COM P L A I N T
AND NOW comes Plaintiff by and through its attorney
ARTHUR A. KUSIC, ESQUIRE, and respectfully represents the
fOllowing I
1, Plaintiff, SUSQUEHANNA MEMORIAL GARDENS is a cemetery
assooiation with offices at R.D. #3, Chestnut Hill Road, York
County, Pennsylvania.
2. Defendant, BRYAN K. LIVINGSTON is an adult
individual residing at 2001 Red Bank Road, Lot 238, Dover,
cumberland County, Pen"sylv!lnia.
3. Defendant, TRACEY L. LIVINGSTON is an adult
individual residing at 4 Crescent court, New cumberland, Cumberland
County, Pennsylvania.
4. On or about March 17, 1994, Defendants entered into
a Seourity Agreement in order to purchase from Plaintiff one burial
spaoe with child protection, with which purchase Defendants
received one free space.
6. Defondllnt,1,l agreed to make slxty (60) suooeslllive
monthly installment payments each and every month until the debt
was paid in full, sixty (60) installmenta to be in the amount of
$39.67.
6. The insta llment payments were to be duo on tho same
day of eaoh and every suaoeoding month as per a true and correct
oopy of the Security Agreement attached hereto, made a part hereof
and marked Exhibit "A", the firot inatallment being due December
5, 1993.
7. In the event of a default of any of Buyer'S
obligations under the agreemont, Plaintiff ~hall have tho rlght at
any time at its option to declare all remaining payments due and
payable together wlth late chargee and an attorney's fee not to
exoeed 20% of the unpaid balance of principal and interest if the
acoount is referred to an attorney for collection. (See Exhibit
"A")
B. The terms and conditions set forth in the Secur i ty
Agreement were agreed to by the Dgfendants.
9. Defendants have not complied with the terms and
conditions of said Security Agreement and arE now in default
leaving a balance due of $2,399.20 plus attorney's fees in the
amount of $359.88 and interest at the rate of 12.00%.
10. Demand has been made upon Defendants for the amount
due and owing but all demands remain unheeded.
11. Plaintiff avero that the amount due and owing does
not exceed the jurisdiction&l amount requiring arbitration referral
by local rule.
