AND NOW, TO WIT, this CO;lLAINT 1.2.- day of November, 1995, COll\8S the plaintiff, York Farm Credit, ACA, by through its attorneys, the law firm of Stock and Leader, and brings this action against the Defendants, Tiaothy M. Alexander and Patricia A. Alexander, husband and wife, whereof the following is a statement: 1. The plaintiff, York Farm Credit, ACA, is a corporation organized and existing under the laws of the United States of America with a principal address of 3301 West Market Street, York, York County, Pennsylvania 17404. 2. Defendants, Timothy M. Alexander and Patricia A. Alexander, husband and wife, are adult individuals residing at 1160 Creek Road, Carlisle, Cumberland County, Pennsylvania 17013. 3. On or about March 29, 1989, the Defendants made, executed and delivered to York Farm Credit, ACA, a Mortgage Note in the sum of $140,000.00 calling for payments in monthly installments, a true and correct copy of which Note is attached hereto, made a part hereof, marked Exhibit "A" and incorporated herein by reference. 4. At the same time, on or about March 29, 1989, the Defendants made, executed and delivered to York Farm Credit, ACA, a certain Mortgage, 3 ..curing Defendants obligation under the above mentioned Note by certain r.al .state in West pennsboro Township, Cumberland County, Pennsylvania, which Mortgage wa. recorded in the Office of the Recorder of Deeds in and for Cumberland County, Pennsylvania in Mortgage Book 933, Page 1014, a copy of which Mortgage is attached hereto, marked Exhibit "B" and incorporatod herein by reference. 5. Having executed and delivered the Mortgage Note and Mortgage Defendants became liable for the payments called for therein in accordance with the terms therein. 6. Defendants are in default under the terms of the Mortgage Note and Mortgage to the Plaintiff by virtue of their failure to make the payments due under the terms of the Mortgage Note and Mortgage on a timely ba.is since March 1, 1995. 7. On August 10, 1995 Defendants were each sent the notice required by the Homeowners Emergency Mortgage Assistance Act of 1983 (Act 91) by United States Certified Mail, postage prepaid and by United States Mail, first class, postage prepaid. The notice was received by Defendant Patricia A. Alexander on August 15, 1995. Although the notice sent certified mail to Defendant Timothy M. Alexander was returned to Plaintiff ..arked "unclaimed", the notice sent first class, postage prepaid, has not, to this date, been returned to Plaintiff. A true and correct copy of the notices are attached hereto, marked Exhibit "C" and are hereby made a part of and incorporated herein by reference. 8. On OCtober 3, 1995 Defendant Timothy M. Alexander made application with the pennsylvania Housing Finance Agency for mortgage assistance in accordance with Act 91. 4 9. On OCtober 13, 1995 Defendant Timothy M. Alexander, waR denied .ortgage assistance by the pennsylvania Housing Finance Agency. A copy of .aid denial is attached hereto, marked Exhibit "0" and incorporated herein by reference. ,10. Thirty (30) days have expired from the date of receipt of the Act 91 notice by Defendant Patricia A, Alexander, and Plaintiff ha. received no response from Defendant Patricia A. Alexander or the Consumer Credit Coun~.ling Agency set forth in the notice to Defendant Patricia A. Alexander. 11. The amount due under the terms of the Mortgage and Mortgage Note ie as follow.: principal balance through October 23, 1995 Interest through October 23, 1995 Late charges through October 23, 1995 Attorney's fees $124,157.74 $9,616.70 $85.50 S6,700.00 $140,559.94 TOTAL Interest will continue to accrue on the above mentioned principal balance at the rate of $36.304 per diem and late charges will continue to accrue at the rate of $14.25 per month. The plaintiff, York Farm Credit, is the holder of a Mortgage upon a 50.001 acre tract of real estate located in West Pennsboro Township, Cumberland County, Pennsylvania, owned by the Defendants, Timothy M. Alexander and patricia A. Alexander, husband and wife. 2. The Mortgage is collateral security for a Note dated March 29, 1989 in the amount of $140,000.00 given by the Defendants to the plaintiff. 3. The terms of the Mortgage have been made a part of the Note. 4. Defendants have failed to make the monthly payments called for in the Note and Mortgage since March 1, 1995. 5. The Defendants have failed to pay the real estate taxes upon the real estate which is the security under the Mortgage for the above mentioned Note for tax years 1993 and 1994, which payments are required by Paragraph Tenth of the Mortgage. 6. On August 15, 1995 the Defendants received the Notice of HOlII8owner8 EI1Iergency Mortgage Assistance Act of 1983 <Act 91) which notice 1 .- - - was .ent to them by the Plaintiff. 7. More than thirty (30) days have passed and Defendant Patricia A. Alexander has not applied for financial assistance pursuant to Act 91. 8. Defendant Timothy M. Alexander was denied a Homeowners Emergency Mortgage Assistance Loan by letter dated October 13, 1995 from the pennaylvania Housing Finance Agency. 9. The Plaintiff, York Farm Credit, is the holder of a Mortgage upon a 50.001 acre tract of real estate located in West pennsboro Town.hip, CUlllberland County, Pennsylvania, owned by the Defendant., Timothy M. Alexander and patricia A. Alexander, husband and wife. 2. The Mortgage is collateral security for a Note dated March 29, 1989 in the amount of $140,000.00 given by the Defendants to the Plaintiff. 3. The terms of the Mortgage have been made a part of the Note. .... Defendants have failed to make the monthly payments called for in the Note and Mortgage since March 1, 1995. 5. The Defendants have failed to pay the real estate taxes upon the real e.tate which is the security under the Mortgage for the above mentioned Note for tax years 1993 and 1994, which payments are required by Paragraph Tenth of the Mortgage. 6. On August 15, 1995 the Defendants received the Notice of Homeowners Emergency Mortgage Assistance Act of 1983 (Act 91) which notice 1 .' .. waa .ant to them by the Plaintiff. 7. More than thirty (30) days have passed and Defendant Patricia A. Alexander has not applied for financial assistance pursuant to Act 91. 8. Defendant Timothy M. Alexander was denied a Homeowners Emergency Mortgage Assistance Loan by letter dated October 13, 1995 from the Pennsylvania Housing Finance Agency. 9. The amount due under the terms of the Mortgage and Note as of May 28, 1996 is as follows: TOTAL $124,157.74 17,530.97 171.00 6,700.00 $148,559.71 Unmatured principal Interest Late charges Reasonable attorney's fees 10. Defendants are in default in their obligations to the Plaintiff under the Note and Mortgage dated March 29, 1989 for their failure to make the payments called for under the Note since March 1, 1995 and their failure to pay the real estate taxes upon the property subject to the Mortgage for 1993 and 1994. 2.
