STIPULATION AGAINST LIENS

GROVER O. HEINBAUGH and ALECIA K. HOLLENBAUGH, of P.O. Box 276,
Newville, PA 17241, hereinaftor referred to as OWNERS whereby
the former undertook and agreed to erect and construct
i.provements to a dwelling house on the certain lot of ,round
situate in Lower Mifflin Township, Cumberland County,
Pennsylvania, more fully bounded and described on the attached
Exhibit "A".
NOW THEREFORE, THIS AOREEMENT WITNESSETH: That the said
CONTRACTOR, for and in consideration of the sum of One II 1.00)
Dollar to them in hand paid by OWNER, the receipt whereof is
hereby acknowledged, and the further consideration .entioned in
the agreement aforesaid, for himself and his subcontractors, and
all parties acting through 01' under him, covenant and agree that
no mechanic's liens 01' claims shall be filed or maintained by him
or any of them against the said buildings and the lot of ground
appurtenant thereto for or on account of any work done 01'
materials furnished by him or any of them under said contract or
otherwise, for, towards, in, 01' about the erection and
construction of the said buildinlls on the lot above deacribed,
and the said CONTRACTOR, for hi.self, his subcontractors and
others under them hereby expressly waive and relinquish the right
to have, file, and maintain any mechanic's liens or claims
against the said real estate and/or buildings or any of them, and
agree that this instrument, waiving the right of lien, shall be
an independent covenant.

ALL that certain tract of land situate in Lower Hifflin
Township, Cumberland County, Pennsylvania, more
particularly bounded and described as follows:
DEGINNING at a set railroad spike in the centerline of
S.R. 944 known as the Enola Road, which point is in the
Northwest corner of Lot No. 6 as shown on the
hereinafter referred to Plan of Lotsj thence alan. the
centerline of said S.R. 944 known as the Enola Road the
following courses and distances: North 37 degrees 40
minutes 13 seconds West 134.73 feet to a pointj thence
North 42 degrees 43 minutes 35 seconds West 66.22 feet
to a pointj thence North 55 degrees 26 minutes 19
seconds West 68.10 feet to a pointj thence North 72
degrees 24 minutes 34 seconds West 130 feet to a point;
thence North 81 degrees 47 minutes 33 seconds West
42.04 feet to a set railroad spike in the line of lands
designated as Area Parcel "3A" on the hereinafter
referred to Plan of Lotsj thence along the said Area
Parcel "3A" South 32 degrees 56 minutes 40 seconds West
352.97 feet to an iron pin; thence continuing alan. the
line of Area Parcel "3A" South 14 degrees 56 minutes 58
seconds East 693.38 feet to an iron pin in the line of
lands now or formerly of Lee A. Clouse; thence alan.
the lands now or formerly of Clouse South 61 degrees 52
minutes 41 seconds East 421.22 feet to an iron pin in
the line of lands of Lot No. 6 as shown on the
hereinafter referred to Subdivision Plan; thence along
said Lot No. 6 North 1 degree 18 minutes 47 seconds
West 675.38 feet to a set railroad spike in the
centerline of S.R. 944 known as the Enola Road at the
place of BEGINNING. CONTAINING 396,361 aquare feet
(9.099 acres) including the right-of-way and being
known as Lot No. 6 on the Final Subdivision Plan for
George H. Gries recorded in Cumberland County Plan Book
64, Page 66.
