following Individuals ware present: the Plaintiff and her ettorney, Farley G. Holt,
Esquire; the Defandant appeared with her sttorney, Joan Carey, Esquire.
3. Items resolved by agreement: Tamporary schedule pending full hesrlng,
4. Issues yet to be resolved: Grandmother's visitation with the minor child,

6, The PllIlntlff'lI pOllltlon on custody Is as follows: Tho Grandmother
believes thllt since she Is the paternal grandmothllr, she should have regular end
consistent contact with the minor child.
6. The Defendant's position on custody Is as follows: The Defendent
believes that tho Grandmother Is not capable of having the child and further, and
most significantly, Is not cepable of Insuring thet the child's father will not havlt
contect with the child while the child Is In Grendmother's custody, Tha Defendant
related thet there was an attempt to heve aupervlsod visitation bofore, and that
Grandmother was unabla to In sura that the supervised visitation did not Include
contact with the Father.
7. Need for separata counsel to represent child: Neither perty requested and
the Conciliator does not believe any Is necessary.
8, Need for Independent psychological evaluation or counseling: Neither
party requested end the Conciliator does not believe this Is necessery.

10. Other metters and comments: This Is a request by the paternal
grandmother for visitation with the minor child. There Is a long history to this caso
Involving the Court of Common Plees of York County, Children end Youth of York
County and with a protection from abuse order In Cumberland County. The Fether
was accused of sexually molesting the naturel mother's oldest daughter from a

prevloue reletlonehlp. When the concllletlon oCQurred, the Fether'e crhnlnel chargee
ware etlll pending.
The Fether'e vleitatlon rights with hie son were euspended ell a result of
thue problems. Mother ettempted to work out some type of supervised contact of
the minor son through the Grondmothlir back In January-February of 1996.
Apparently the Grandmother did not follow through with the supervised visitation
and Father had direct, unsupervised vlsltetlon with his son. As e result of her
Inability to follow through with thet plen, Mother is convinced that Fsther will have
cont.ct with the son through the Grandmother.
If Grandmothar Is to granted vlsltstlon periods with her grandson, she must
give the Court assurance that the grandeon will not have contact with hie father
during these perlode.

Sheila M, Miller, of York Haven, York County, the patemal grandmother of
Joshua Rlohard Wllaon, bom December 21, 1992, seeks partial oustody of Joshua,
Joshua lives In Carlisle with his mother, Donna L. Wilson, She Is married to Joshua's
father but separated from him since September, 1994,' Joshua's father has just been
bound over to court on six sexual offenses against a teenage daughter of the mother,
who with another son, age ten, lives with her and Joshua,R The father of those two
children Is not the father of Joshua.
1. 23 Pa,C,S. Section 5312 provides that:
In all proceedings for dissolution, subsequent to the
oommencement of the proceeding a'1d continuing thereafter or when
parents have been separated for six months or more, the court may,
upon application of the parent or grandparent of a party, grant
reasonable partial custOdy or visitation rights, or both, to the unmarried
ohlld If It finds that visitation rfghts or partial custody, or both, would be
In the best Interest of the child and would not Interfere with the parent-
ohlld relationship, The court shall consider the amount of personal
contact between the parents or grandparents of the party and the child
prior to the application,
2, The offenses Include statutory rape and Involuntary deviate sexual
Intercourse by forcible compulsion.

Joshua's father now lives a short dlstanoe from the patemal grandmother, and
the evidence shows that she hasUltle ability to exert control over him, He has not
seen Joshua slnoe December, 1994, Despite the patemal grandmothe~s promise not
to allow the father to be with Joshua, we are not satisfied that she can exercise
unsupervised periods of partial custody without Intervention by the father. If that
oocurred, It would not, at this point, be In the best Interest of Joshua, The patemal
grandmother has not seen Joshua slnoe December 26, 1994, Her contaot with him
before that was not extensive. It Is not olear that Joshua even has a recollection of
her, Therefore, the following order Is entered.
