AND NOW, comes Defendant, John Bender, by and through his
attorneys, O'BRIEN, BARIC AND SCHERER, and files t.he within Answer,
New Matter and Counterclaim as followSI
1. Admitted.

3. Denied as stated. Dy way of further answer, Defendant
and his wife, Bonnie L. Bender leased an apartment from the
plaintiff known as 15 East Main Street, Newville, PA being the
first floor of said property. The lease agreement was made May 11,
1992 and continued for a period of one year subject to modification
by notice provided by the Plaintiff.
4. Admitted in part and denied in part. By way of fUI'ther
answer, Defendant responds as follows:
a. Defendant paid all rent and late charges accruing
during the term of the lease up to May, 1995. Defendant
admits that payment of $315.00 was not made for the
period September to October 3, 1995 and any 16te charges
were not paid aft.er May, 1995. Defendant had good and
valid reasons for not making said payment as more fully
set forth in New Matter and Counterclaim.

b. After reasonable investigation, Defendant is without
knowledge or information sufficient to form a belief as
to the truth or falsity of this averment and strict proof
thereof is demanded.

thereof is demanded.

without knowledge or information sufficient to form a belief as to
the truth or falsity of this averment and strict proof thereof is
demanded.
6. Denied. Defendant had the permission of Plaintiff to make
the modifications.

7. Denied that the amount set forth in Plaintiff's complaint
is due and owing or appropriate.
WHEREFORE, Defendant requests judgment in his favor and
against the plaintiff.

8. plaintiff received payment of late charges from Defendant
as set forth on Exhibit "B" to Plaintiff's complaint.
9. plaintiff was repeatedly notified that e water leak
existed at the property in the line from the publio water service
to the property yet plaintiff failed and refused to remedy the
defect causing Defendant to incur extraordinary water and sewer
bills.
10. plaintiff was repeatedly notified that the apartment unit

appropriate meuures to resolve the infestatlon making the unit
uninhabitable.
1\. Plaintiff reoeived a Beourity depoBit from the Defendant
in the amount of $350.00 oontemporaneouuly with exeoution of the
lease agreement appended to Plaintiff's complaint as Exhibit "A".
Plaintiff has failed and refulled to return tho Beourity deposit to
Defendant.
12. plaintiff has failed to provide Defendant with an
itemization of the damages allegedly cauBed to the property.
13. plaintiff informed Defendant at the outset of the tenancy
that the Defendant could make an~' modifications to the property
that the Defendant wanted to in order to make himself more
comfortabl~ in his occupancy.
14. plaintiff was aware of the partition modification made by
Defendant and approved the modification.

~UIT I
15. While Defendant was in possellsion of the proper.ty, the
property beoame infested with roaches.
16. Defendant notified Plaintiff of the infestation and
requeBted that the roaches be eradicated.
17. plaintiff undertook measures to eradicate the roaohes,

however, the aotions undertaken were not appropriate or effectiv$
in resolving the infestation.
18. The infestation continued unabated and was severe and
pervasive throughout the property.
19. The infestation made the property uninhabitable,
unsanitary and unsafe.
20. The continuing infestation was a breach of the implied
warranty of habitability extended to the Defendant by the
plaintiff.
21. As a consequence of this breach, Defendant lost several
items of personalty including, but not limited to, the followingl
a video cassette recorder, television, microwave oven, sofa bed,
five video tapes, three bags of food and an answering machine. The
VBlue of these items of personalty is estimated as $ 995.00.
WHEREFORE, Defendent, counter-plaintiff, demands judgment
against Plaintiff in the amount of $995.00 plus interest and costs
and any other relief deemed just and proper.
COUNT II
22. In or about January, 1995, wBter began to come through
the ceiling of the kitchen in the property. The water was coming
through a ceiling light fixture and caused extensive damage to the
ceiling of the kitchen.
23. Defendant requested that the Plaintiff repair the leak
and the oeiling in the kitchen.
24. Defendant informed the plaintiff that Defendant would

have the ceiling repaired and expected compensation for the repair
from the Plaintiff. Plaintiff oo>>sented to this arrangement and
the repair was made.
25. Defendant was charged $600.00 for the repair and has
received no reimbursement or set-off fr.om Plaintiff for this
expense.
WHEREFORE, Defendant, Counter-plaintiff, demands judgment
against Plaintiff for the cost of the repair plus costs and
interest and any ~ther amount deemed just and proper.
COUNT I II
26. Defendant, Counter-Plaintiff, incorporates by reference
the averments set forth in paragraphs fourteen (14) to twenty-six
(26) .
27. Plaintiff has to the date hereof failed and refused to
refund to Defendallt the security deposit paid by Defendant to
Plaintiff .
28. Plaintiff has failed to provide Defendant with an
itemized statement of alleged repairs or damages to the property.
29. The property leased to Defendant was used primarily for
family or household purposes.
30. The actions of Plaintiff, severally and cumulatively are
violative of the Unfair Trade Practices and Consumer Protection
Law, 72 P.S. Section 201-1 et seq.
