativesl
3. Temporary physical custody of the children, LVNDSAI
M. HOKE, KARLEE M. HOKE and AaBY M. HOKE, is awarded to
plaintiff 1 and
4. plaintiff shall have access to the marital home,

Defendant is hereby notified that violation of this Order
may lead to a finding of indiroct criminal contempt which is
punishable by a fine not to exoeed $1,000.00 and/or by a sentence
of up to eix (6) months in jail and other appropriate punishment.
The Sheriff's Office of the appropr.iate county shall attempt
to make service at the Plaintiff's request, but servioe may be
accomplished under any applicable RUle of civil Procedure.
The Silver spring Township Police Department and the
Pennsylvania state Poliae will be provided with a copy of this
Order by attorneys for Plaintiff.
This Order shall be enforced by any law enforcement agency
when a violation occurs by arrest for indirect criminal contempt.
The arrest may be without warrant upon probable cause that this
Order has been violated, whether or not the violation ,s
committed in the presence of the police officer. In the event
that an arrest is made under this section, the Defendant shall be
taken without unnecessary delay before the Court that issued the
Order. When the Ccurt is unavailable, the Defendant shall be
arraigned before the appropriate district justice. (23 Pa.C.S.A.

1. The Plaintiff, Miohelle L. Hoka, is an adult individual
currently residing with her parents at 140 Green Ridge Road,
carlisle (Silver spring Township), Pennsylvania.
2. The Defendant, Jack A. Hoke, is an adult individual
currently residing at 512 criswell. Drive, Boiling springs (Monroe
Township), Pennsylvania.
3. Plaintiff and Defendant are married to one another.

4. For years, the Defendant has attempted to cause and has
intentionally, knowingly or recklessly caused bodily injury to
the Plaintiff, has placed Plaintiff in reasonable fear of
imminent serious bodily injury and has knowingly engaged in a
course of conduct toward Plaintiff under circumstances Which
place Plaintiff in reasonable fear of ~odily Jnjury, including,
but not limited to the following specific inotances of abuse:
a. In or about August, 1995, Defendant came at
Plaintiff, wrapped hilS hands around her throat,
threatened to kill her and struck her across the face
"
causing bodily injury;
b. on or about October 10, 1995, Defendant
returned trom hunting and threatened plaintiff's lite
stating that he did not need a gun to kill her -- that
he would kill her with his bare hands;
c. on or about ootober 27, 1995, Detendant
threatened Plaintitf's life stating that if she thought
she was going to get a divorce he would bury her;
d. In or about April, 1994 Defendant threatened
Plaintiff's life and also threatened to kill himself;
and
e. other instances of abu~e over the years,
5. Defendant repeatedly abuses both alcohol and drugs.
6. In addition to the abusive behavior described
hereinabove, plaintiff has exhibited bizarre behavior causing
plaintiff to believe that she and the children are in danger.
7. On or about October 15, 1995, Defendant agreed to move
out of the marital home of 512 criswell Drive, Boiling Springs,
Pennsylvania.
8. On or about November 10, 1995 Defendant moved back into
the marital home ~ithout the consent of Plaintiff and against her
wishes.

9. On Novsmber 10/ 1995 Plaintiff attemptsd to leave the
marital home with the parties' three childrenl LYNDSAI H. HOKE,
(D.O.B. 12/23/891 age 5)/ KARLEE M. HOKE (D.O.B. 11/25/921 age 2)
and ABBY H. HOKE (D.O.B. 2/3/941 age 1). Defendant reacted by
crying, screaming and begging her and the children not to leave.
Defendant grabbed the youngest child, Abby, and refused to allow
Plaintiff t.o have custody of her.
10. Plaintiff,' has been a "stay-at-home" mother and has been
the primary caretaker of the ohildren.
11. The sisters, Lyndsai, Karlee and Abby have never been
apart for any appreciable length of time.
12. It is in the children'S best interests to be with their
mother and primary caretaker.
13. Defendant has failed and refused to allow Abby to
return to her mother.
14. Defendant remains in the marital home where most of the
ohildren's clothing and other items necessary for their proper
care and maintenance are located.

the children, Lyndsai M. Hoke, Karlee M. Hoke end Abby M. Hoke
(hereinafter referred to as the "children") exoept for the
supervised temporary physioal, custody as set forth in paragraph 7
hereinbelow or as ordered by this court in a custody action;
6. Temporary physioa\ custody of the children is awarded
to plaintiff pending further Order of court in a custody action;
7. Pefendant sha~l enjoy temporary physical rustody of the
childr~n on Friday, November 24, 1995 from Noon until 7tOO P.M.
and on Sunday, Novemher 26, 1995 from 9:00 A.M. until 7100 P.M.
said periods of temporary physical custody with Defendant shall
be supervised by Defendant's parents;
8. All matters relating to the custody of the children
shall be addressed through the parties' attorneys; and
9. Defendant is hereby notified that violation of this
order may lead to a finding of indirect criminal contempt which

sentence of up to six (6) months in jail and other appropriate
punishment. The Silver spring Township police Department and the
