or sUb.tantiallY reduced pursuant to the terms of the
pennsylvania comparative Negligence Act, 42 Pa.C.B.A. 57102,
which is incorporated herein by reference.
20. The Plaintitfs' damages and losses as claimed were not
proximately caused in any manner whatsoever by the Detendant.
21. The Plaintitt's, Bandra Foreman's, olaims are barred or
diminished by her own contributory or comparative negligence,
which negligence was the cause of her injuries and the other
damage. claimed.
22. The Plaintitfs' cause ot action against Detendant is
barred because ot Detendant's governmental immunity under 42 Pa.
C.S.A. 58541, At. IAQ.
23. Bpecitically, Plaintitts' claims are barred by reason
ot the fact that her olaims against Detendant do not tall within
any of the exceptions to governmental immunity as set torth in 42
Pa. C.B.A. 58542.

responsive pleading is required. To the extent that a response may

Foreman wa. negligent in any manner upon the cause of action stated
in Plaintitts' complaint.
Theretore, it is denied that the
Pennsylvania Comparative Negligence Act, 42 Pa.C.B.A. 57102, is in
any way applicable to plaintiffs' claims, and that such Aot would
result in the bar or reduction or Plaintitts' damages.

that a respon.e may be deemed proper, it is specifically denied
that the doctrine ot the a$sumption ot the risk i. applicable to
Plaintiffs' claim. It is further specifically denied that
Plaintitt Sandra Foreman consciously and knowinqly as.umed the riak
of injury caused by the Defendant's neql1qent oonduct, .ince
Plaintitt Sandra Foreman was not aware ot tha danqerous condition
which exiated on the Detendant's property prior to her fall.

Foreman contemplated or understood the risk ot injury which could

con.ortium. To the extent that the Detendant eeek. to claim a
limitation in damages and to the extent that Plaintifta' claim may
exceed the statutory Umit contained in 42 Pa.C.B.A. S8553(b),
Plaintitfe claim that the limitation on damages i. unconstitutional
and theretore, inapplicable to Plaintitts' claim.
